赵明福民主促进会与明福家属不满首相安华多次拒见(他们),而决定在即将来临的元宵节(即阳历2月24日)上午11时正,到行动党的半山芭总部,向陆兆福拜年和探问关于明福命案调查的进展。人民之友工委会2024年2月5日(星期一)发表《5点声明》,表达我们对赵明福冤死不能昭雪事件的严正立场和明确态度。

人民之友工委会根据本身以往对全国大选和州议会选举的论述,结合团结政府成立后的政治形势,决定对新古毛州议席补选,于2024年5月8日发表声明,供新古毛选民5月11日投票以至全国各族人民今后行动的参考。

雪州宗教局昨天阻止一名被怀疑是穆斯林的新娘,在八打灵再也一间兴都庙完婚,招致非议。兴权会今天敦促国会议员,阻止这些“过份热心”的宗教局官员踩线,在执法时做出超越权限的行动。

兴权会主席瓦塔慕迪炮轰宗教局,在怀疑新娘是穆斯林的情况下,进入兴都庙阻止婚礼。

《阳光日报》报导,一项来自宗教局的消息指称,该局援引
1988年非伊斯兰宗教(管制向穆斯林传教)法令,避免穆斯林脱教,来合理化该局在婚礼上带走新娘之举。
 
新娘与亲人配合检举 

根据报导,宗教局官员昨早10点展开检举,并在“情况受控”下带走32岁新娘;在过程中,新娘、新郎家属与客人都配合官员的执法,当时警员也在场外驻守。

新娘被带返雪州宗教局位于沙亚南的总部,接受质询。消息指称,她在录取口供时说,其父替她们4名兄弟姐妹皈依伊教后,就抛弃他们,她在成长期间接触的是兴都教。

称可产生不必要困扰

瓦塔慕迪不认同宗教局的检举行为,并感到愤怒。

“这是非法检举,它不仅违宪,也会产生不必要困扰。”
 
“宗教局的行动,明显不尊重非穆斯林与他们的膜拜场合。他们的行动,明显超越其权限。”

瓦塔慕迪表示,雪州宗教局的行为已违反联邦宪法,赋予人民信仰自由权利的第11条款。

“雪州宗教局与当局不应这么理所当然,(去触动)其他宗教敏感度。”

“不仅是穆斯林对本身宗教具有敏感度,其他宗教的信徒也有同样的感受。”

庆幸未发生不快事故

瓦塔慕迪表示,雪州宗教局应该庆幸的是,其执法行动未在兴都庙引发不乐见的事故。

“这个国家有一个很严重的问题,政府公务员以马来人为主,因此这种以穆斯林思维为重心的官员,将把其宗教价值观灌入政府行政里,并当成至高无上的(指标)。”

今年1月2日,雪州宗教局检举大马圣经公会,充公321本《马来圣经》与伊班文圣经后,带回去调查,引起社会高度关注。

过程中,该局将2名工作人员带回录取口供,迄今此案仍未解决。

兴权会针对雪兰莪伊斯兰宗教局突然进行搜捕、阻止兴都教婚礼一事,发表声明。

兴权会谴责雪兰莪伊斯兰宗教局于昨日(6月1日)突然采取行动、阻扰一场行将在一所兴都庙举行的婚礼。

雪兰莪伊斯兰宗教局对上述婚礼的突击行动是非法、违宪的,并具有怂恿扰乱社会安宁的作用。雪兰莪伊斯兰宗教局采取这项行动显然是毫不尊重非穆斯林(即穆斯林以外的其他教徒)对其宗教信仰和膜拜场所的敏感。这项行动是一项明显越逾他们的权限范围的行动。

据《阳光日报》和《当今大马》报道,雪兰莪伊斯兰宗教局是援引《1988年非伊斯兰宗教(对穆斯林传教的管制)法令》采取行动(强 行带走新娘,说是进行调查)。上述法令阐明,对穆斯林进行劝服、影响或唆使 脱教是一项犯罪行为。

上述法令并不赋予雪兰莪宗教局任何权利突击兴都庙进行搜捕以及阻止兴都教徒举办婚礼。他们的行动本身是明显(违宪)的。

这场婚礼是在新娘所同意并理解她所处的困难境况下举行的,新娘从出生以来就过着兴都教徒的生活,父亲在她年幼的时候替她皈依伊斯兰教,她并不知情。

此外,新娘根据自己的意愿,踏入婚姻的殿堂,她没有受到任何强迫或煽惑。因此,上述法令怎能适用在这种情况呢?

雪兰莪伊斯兰宗教局官员的“过分嫉妒”态度恰恰说明了他们拥有任意干扰或妨碍非穆斯林的私人生活的自由而免受法律制裁。

如今,雪兰莪伊斯兰宗教局官员明显违反国家最高法律即联邦宪法第11条款,他们这种干扰、妨碍非穆斯林事务的绝对专横权力必须立即停止。

雪兰莪伊斯兰宗教局或穆斯林权力机构不应自以为可以理所当然触动其他宗教的敏感神经。穆斯林对伊斯兰教具有多少程度的敏感,其他教徒对他们本身所信仰的宗教也会有跟穆斯林同样(程度)的感受。

应该庆幸的是,在我们的庙堂里,没有发生不幸的事故。所有在场的人对雪兰莪伊斯兰宗教局在庙堂里所采取的非法和违宪行动保持冷静。

那些在不知情的情况下皈依伊斯兰教而引起的宗教争议以及国民登记局不愿按照民事法让受害者有机会(条件)补救并非由他们(受害者)本身所造成的失误,是导致争议不断发生的主要原因。

我们这个国家有一个有很严重的问题。公共服务是由以马来人和穆斯林为中心的官员所支配,他们强制将他们的个人宗教信仰置于政府行政上的至高无上的地位。

他们的行为就是毫不含糊地通过政府宣传媒介和国家机器压迫非穆斯林群体和他们的宗教信仰。

兴权会呼吁所有朝野国会议员在国会提出一项动议,纠正和修改现存的法律框架或条款,以保护个人的宗教信仰自由——这是期待已久的事。

Kami, 47 pertubuhan sivil, kesatuan sekerja dan kumpulan prihatin yang dinyatakan dibawah ini, kini membuat tuntutan berikut demi memastikan hak pekerja dan kesatuan sekerja dijamin di Malaysia. Adalah sedih apabila kerajaan mengutamakan kepentingan perniagaan, pelabur dan majikan lebih daripada hak dan kebajikan pekerja dan keluarga mereka.

1- KERJA TETAP ‘REGULAR’ SEHINGGA UMUR PERSARAAN – MANSUHKAN KERJA ‘PRECARIOUS’(TIDAK STABIL) KERJA KONTRAK JANGKA PENDEK

Hak untuk kerja tetap sehingga umur persaraan adalah penting untuk kesejahteraan ekonomi dan kestabilan kewangan pekerja dan keluarga mereka.

Kerja kontrak jangka pendek atau jangka tetap adalah jenis kerja ‘precarious’(tak stabil/tidak menentu) yang harus dimansuhkan. Kerja kontrak jangka pendek membenarkan penafian hak bersara pada umur 60, hak dan faedah ‘maternity’, penambahan hak yang berlaku apabila tambah tempuh perkhidmatan, menjadikan hamper mustahil untuk pekerja menubuhkan, menyertai atau berkhidmat dalam kepimpinan kesatuan sekerja sedia ada. Kontrak jangka pendek sebegini, yang biasa untuk satu tahun atau kurang, dengan tidak ad hak untuk perlanjutan tempuh kerja walaupun kerja masih wujud, melemahkan keupayaan seseorang pekerja berjuang untuk hak pekerja yang lebih baik, dan semestinya melemahkan kesatuan sekerja atau menjadikan proses menubuhkan kesatuan mustahil.

Kami menuntut untuk jaminan hak kerja tetap sehingga persaraan, dan pemansuhan kontrak kerja jangka pendek atau amalan pengajian sedemikian yang tidak stabil(precarious)

2 – MANSUHKAN SISTEM ‘CONTRACTOR FOR LABOUR’ – PASTIKAN PERHUBUNGAN KERJA TERUS DI ANTARA PEKERJA DAN PEMILEK/OPERATOR TEMPAT KERJA

Perhubungan kerja terus di antara pekerja dan tuan punya/operator tempat kerja, principal, adalah penting untuk memastikan pekerjaan stabil, di mana majikan afa obligasi untuk memastikan hak dan kebajikan pekerja dipelihara dengan terbaik. Seorang ‘ contractor for labour’(COL) harus tidak menjadi majikan, dan peranan mereka, jika ada pun, harus hanya untuk membekalkan pekerja kepada tuanpunya/operator tempat kerja atau secara alternative mencari pekerja pekerjaan dengan majikan, dan untuk perkhidmatan tersebut harus dibayar fi(‘fee).

Pemilik/operator tempat kerja, yng juga dikenali sebagai ‘principal’, yang sepatutnya mempunyai pekerjaan terus dengan pekerja yang bekerja ditempat kerja mereka. Tuntutan ini telah dilakukan dulu melalui Kenyataan Bersama 93 kumpulan bertarikh 3/5/2012 bertajuk,‘Mansuhkan Sistem ‘Contractor For Labour’ – Tarik balik pindaan 2012 kepada Akta Kerja 1955 (Abolish the ‘Contractor for Labour’ system - Withdraw the 2012 amendments to Employment Act 1955’), dan juga melalui kenyataan terdahulu oleh 115 kumpulan pada 28/10/20111 bertajuk, ‘Malaysia Harus Memastikan hak Pekerja dan Kesatuan sekerja, dan menarik balik cadangan pindaan tidak adil kepada Akta Kerja – Pembekal Pekerja tidak harus menjadi Majikan’(‘Malaysia Must Protect Worker and Union Rights, and withdraw proposed unjust amendments to Employment Act - Labour Suppliers Should Not Be Employers’.) Kami juga menarik perhatian kepada Resolusi Majlis Peguam Malaysia tahun 2012, yang menyatakan pendirian sama, di antara lain menyatakan bahawa, ‘ Majlis Peguam berpendirian bahawa pembekal pekerja dan/atau ‘contractor for labour’ harus tidak atau terus menjadi majikan pekerja yang mereka membekalkan kepada pekrja yang telah dibekalkan kepada, diterima dan yang telah mula bekerja di tempat kerja principal atau pemilik tempat kerja. Selepas itu, pekerja harus menjadi ‘employee’(pekerja) principal atau pemilik tempat kerja.’ Kami juga mengingat kembali piket dan protes yang dianjurkan MTUC menentang sistem ‘contractor for labour’.

3 – MENGHALANG ‘OUTSOURCING’ KERJA, PEMECAHAN SYARIKAT MAJIKAN DAN SKIMA SEDEMIKIAN YANG SECARA EFEKTIF MENGHAPUSKAN SOLIDARITY PEKERJA DAN MERUPAKAN TINDAKAN ‘MENGHANCURKAN KESATUAN SEKERJA’(UNION BUSTING)

Untuk mengelakkan kesatuan sekerja dan perhubungan kerja, setengah majikan telah ‘outsourcing’ sebahagian kerja mereka kepada kontraktor pihak ketiga, yang kemudian mengunakan pekerja sendiri untuk melakukan kerja tersebut. Ini berlaku, antara lain, di sector perladangan, dan Kesatuan Sekerja Pekerja Perladangan(NUPW), yang dahulunya sebuah kesatuan sekerja yang kuat, pada hari sudah dilemahkan walaupun bilangan pekerja di sector perladangan kekal sama atau telah bertambah. Satu contoh lagi, adalah disektor perbankan bila setengan aspek industry perbankan saperti perbankan internet atau talipon telah di’outsource’ kepada pihak ketiga. “Outsourcing’ kerja adalah satu lagi strategi ‘union busting’, yang melemahkan kesatuan sekerja, dan menafikan ahli kesatuan hak sedia ada dalam Perjanjian Koletif Bersama(CBA).

Satu lagi cara yang digunakan adalah dengan memecahkan sesuatu syarikat majikan kepada beberapa syarikat yang kecil, sesuatu yang kini difikirkan oleh Tenaga Nasional Berhad(TNB). Ini telah ditentang dengan kuat oleh 4 kesatuan sekerja yang kini mewakili ramai pekerja TNB. Pemecahan ini, jika berlaku, akan melemahkan kesatuan sekerja yng kini kuat, dan kemungkinan akan menfikan ahli kesatuan sedia ada hak dan faedah yang kini mereka menikmati melalui Perjanjian Kolektif Bersama. Bila syarikat baru diwujudkan, pekerja akan menjadi pekerja entity baru dan terpaksa melalui proses panjang menubuhkan, selepas itu mendapatkan pengiktirafan lagi, dan memasuki CBA baru dengan majikan baru ini, satu proses yang mungkin akan mengambil masa lama. Kami menyokongan kenyataan bersama 4 Kesatuan Sekerja di TNB, iaitu Persatuan Eksekutif Tenaga Nasional Berhad (PETNB), Kesatuan Percantuman Pekerja-Pekerja TNB (KPPPTNB), Tenaga Nasional Junior Officers Union (TNBJOU) dan Persatuan Unit Keselamatan TNB (PERUNIKA) bertarikh14/11/2013 menentang cadangan memcahkan TNB.

4 – BERHENTI PEMBUANGAN KERJA DAN PENGANIYAAN PEMIMPIN KESATUAN SEKERJA DAN PEKERJA UNTUK TINDAKAN MEMPERJUANGKAN HAK PEKERJA DAN MENIMBULKAN KETIDAKADILAN.

Bila presiden National Union of Flight Attendants Malaysia (NUFAM) mengeluarkan kenyataan selaku Presiden Kesatuan Sekerja mendedahkan (highlight) juga beberapa isu pekerja yang masih belum diselesaikan oelj Malayian Airline(MAS), beliau diberhentikan kerja atas alas an mengeluarkan kenyataan selaku pekerja. 53 kumpulan telah mengeluarkan kenyataan bertarikh 3/3/2014 bertajuk “Malaysian Airline Harus Menghormati Hak Kesatuan Sekerja dan Pekerja – Berhenti Tindakan ‘Union Busting’ Terhadap NUFAM dan ahlinya’[ ‘Malaysian Airlines Must Respect Trade Union and Worker Rights -Cease Anti-Union activities against NUFAM and its members’] dan kami juga merujuk kepada kenyataan terdahulu yang dikeluarkan 43 kumpulan pad 3/12/2013 bertajuk, ‘MAS Harus Segera Membatalkan ‘suspension’ presidn kesatuan sekerja Ismail Nasaruddin – Isu Hak Pekerja harus diselesaikan melalui rundingan Bukan melalui ‘Union Buting’. [‘MAS Must Immediately Revoke Suspension of Union President Ismail Nasaruddin Worker Right Issue Should Be Resolved By Negotiations Not ‘Union Busting’. ]

Juga, 18 pekerja telah dibuang kerja oleh anak syarikat DRB HICOM kerana menghantarserahkan memorandum MTUC kepada calum dalam Pilihanraya Umum yang lalu, di mana objektif MTUC adalah untuk mendapatkan komitmen bakal ahli Parlimen berkenaan isu hak pekerja. Kami mengulang kenyataan 51 kumpulan yang dikeluarkan pada 25/6/2013 bertajuk, “ DRB HICOM harus menghormati hak rakyat untuk mengambil bahagian dalam proses demokratik – berhenti tindakan disiplin terhadap pekerja yang melaksanakan hak politik mereka’ [“DRB HICOM Must Respect The Citizens’ Right To Participate In The Democratic Process In Malaysia– Stop disciplinary action against workers for exercising their political rights.”]

Ramai lagi pemimpin Kesatuan Sekerja yang telah ditamatkan perkhidmatan kerana mendedahkan keridakadilan yang berlaku kepada pekerja, antara lain, Abdul Jamil Lalaludeen dan Chen Ka Fattyang merupakan Naib Presiden dan Bendahari National Union of Bank Employees (NUBE); Hata Wahari, Presiden National Union of Journalists(NUJ); Ismail Nasaruddin, Presiden NUFAM; dan Wan Noorulazhar , Presiden Electronic Industry Employees Union Western Region, Peninsular Malaysia (EIEUWR). Kami menarik perhatian kepada Kenyataan 87 kumpulan bertarikh 4/4/2013, RENESAS Harus Segera Mengiktiraf Kesatuan Sekerja dan Mengembalikan Kerja Wan Noorulazhar [‘RENESAS Must Immediately Accord Recognition To The Union And Reinstate Wan Noorulazhar.’]

Kami menuntut pemberhentian tindakan pembuangan kerja, diskriminasi dan lain jenis penganiyaan terhadap ahli kesatuan sekerja dan pemimpin pekerja, di mana semua tindakan sedemikian secara wajar harus dilihat sebagi tindakan ‘union busting’ dilakukan majikan yang tidak baik, yang pada masa ini seolah-olah direstui kerajaan Malaysia.

Kami menuntut pemansuhan undang-uangan yang kini membenarkan majikan membuang kerja ahli kesatuan sekerja dengan senang-senang mengambil kira ianya suatu salahlaku kerja seorang pekerja biasa, Sebagi contoh, Presiden NUFAM di buang kerja kerana MAS menganggap tindakan seorang pekerjanya mengeluarkan kenyataan media adalah salah laku kerja.

5 – HAK UNTUK MENDAPATKAN SIASATAN DALAMAN[DOMESTIC INQUIRY] SEBELUM DIBUANG KERJA

Ismail Nasarudin dan 4 yang lain daripada NUFAM telah dibuang kerja oleh MAS tanpa apa-apa Siasatan Dalaman (Domestic Inquiry). …..Harmoni Perhubungan Industri ..keadilan menuntut bila majikan mendakwa bahawa pekerja telah melakukan salahlaku kerja, natural justice memerlukan bahawa pekerja diberikan hak didengar dan hak menghadapi dakwaan ini di hadapan satu panel yang berkecuali.

Di dalam kes 18, yang telah dibuang kerja oleh anak syarikat DRB HICOM, mereka ada Siasatan Dalaman(DI) tetapi hak untuk diwakili oleh wakil kesatuan dinafikan. Mereka hanya dibenarkan diwakili oleh pekerja daripada tempat kerja mereka.

Memandangkan, bahawa kebanyakkan pekerja tidak menjadi ahli kesatuan sekerja atau ada kesatuan sekerja, adalah penting demi keadilan bahawa semua pekerja harus mempunyai hak untuk mendapat Siasatan Dalaman(DI), dan hak ini perlu diberikan melalui undang-undang. Hak untuk pekerja yang didakwa melakukan salahlaku kerja untuk diwakili peguam, ahli kesatuan sekerja atau pekerja pilihan mereka sendiri juga harus dijamin.

6 – SALAHLAKU KERJA HARUS DITETAPKAN OLEH UNDANG-UNDANG

Majikan telah sewenang-wenang menambahkan jumlah salahlaku kerja, di mana kebanyakkan daripada salahlaku ini adalah juga tidak jelas dan/atau yang secara terus menghakis/menafikan hak asas pekerja atau kesatuan sekerja mereka, termasuk juga hak asas pekerja mendedahkan ketidakadilan, berjuang untuk hak pekerja serta juga hak membuat aduan atau representasi kepada pihak berkuasa berkenaan penncabulan hak pekerja atau salahlaku majikan.

Di dalam kes DRB HICOM, satu daripada salahlaku kerja yang didakwa adalah, ‘‘Membawa atau cuba membawa apa-apa bentuk pengaruh atau tekanan luar untuk mengemukakan dan menyokong sesuatu tuntutan berhubung dengan perkhidmatan sama ada tuntutan itu adalah tuntutan secara individu atau tuntutan lain-lain kakitangan” Bagaimana ini boleh dikatakan salahlaku kerja bila inilah apa yang pekerja dan kesatuan sekerja lakukan – menonjolkan ketidakadilan dan berkempen untuk sokongan yang semestinya akan menjana tekanan. …dan sebagainya ke atas majikan. Ini juga niat mana-mana piket. Ianya tidak masuk akal, bila perkara ini dijadikan salahlaku kerja. 51 kumpulan telah pada 25/6/2013, mengeluarkan kenyataan, ‘DRB HICOM HARUS menghormati hak rakyat untuk mengambil bahagian dalam proses demokrasi – berhenti tindakan disiplin terhadap pekerja yang melaksanakan hak politik mereka’(‘DRB HICOM Must Respect The Citizens’ Right To Participate In The Democratic Process In Malaysia– Stop disciplinary action against workers for exercising their political rights.’). Kini, pekerja di MAS juga menghadapi tindakan disiplin kerana membawa aduan mereka ke Putrajaya.

Salahlaku kerja seharusnya tidak cuba mengurangkan hak pekerja, kebebasan bersuara, hak selaku rakyat dan hak asasi yang lain. Saperti kesalahan jenayah, salahlaku kerja mestilah jelas dinyatakan termasuk apakah juga hukuman yang akan dikenakan jika salahlaku berkenaan dibuktikan atau diakui pekerja tertuduh.

Demi menjamin keselamatan pekerja, harus terdapat undang-undang yang mendefinasikan atau menetapkan apakah salkahlaku kerja, menghadkannya kepada perkara yang berkenaan tempat kerja atau secara munasabah yang ada kaitan dengan kerja. Cubaan majikan mengawal kehidupan peribadi, kebebasan dan hak asasi pekerja terutamanya di luar masa kerja seharusnya tidak sama sekali dibenarkan.

7 – BILA PEMBUANGAN KERJA DIPUTUSKAN SEBAGAI SALAH DAN/ATAU TANPA ASAS MUNASABAH, HAK UNTUK MENDAPATKAN KERJA KEMBALI TANPA KEHILANGAN FAEDAH HARUS DIJAMIN

Bila seseorang pekerja dibuang kerja secara salah, keadilan dituntut pekerja memohon kerja kembali dengan membuat aduan yang akhirnya akan sampai di Mahkamah Perusahaan yang menentukan sama ada pemnbuangan kerja itu adalah salah atau tidak. Jika didapati pekerja dibuang kerja secara salah, majikan seharusnya diperintahkan mengambil kembali pekerja tanpa kehilangan apa-apa faedah. Secara alternative, pekerja juga harus boleh menuntut pampasan sebagai ganti mendapat kerja kembali.

Di Malaysia, hak membuat pilihan sama ada mahu kerja kembali atau menerima pampasan sebagai ganti telah dirampas daripada pekerja, dan diletak kepada budibicara Mahkamah yang pada masa kini didapati jarang mengarahkan kerja kembali tetapi pampasan sebagai ganti kerja kembali. Pada tahun 2007, satu Jadual 2 yang baru ditambahkan kepada Akta Perhubungan Perusahaan 1977, yang secara tidak adil bukan sahaja menghadkan kuantum pampasan sebagai ganti kembali kerja kepada tidak lebih daripada 24 bulan, dan untuk mereka yang masih dalam tempuh percubaan tidak lebih daripada 12 bulan tetapi juga membenarkan potongan lain daripada jumlah ini. Ini semua tidak akan menakutkan (deter) majikan membuang pekerja secara salah, tetapi sebaliknya memberanikan majikan mengunakan ‘pembuangan kerja secara salah’ sebagai taktik mengeluarkan pemimpin pekerja dan kesatuan sekerja daripada kalangan pekerja mereka. Jadual 2 ini, yang tidak adil bagi pekerja, harus di mansuhkan, dan pilihan sama ada mahu kembali kerja atau terima pampasan sebagai alternatik kembali kerja harus di tangan pekerja mangsa pembuangan kerja secara salah.

8 – TEMPUH PERCUBAAN (PROBATION) DAN HAK LAIN HARUS DIJAMIN UNDANG-UNDANG UNTUK SEMUA PEKERJA

Lebih daripada 92% pekerja di Malaysia bukan ahli kesatuan sekerja, dan oleh kerana itu mereka tidak ada mekanisma Perjanjian Bersama, yang mungkin dapat memastikan hak pekerja yang dijamin secara khusus dalam perundangan buruh masih dapat juga dinikmati pekerja. Probation(Tempuh Percubaan) adalah contoh satu daripada hak ini, di mana secara munasabah tempuhnya tidak harus lebih daripada tiga(3) bulan, yang merupakan jangkamasa cukup untuk mana-mana majikan menilai kesesuaian seseorang pekerja dan seteruskan mengesahkan sebagai pekerja tetap sampai umur persaraan.

Kini, ramai majikan menyalahgunakan kekurangan perundangan buruh ini, dan membiarkan pekerja terus wujud sebagai pekerja dalam tempuh percubaan untuk jangkamasa yang panjang, kadang-kadang bertahun-tahun, dan ini kerana seseorang pekerja dalam tempuh percubaan ada hak kurang berbanding pekerja yang sudah disahkan pekerja tetap. Undang-undang harus menetapkan tempoh maksima tempoh percubaan, termasuk juga peruntukan pasti bahawa selepas tiga(3) bulan, pekerja dianggap sebagai pekerja tetap.

9 – CEPATKAN PENDAFTARAN DAN PENGIKTIRAFAN KESATUAN SEKERJA

Sedangkan hak masa dan akibat ketidakpatuhan kehendak tempuh masa melakukan sesuatu wujud dalam perundangan buruh untuk perkara yang patut dilakukan pekerja atau kesatuan sekerja, jelas provisi sedemikian untuk tindakan majikan tidak ada. Pengiktirafan kesatuan sekerja di RENESAS mengambil lebih kurang 4 tahun. Di dalam kes ini, ada kalanya majikan RENESAS gagal mematuhi arahan Kementerian atau lewat mematuhi keperluan undang-undang, di mana ini semua boleh majikan lakukan kerana undang-undang tidak menetapkan masa melakukan sesuatu atau kesan kegagalan majikan melakukan sesuatu – ini membenarkan majikan dengan begitu mudah memperlewatkan hak pekerja atau kesatuan sekerja.

Pengiktirafan kesatuan adalah satu pra-syarat yang perlu diikuti di Malaysia sebelum majikan dan kesatuan sekerja dapat memasuki Perjanjian Bersama, di mana proses ini harus dipercepatkan dan diuruskan dengan pantas, sebaiknya tidak mengambil lebih daripada tiga(3) bulan. Keputusan ‘undi sulit’ harus hanya berasaskan bilangan undi dalam kotak undi, di mana kini ianya secara tidak adil juga mengambil kira bahawa mereka yang tidak dapat membuang undi atas andaian bahawa mereka ini semua sebenarnya tidak mahu kesatuan. Ini tidak adil.

Hak semakan kehakiman tidak boleh dinafikan, tetapi bila ianya digunakan majikan sebagai cara melewatkan pengiktirafan kesatuan sekerja, adalah perlu prosiding Mahkamah dipercepatkan untuk memastikan hak pekerja dan kesatuan sekerja tidak dinafikan atau dilewatkan. Adalah memalukan bagaimana setengah majikan sanggup berbuat apa sahaja untuk menafikan hak pekerja. Sebagai contoh, Malaysian Airlines(MAS), kini mencabar keputusan Menteri memberikan pengiktirafan kepada NUFAM selepas undi sulit dengan jelas menunjukkan bahawa 62.73% flight attendant di MAS mahu NUFAM sebagai kesatuan sekerja yang mewakili mereka. Di dalam kes RENESAS, pengiktirafan kesatuan sekerja dilewatkan setahun lebih akibat Semakan Kehakiman dan Rayuan seterusnya di Mahkamah oleh majikan. Sebagai polisi, semakan kehakiman dan rayuan sedemikian harus cepat dihabiskan kerana kelewatan mengakibatkan hak pekerja, dan tidakan Mahkamah sedemikian tidak harus digunakan untuk melewatkan proses mendapat pengiktirafan, atau pun proses kemasukkan Perjanjian Bersama.

10 – PERTIKAIAN PERUSAHAAN(TRADE DISPUTES) HARUS DISELESAIKAN CEPAT DAN ‘STATUS QUO’ SEMUA PIHAK HARUS DIKEKALKAN SEHINGGA ADA PENYELESAIAN

Sejarah menunjukkan bahawa mogok dan tindakan perusahaan merupakan cara paling berkesan bagi pekerja dan kesatuan sekerja menyelesaikan pertelingkahan dengan majikan dan menuntut hak, tetapi kerajaan Malaysia telah masuk campur menghakis atau menghadkan pilihan pekerja dan kesatuan sekerja yang mengakibatkan kerugian kepada pekerja dan kesatuan sekerja. Kerajaan lebih cenderung kepada pilihan menyelesaikan pertikaian perusahaan(trade dispute) melalui proses aduan, perbincangan dan arbitrasi bukan melalui mogok dan tindakan perusahaan. Olehkerana ini, proses menyelesaikan pertikaian perusahaan ini harus dijalankan dengan cepat, dan pekerja dan ahli kesatuan sekerja harus secara berkesan dipastikan selamat daripada pembuangan kerja dan diskriminasi oleh pihak majikan sewaktu dan sehingga penyelesaian pertikaian perusahaan dan/atau aduan ini dicapai.

Kebanyakkan pertikaian perusahaan dan aduan dimulakan oleh pekerja dan kesatuan sekerja, di mana kebanyakkan masa pekerja yang terbabit menjadi mangsa pembuangan kerja dan tindakan diskriminasi majikan manakala majikan terus saperti biasa meneruskan perniagaan mereka, justeru keadilan memerlukan agar semua pertikaian poerusahaan ini diselesaikan cepat, tak lebih daripada 30 hari, dan pekerja yang telah dibuang kerja akibat pemfailan atau berkenaan sesuatu pertikaian perusahaan harus terus dibayar gaji biasa sehingga pertikaian perusahaan ini berjaya diselesaikan. Majikan harus dihalang daripada membuang kerja pekerja dan ahli kesatuan sekerja yang melapurkan pertikaian perusahaan dan/atau aduan sehingga perkara ini diselesaikan.

11 – PEKERJA MIGRAN SEHARUSNYA TIDAK DIDISKRIMINASI

Gaji sama untuk kerja sama adalah adil. Ianya salah jika pekerja migran didiskriminasi dalam isu hak gaji minima, sebagai contoh kerajaan mencadangkan pekerja migran kini membayar levi, di mana levi sebenarnya pembayaran yang dikenakan atas majikan untuk mengalakkan majikan mengambil kerja pekerja tempatan berbanding dengan pekerja migran. 82 kumpulan telah pada 8/2/2013 mengeluarkan kenyataan bertajuk, Gaji Minima Untuk Semua Pekerja, termasuk Pekerja Migran – Tidak kepada Potongan Gaji untuk Mendapat Kembali Levi Yang Harus Dibayar Oleh Majikan’

12 – PEMBERIAN PENGECUALIAN SECARA ‘UNILATERAL’ KEPADA MAJIKAN UNTUK MENAFIKAN HAK PEKERJA YANG DIBERIKAN UNDANG-UNDANG HARUS BERHENTI

Undang-undang memberikan hak pekerja, tetapi banyak situasi di mana ada peruntukkan yang memberikan kuasa kepada Menteri memberikan pengecualian kepada majikan. Sebagai contoh, hak pekerja kerja maksima 8 jam setiap hari, atau maksima 48 jam seminggu boleh dielak jika majikan diberikan pengecualian. Keputusan member pengecualian diberikan tanpa pengetahuan awal pekerja terbabit, tanpa memberi hak kepada pekerja atau kesatuan terbabit atau untuk membantah permohonan majikan sebelum keputusan pengecualian diberikan. Keputusan pengecualian memang dapat dicabar dalam had masa tertentu, tetapi bagi pekerja, khususnya mereka yang tiada kesatuan sekerja, keupayaan atau kapasiti berbuat cabaran sedemikian tidak ada. Secara adil, hak didengar atau membantah permohonan majikan untuk pengecualian harus diberikan sebelum keputusan pengecualian dibuat. Sebenarnya, majikan seharusnya tidak diberikan pengecualian yang akan membawa kepada situasi hak pekerja atau kesatuan sekerja yang ditetapkan undang-undang dinafikan.

13 – GAJI MINIMA MEMADAI UNTUK MEMASTIKAN KEHIDUPAN BAIK (DECENT LIVELIHOOD)

Semua pekerja di Malaysia harus menerima gaji minima mulai 1 Januari 2014 tetapi malangnya kuantum gaji minima ini ditetapkan pada tahun 2012, iaitu RM900 untuk Semenanjung Malaysia dan RM800 untuk Sabah dan Sarawak, di mana jumlah ini kini sudah tidak lagi mencukupi memastikan kehidupan baik(decent) untuk pekerja dan keluarga memandangkan peningkatan tinggi kos sara hidup. Manakala, pekerja dalam sector awam mendapat juga Elaun Kos Sara Hidup [Cost of Living Allowances(COLA)], pekerja sector swasta tidak mendapatkan COLA. Mengambil kira juga hakikat bahawa kerajaan Malaysia telah berpendirian bahawa isirumah yang mendapatkan pendapatan kurang daripada RM3,000 sebulan memerlukan bantuan kewangan, secara lojik gaji minima harus dinaikkan kepada sekurang-kurang RM1,500.

COLA juga harus dijadikan hak undang-undang bagi pekerja, khususnya mereka yang berpendapatan rendah. Kadar Gaji Minima juga harus dikaji semula sekurang-kurang setiap 6 bulan mengambil kira bahawa peningkatan kos sara hidup kini begitu cepat, dan jumlah wang sebenarnya yang diperlukan untuk memastikan kehidupan baik ‘decent’ pekerja dan keluarganya.

14 – HAK UNTUK MENDAPATKAN FAEDAH ‘TIDAK ADA KERJA’(UNEMPLOYMENT BENEFITS)

Pada masa kini, bila pekerjaan adalah tidak stabil (precarious), kerajaan perlu menyediakan skim faedah ‘tidak ada kerja’(unemployment benefits) untuk membantu pekerja dan keluarga mereka bila mereka tidak ada kerja. Walaupun tidak ada kerja atau pendapatan, obligasi perlu bayar sewa, bil keperluan asas, hutang kereta atau rumah, bayaran pembelajaran kanak-kanak, dll masih perlu dilakukan oleh pekerja yang tidak ada kerja dan sumber pendapatan. Tanpa bantuan kewangan dalam bentuk faedah ‘pekerja tak ada kerja’(Unemployment benefit), kehidupan pekerja dan keluarga akan terjejas dengan serius. Sokongan semasa susah saperti ini kini wujud di Negara lain, termasuk juga negara jiran Thailand.

15 – HAK UNTUK TIDAK DIDISKRIMINASI BERASASKAN JANTINA

Walaupun Perlembagaan Persekutuan menjamain layanan sama rata, mahkamah telah berkeputusan bahawa obligasi tidak mendiskriminasi pekerja berasaskan jantina adalah hanya obligasi bila majikan adalah kerajaan atau badan berkanun – majikan sector swasta tidak ada obligasi sedemikian. Ini secara jelas bercanggah dengan obligasi Malaysia di bawah Konvensyen Penghapusan Semua Jenis Diskriminasi Terhadap Perempuan[Convention on the Elimination of All Forms of Discrimination against Women (CEDAW)] yang Malaysia telah tandatangani. Undang-undang patut dipinda untuk memastikan bahawa semua majikan tidak dibenarkan mendiskriminasi pekerja berasaskan jantina atau apa bentuk diskriminasi yang lain.

16 - KESELAMATAN DAN KESIHATAN PEKERJAAN DI TEMPAT KERJA

Jabatan Keselamatan dan Kesihatan Pekerjaan (DOSH) merekodkan 1,248 kemalangan tempat kerja di 10 sektor pada 5 bulan pertama tahun 2013, yang mengakibatkan 68 pekerja maut, 81 hilang upaya kekal, dan 1,099 kecederaan tidak mengakibatkan kecacatan kekal.

Pada tahun 2010, sejumlah 1426 kes penyakit pekerjaan(occupational disease) dan keracunan telah dilapurkan kepada Bahagian Kesihatan Pekerjaan berbanding dengan 791 kes yang dilapurkan tahun sebelumnya, di mana hanya lebih kurang separuh berjaya disiasat secara berkesan. Di antara penyakit kesihatan yang dilapurkan adalah kehilangan pendengaran akibat bunyi (noise induced hearing loss (NIHL)), penyakit kulit pekerjaan(occupational skin diseases) dan penyakit paru-paru pekerjaan(occupational lung diseases). Secara umum tahap kesedaran mengenai penyakit pekerjaan adalah rendah, tambah lagi bila ia diketahui lama selepas pekerja sudah meninggalkan tempat kerja berkenaan – maka berlaku kurang lapuran (under reporting) mengenai penyakit pekerjaan. Untuk peklerja migrant(asing) yang telah kembali kepada negara asal, kini masih tidak wujud mekanisma aduan atau akses kepada keadilan yang berkesan bila ia melibatkan penyakit pekerjaan.

Malaysia harus menambahkan kesedaran mengenai penyakit pekerjaan, dan harus lebih komited memastikan penguatkuasaan aktif untuk memastikan keselamatan dan keihatan pekerjaan di tempat kerja. Hospital dan pengamal perubatan harus diperlukan memaklumkan kepada pekerja dengan penyakit atau keadaan kesihatan yang mungin berkait dengan tempat kerja hakikat ini, dan juga di mana mereka boleh membuat aduan dan akses keadilan.

Memandangan ramai majikan juga ada menyediakan tempat penginapan pekerja, harus ada undang-undang menetapkan piawaan minima perumahan pekerja yang akan memastikan kesihatan dan keselamatan pekerja. Pekerja migrant datang ke Malaysia yang sihat (with a clean bill of health) yang kemudiannya dihantar kembali ke negara asal berasaskan penyakit saperti penyakit batuk kering (TB), yang kemungkinan besar disebabkan tempat tinggal pekerja yang sesak dan sempit(cramped) atau tempat kerja, dan oleh kerana ini senarai penyakit pekerjaan harus dikaji semula untuk memasukkan penyakit yang mungkin disebabkan akibat keadaan tempat kerja atau juga keadaan perumahan pekerja yang kurang memuaskan.

17 – HAK PEKERJA DALAM UNDANG-UNDANG UNTUK SEMUA PEKERJA

Memandangkan di Malaysia, kebanyakkan pekerja tidak tahu mengenai hak pekerja atau kesatuan sekerja, tambahan juga kerana hakikat bahawa hak pekerja dan kesatuan tidak pun di ajar disekolah atau kolej, di mana ini memerlukan bahawa undang-undang menetapkan dan menjamin hak pekerja minima untuk semua, yang tidak terhad kepada yang hanya berpendapatan RM2,000 atau kurang, atau hanya untuk pekerja klas tertentu sahaja. Pekerja domestic, sama saperti pekerja lain, seharusnya mempunyai hak sama menikmati hak minima pekerja yang ditetapkan undang-undang.

18. JANGAN TANDATANGAN PERJANJIAN YANG AKAN MENGHAKIS ATAU MEMBANTUT HAK PEKERJA

Malaysia telah dan masih mahu tandatangani Perjanjian Perdagangan Bebas(Free Trade Agreements) dan perjanjian lain, saperti Perjanjian Perkongsian Trans-Pasifik (Trans-Pacific Partnership Agreement [TPPA]) tanpa bersikap terbuka dan telus mengenai kandungan perjanjian berkenaan, dan tanpa konsultasi dengan rakyat. Beberapa perjanjian ini, kini diketahui mengandungi fasal/klausa yang akan membawa kesan bukan sahaja menghakis tetapi juga membantut hak pekerja. Satu fasal sedemikian adalah Fasal Perlindungan Pelabur (Investor Protection Clause), yang melindungi pelabur dan juga membenarkan pelabur mengambil tindakan undang-undang terhadap kerajaan sekiranya kerajaan berbuat sesuatu di masa depan yang akan mengakibatkan majikan diperlukan membelanjakan lebih wang, atau melakukan perkara yang akan menjejaskan keuntungan perniagaan. Maka, jika Malaysia pada masa depan bertindak memperbaiki perkara saperti hak pekerja, keselamatan pekerja, kesihatan awam dan perlindungan alam sekitar, di mana ini akan memerlukan perniagaan berbelanja lebih yang akan mengakibatkan keuntungan, Malaysia mengadapi risiko akan disaman atau diambil tindakan undang-undang, di mana ini berkemungkinan akan menghalang kerajaan Malaysia memperbaiki hak dan keadaan kerja pekerja di Malaysia

Harus disedari bahawa tuntutan atau isu pekerja dan kesatuan sekerja yang disenaraikan di atas sama sekali bukan komprehensif(comprehensive), tetapi adalah senarai setengah isu asas yang masih memerlukan tindakan, dan seharus tidak dibenarkan dilupakan akibat pengedaran masa, pengawalan media atau sebab lain.

Obligasi menghormati dan menjamin hak pekerja dan kesatuan sekerja bukan sahaja pada kerajaan Malaysia, tetapi juga perniagaan, ‘corporation’, majikan, kerajaan negara daripada mana datang mereka yang memiliki atau mengawal perniagaan, negara daripada mana datangnya pekerja migrant(asing), mereka yang merupakan penguna barangan atau perkhidmatan, lain perniagaan yang ada kaitan dengan majikan termasuk yang dalam supply chain (rantai pembekalan), dan secara umum semua dalam komuniti global. Berkompromosi piawai atau hak pekerja yang wujud di negara masing-masing atau perniagaan, atas alasan cukup memadai memenuhi keperluan khusus undang-undang Malaysia tidak boleh diterima.

Ruggie’s ‘Prinsip Pembimbing mengenai Perniagaan dan Hak Asasi: Implementasi Rangka Kerja Pertubuhan Bangsa-Bangsa Bersatu “Memelihara, Menghormati dan Remedi’ [Ruggie’s "Guiding Principles on Business and Human Rights: Implementing the United Nations 'Protect, Respect and Remedy' Framework"] adalah satu daripada piawaian dan pembimbing atau garis panduan (guidelines), yang harus diterimapakai kerajaan, perniagaan dan majikan. Ia bukan memadai untuk hanya sesebuah negara menandatangani atau meratifikasi Konvensyen atau Instrumen Pertubuhan Bangsa-Bangsa Bersatu(UN) dan Pertubuhan Buruh Antarabangsa(ILO) tetapi tidak melakukan apa yang perlu untuk memberikan kesan penuh di Malaysia.

Kami menuntut kerajaan Malaysia segera mengambil tindakan memastikan kesemua tuntutan di atas diberi kesan untuk memastikan keadilan untuk pekerja dan kesatuan sekerja di Malaysia. Hak dan kebajikan pekerja dan keluarga mereka harus dijadikan keutamaan mana-mana kerajaan, dan ini harus juga memerlukan penyediaan mekanisma memelihara kebajikan pekerja saperti faedah mereka yang tidak ada kerja (unemployment benefit) untuk pekerja mendapati diri mereka dalam keadaan tidak ada kerja.

Kami menuntut pengembalian kerja(reinstatement) kesemua pemimpin pekerja dan kesatuan sekerja termasuk Abdul Jamil Lalaludeen dan Chen Ka Fatt dari NUBE, Ismail Nasaruddin dari NUFAM, Wan Noorulazhar dari KSIEWBSM(EIUWR), dan Rusaini Mamat daripada NUTEAIW

Kami juga menuntut Malaysia segera meratifikasi Konvensyen ILO 87 Kebebasan Berpersatuan dan Penjagaan Hak Berorganisasi(ILO Conventions 87, Freedom of Association and Protection of the Right to Organise) dan lain-lain konvensyen pekerja yang penting. Kami juga menuntut Malaysia memberi kesan penuh kepada semua Konvensyen Pertubuhan Bangsa-Bangsa Bersatu(PBB/UN) dan Pertubuhan Buruh Antarabangsa(ILO) termasuk juga ILO Convention 98, Right to Collective Bargaining(Hak Untuk Perjanjian Bersama).

47 Groups :- WORKER AND TRADE UNION RIGHTS MUST BE PRIORITIZED
FOR THE WELL BEING OF THE WORKER AND THEIR FAMILIES 

Joint Statement– 2/6/2014


We, the undersigned 47 civil society organizations, trade unions and concerned groups, make the following demands to better protect worker and trade union rights in Malaysia. It is sad when a government places the interest of businesses, investors and employers over the rights and welfare of workers and their families.


1. STABLE REGULAR EMPLOYMENT UNTIL RETIREMENT AGE–ABOLISH PRECARIOUS SHORT-TERM EMPLOYMENT CONTRACTS

The right to permanent regular employment until retirement age is essential for the economic wellbeing and financial stability of the worker and their families.

A short-term or fixed term employment contract is a form of precarious employment that must be abolished. It allows for the denial of the right of retirement at 60, maternity rights and benefits, increments of rights which comes with tenure, makes it near impossible for such workers to form, join or even serve as leaders in existing unions. Such short-term employment contracts, usually a year or less, with no right of extension even if the work still exist, weakens worker capacity to struggle for better worker rights, and certainly weakens unions or makes unionization impossible.

We call for guarantee of the right to regular employment until retirement, and the abolition of short-term employment contracts and similar precarious employment practices.

2. ABOLISH THE ‘CONTRACTOR FOR LABOUR SYSTEM’ – ENSURE DIRECT EMPLOYMENT RELATIONSHIP BETWEEN WORKER AND OWNER/OPERATOR OF WORKPLACES

Direct employment relationship with the owner/operator of the workplace known as the principal, is essential to ensure stable employment, noting that employers do have the obligation to ensure worker rights and welfare are best protected. A contractor for labour (COL) should never be employers, and their role, if any, is to supply workers to owner/operators of workplace or alternatively find workers work with employers who need workers, and for the service rendered they should be paid a fee.

It is the owner/operator of workplaces, known as the principal, who should be having direct employment relationship with workers that work at their workplaces. This demand, amongst others, had been made vide the joint statement by 93 groups dated 3/5/2012 entitled, ‘Abolish the ‘Contractor for Labour’ system - Withdraw the 2012 amendments to Employment Act 1955’, and also vide the earlier statement by 115 groups on 28/10/2011 entitled,‘Malaysia Must Protect Worker and Union Rights, and withdraw proposed unjust amendments to Employment Act - Labour Suppliers Should Not Be Employers’. We also draw attention to the Malaysian Bar Resolution of 2012 expressing the same sentiment, which amongst others said ‘The Malaysian Bar takes the stand that labour suppliers and/or contractors of labour should never be or continue to be employers of workers after they are supplied, accepted and start working at the workplaces of principals or owners. Thereafter, these workers shall be employees of the principal or owners of the workplace.’ We also recall the MTUC initiated pickets and protests against the ‘contractor for labour system’.

3. PREVENT OUTSOURCING OF WORK, ‘BREAKING UP OF EMPLOYER COMPANIES’ AND OTHER SUCH SCHEME WHICH EFFECTIVELY DESTROYS WORKER SOLIDARITY AND IS AN ACT OF UNION BUSTING.

To avoid trade unions and employer relationship, some employers are outsourcing parts of the work to third party contractors who then use their own employees to do the work. This happened in the plantation sector, and National Union of Plantation Workers(NUPW), which once was a strong union with many members, is today so much weakened even though the number of workers in the plantation sector has remained the same or even increased. Another example, is what happened to the banking sector when certain aspects of the banking industry work like phone and internet banking was outsourced to third parties. Outsourcing of work is yet another ‘union busting’ strategy, that weakens trade unions, and deprives union members of the benefits of existing Collective Bargaining Agreement.

Another method, is to break up one company into different smaller companies, something that Tenaga Nasional Berhad(TNB) is now considering. This has been strongly opposed by the 4 existing unions representing the many workers in TNB. The break-up action would result in weakening of existing strong unions, and possibly deprivation of existing members of benefits and rights they now enjoy through Collective Bargaining Agreements. When new companies are formed, workers who find themselves in these new entities would have to go through the long process of forming, then getting union recognition all over again, and entering into new CBA with their new employers, a process that can take years. We support the statement of the 4 Trade Unions of TNB workers, being Persatuan Eksekutif Tenaga Nasional Berhad (PETNB), Kesatuan Percantuman Pekerja-Pekerja TNB (KPPPTNB), Tenaga Nasional Junior Officers Union (TNBJOU) and Persatuan Unit Keselamatan TNB (PERUNIKA) dated 14/11/2013 opposing the proposal to break up TNB.

4 STOP THE TERMINATION AND PERSECUTION OF UNION AND WORKER LEADERS FOR ACTIVITIES TO ADVANCE WORKER RIGHTS AND HIGHLIGHT INJUSTICES.

When the president of the National Union of Flight Attendants Malaysia (NUFAM) issued a statement as Union President highlighting also some of the pending issues yet to be dealt by Malaysian Airlines (MAS), he was terminated by reason of issuing a statement as an employee. 53 organisations issued a statement on 3/3/2014 entitled, ‘Malaysian Airlines Must Respect Trade Union and Worker Rights -Cease Anti-Union activities against NUFAM and its members’, and we also refer to the earlier statement by 43 groups on 3/12/2013, entitled, ‘MAS Must Immediately Revoke Suspension of Union President Ismail Nasaruddin Worker Right Issue Should Be Resolved By Negotiations Not ‘Union Busting’.

Likewise, 18 workers were terminated by DRB HICOM for handing over a Malaysian Trade Union Congress(MTUC) memorandum to candidates contesting in the last General Election, where the object of MTUC was to get commitment from incoming parliamentarians with regard to worker rights. We reiterate the statement by 51 groups issued on 25/6/2013 entitled, “DRB HICOM Must Respect The Citizens’ Right To Participate In The Democratic Process In Malaysia– Stop disciplinary action against workers for exercising their political rights.”

Many other trade union leaders have been terminated for highlighting injustices affecting workers, amongst others Abdul Jamil Lalaludeen and Chen KaFatt who were, respectively, the Vice-President and the Honorary Treasurer of the National Union of Bank Employees (NUBE); Hata Wahari, the President of the National Union of Journalists; Ismail Nasaruddin, the President of NUFAM; and Wan Noorulazhar , the President of the Electronic Industry Employees Union Western Region, Peninsular Malaysia (EIEUWR). We recall the Joint Statement by 87 groups dated 4/4/2013, ‘RENESAS Must Immediately Accord Recognition To The Union And Reinstate Wan Noorulazhar.’

We call for the end of termination, discrimination against and other forms of persecution against unionist and worker leaders, all of which could be rightly perceived as union busting by bad employers, which can be perceived as being condoned by Malaysian government.

We call for a repeal of the law that now allows employers to terminate of unionist by simply treating it as an employee misconduct. For example, NUFAM’s president was terminated because MAS said that the act of an employee issuing a media statement was a misconduct.

5. RIGHT TO A DOMESTIC INQUIRY BEFORE BEING TERMINATED

Ismail Nasarudin and 4 other from NUFAM were recently terminated without even a Domestic Inquiry. In the spirit of industrial harmony and justice, when an employer alleges a misconduct, natural justice demands that workers be accorded the right to be heard and right to defend against the allegation in front an independent panel.

In the case of the 18, who have been terminated by DRB HICOM subsidiaries, they had a Domestic Inquiry but were denied the right to be represented by a representative of their National Union. They were only allowed to be represented by a worker from their own workplace.

Noting that the majority of workers are not even unionized, it is essential that in the interest of justice, all workers shall have the right to domestic inquiry, and this should be provided for in law. There must also be the right accorded to the affected worker to be represented by a lawyer, unionist or worker of their choice.

6. MISCONDUCT NEED TO BE STATUTORILY DEFINED

Employers have been arbitrarily increasing the number of misconducts, many of which are vague and some even undermine fundamental rights of workers, or their unions, including the right of workers to highlight injustices, fight for better rights or even make representations to the relevant authorities to complain about violation of rights.

In the case of the DRB HICOM, one of the alleged misconduct was the‘bringing about or trying to bring about any form of influence or outside pressure to submit or support any external claim that is related to service be it an individual claim or claims of other employees’. Now, how can this be a misconduct when it really is what workers and unions do – that is highlight and campaign for support and hence ‘exertion of pressure’, etc… on employers, which by the way is also the object of any worker pickets. It is absurd when this very right is made into misconduct. 51 Groups issued a statement on25/6/2013, ‘DRB HICOM Must Respect The Citizens’ Right To Participate In The Democratic Process In Malaysia– Stop disciplinary action against workers for exercising their political rights.’ Now, workers in MAS are facing disciplinary actions for bringing their grievances to the Ministry in Putrajaya.

Worker misconduct should never attempt to diminish worker rights, freedom of expression, rights as citizens and other human rights.Like criminal offences, misconducts must be clearly stipulated including also the penalties that could be imposed by employer in the event the misconduct is proven or admitted.

For the protection of workers, there must be laws that defining employment misconducts, limiting it to matters at the workplace or reasonably related, but never to prevent worker organizing, union building and union activities. Attempts of employers to control the personal life, freedoms and human rights of workers especially outside working hours should never be permitted.

7. WHEN A WORKER TERMINATION HAS BEEN DETERMINED AS BEING WITHOUT JUST CAUSE, THE RIGHT TO BE REINSTATED WITHOUT LOSS OF BENEFITS MUST BE GUARANTEED.

When a worker is wrongfully dismissed, justice is sought by a worker seeking reinstatement by lodging a complaint which ultimately goes to the Industrial Court who decides whether it wasa wrongful dismissal or not. If wrongfully dismissed, the employer shouldjustly be ordered to reinstate the worker without loss of benefits.Alternatively, the worker should be able to claim compensation in lieu of reinstatement.

In Malaysia, the choice between reinstatement and compensation is taken away from the worker, and placed in the courts which now generally do not order reinstatement. In 2007, a new Scheduled 2 was added to the Industrial Relations Act 1977, which unjustly now not just limits the quantum of compensation in lieu of reinstatement to not more than 24 months, and for probationers not more than 12 months but also provides further deductions. This, rather than deter employers from wrongfully dismissing workers now emboldens them to use ‘wrongful dismissal’ as a means to get rid of worker and/or union leaders. This anti-worker Schedule 2 must be repealed, and the choice of accepting reinstatement or compensation must be restored to the aggrieved worker.

8 PROBATION AND OTHER RIGHTS SHOULD BE PROTECTED BY THE LAW FOR ALL WORKERS

More than 92% of workers in Malaysia are not unionized, and as such they do not have the mechanism of a Collective Bargaining Agreement, that may allow the recognition of basic worker rights now absent from labour legislations to be enjoyed. Probation is one such right, which reasonably for a regular employee, should never be more than three(3) months, being more than sufficient time for any employer to assess the suitability of a worker to be considered and confirmed as a permanent employee until retirement.

Now, many employers abuse this gap in the law, and keep workers as probationers for very long periods sometimes even years, and this is because a worker on probation has far less worker rights compared to a confirmed regular employee. The law must now fix the maximum length of probation, and include a deeming provision that after three(3) months, an employee shall be deemed to be a confirmed employee.

9. EXPEDITE TRADE UNION REGISTRATION AND RECOGNITION

While time limits and consequences for failure to do something are there in the law for acts to be done by workers and their unions, there is absence of similar provisions when it comes to employers. The recognition of the trade union in the case of RENESAS took about 4 years. In this case, there were times that employer RENESAS failed to comply with explicit instructions by the Ministry or was delay complying with the law, and this was possible when the law provides no time limits or the consequence of an employer failing to do something – this allows employers to so easily delay and even ignore workers and trade union rights.

Recognition of trade unions, a condition that needs to be satisfied in Malaysia before employers and trade unions are allowed to enter into Collective Bargaining Agreement, must be expedited and dealt with speedily, preferably taking no longer than three(3) months. The outcome of the ‘secret ballot’ must just be based just on the number of votes cast, whereas now it unjustly considers those who should have but did not manage to cast their votes as being votes against the union.

The right to Judicial Review is acknowledged, but when employers resort to using it to delay recognition of trade unions, it is essential that such proceedings in courts are proceeded with speedily to prevent denial and delaying worker and trade union rights. It is shameful how some employers are willing to do whatever to deny workers their rights, Malaysian Airlines(MAS), for example, is embarrassingly challenging the Minister’s decision to accord recognition of NUFAM after the secret ballot conducted clearly showed that 62.73% flight attendants in MAS wanted NUFAM as the union representing them.In the case of RENESAS, union recognition was delayed for a year or more by reason of Judicial Review and appeals initiated by the employer. As a matter of policy, such judicial review and appeals should be speedily disposed as delays affects worker rights, and these court actions should never be allowed to delay union recognition process, or the execution of Collective Bargaining Agreements.

10. TRADE DISPUTES MUST BE RESOLVED EXPEDITIOUSLY AND STATUS QUO PENDING RESOLUTION MUST BE MAINTAINED

History shows that it is strikes and industrial actions that have been most effective means available to workers and their unions in resolving disputes with employers and claiming rights, but Malaysia has interfered with this option to the detriment of workers and unions, and have adopted a preference of dealing with trade disputes vide negotiation and arbitration, and as such this process must be done speedily, and workers and unionist must be effectively protected from termination and discrimination by employers, more so pending resolution of trade disputes or complaints.

The majority of the trade disputes are initiated by workers and unions, who many a time have to suffer termination, discrimination or violation of rights whilst employers continue their business operation as usual, and as such justice demands that trade disputes be resolved speedily, not longer than 30 days, and that any workers who have been terminated pursuant to the filing of or related to a trade dispute should continuously be paid normal wages until the said dispute is resolved. Employers should be barred from terminating workers or unionists who have lodged trade disputes and/or complaints until the matter is resolved.

11. MIGRANT WORKERS SHOULD NOT BE DISCRIMINATED

Equal pay for equal work is just. It is wrong for migrant workers to be discriminated against with regards the right to minimum wages, as an example, where the government is suggesting the making of migrant workers to now pay levy, which was a payment imposed on employers to deter employers from employing migrant workers over local workers. 82 groups issued a statement on 8/2/2013, ‘Minimum Wages For All Workers, Including Migrant Workers - No to Wage Deduction to recover Levy Payable By Employers –‘

12. THE UNILATERAL GIVING OF EXEMPTION GRANTED TO EMPLOYERS TO EVADE RIGHTS PROVIDED BY LAW MUST STOP

The law provide for worker rights, but many a time there are provisions that allow the Minister to provide exemption to certain employers. For example, the maximum 8 hour working day or 48 hours working week,can also be avoided if the employer gets an exemption. The exemptions are granted without the prior knowledge of, let alone being accorded the right to be heard to, the affected workers and/or their unions. There is the possibility to challenge the exemptions within a limited time frame, but workers, especially those without trade unions, just do not have the capacity to challenge such decisions. Justly, the right to be heard and contest application for exemption must be granted to the worker or their union, before the decision.In fact, employers should never be granted exemptions, that will deny workers their worker or trade union rights.

13. MINIMUM WAGES MUST BE SUFFICIENT TO SUSTAIN A DECENT LIVELIHOOD

All workers in Malaysia are supposed to be receiving minimum wages as of 1 January 2014 but alas the quantum of minimum wages fixed in 2012 at RM900 for Peninsular Malaysia, and RM800 for Sabah and Sarawak is no longer sufficient to ensure a decent livelihood for the worker and his family given the large increases in the cost of living. While for public sector workers get also Cost of Living Allowances(COLA), the majority of the workers are in the private sector do not get COLA. Using also the fact that the Malaysian government has declared that households earning less than RM3,000-00 are in need of financial assistance, it is only logical that minimum wages be increased for all workers to at least RM1,500.

COLA should also be made a legal right for worker, especially for the lower income worker. Minimum wage rates should also be reviewed at least every 6 months, taking into account the speedily increasing cost of living and the monies required to ensure a decent livelihood for the worker and the family.

14. THE RIGHT TO UNEMPLOYMENT BENEFITS

In this day and age when employment is precarious, there is a need for the government to put in place unemployment benefits to assist workers temporarily out of a job and their families. Even if out of job, and deprived of an income, regular payments for rental, basic amenities, car and house loans, children’s education, etc is required of the unemployed worker. Without financial assistance in the form of an unemployment benefit, the lives of the unemployed worker and their families will be seriously affected. This safety net for workers is something that is available in many countries, including also neighboring Thailand.

15. NON-DISCRIMINATION BASED ON GENDER

While our Federal Constitution guarantees equality, courts have found that the obligation not to discriminate workers based on gender is only on the government and statutory bodies – not on private sector employers. This goes against the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) which Malaysia has ratified. The laws must be amended to ensure that all employers do not discriminate workers based on gender or any other forms of discrimination.

16. OCCUPATIONAL SAFETY AND HEALTH AT THE WORKPLACE

The Department of Occupational Safety and Health (DOSH) recorded 1,248 workplace accidents in 10 sectors in the first five months of 2013, which resulted in 68 worker deaths, 81 permanent disabilities and 1,099 injuries not resulting in permanent disabilities.

In 2010, a total of 1426 cases of occupational disease and poisoning have been reported to the Occupational Health Division as compared with 791 cases reported in the previous year, whereby only about half were successfully investigated. Amongst the diseases reported were noise induced hearing loss (NIHL), occupational skin diseases and occupational lung diseases. There is still a general low awareness about occupational diseases, more so when it becomes evident long after the worker has left the workplace – hence an under-reporting of occupational diseases occurs. For migrant workers who have returned to country of origin, there yet no effective mechanism of complaint or access to justice when it comes to occupational disease.

Malaysia must increase awareness of workers about occupational disease, and be committed to active enforcement to ensure occupational safety and health at the workplace. Hospitals and medical practitioners should also inform workers with diseases or medical conditions that could have been related to their workplace of this fact, and of where they can lodge complaints and access justice.

Noting that many employers also provide workers accommodation, there must be law stipulating the minimum standards of worker housing that would protect the health and safety of workers. Migrant workers who came into Malaysia with a clean bill of health have been subsequently sent back by reason of diseases like tuberculosis(TB) that could have most likely been contracted by reason of cramped worker housing or workplace, and as such the list of occupational disease need to be reviewed to include also diseases that could have been contracted by reason worker working or even poor worker housing conditions.

17. WORKER RIGHTS IN LAW FOR ALL WORKERS

Noting that in Malaysia, most workers are ignorant of worker and trade union rights, a fact brought about also by reason that worker and trade union rights are not taught in schools or colleges, it is thus necessary that minimum worker rights are provided for and protected by law.The laws that provide for minimum worker rights should ensure that these rights are enjoyed by all workers, not just workers earning RM2,000 and below or just certain classes of workers. Domestic workers, like all other workers, should also have the right to enjoy all minimum worker rights provided for by law.

18. DO NOT SIGN AGREEMENTS THAT WILL ERODE OR STAGNATE WORKER RIGHTS

Malaysia signs or will still sign Free Trade Agreements and other Treaties, like the Trans-Pacific Partnership Agreement (TPPA) without being open and transparent of the contents of the said agreements, and without consultation with the people. Some of these agreements, it is now known, contain clauses that will in effect not just erode but also stagnate worker rights. One such clause is the Investor Protection Clause, which protects investors allowing them to sue governments if the government does anything in the future which would mean employers having to expend more money, or do things that may affect the businesses profits. As such, if and when Malaysia in the future decides to improve matters like worker rights, worker safety, public health and environmental protection, requiring businesses to thus expend monies which will impact profits, Malaysia risk being sued and this may deter Malaysia from improving rights and working conditions of workers in Malaysia.

It must be noted that in no way is the above a comprehensive listing all demands or issues that affect worker and trade union rights, but it is a listing of some of the fundamental issues and calls that must be acted on, and not be allowed to swept aside with the lapse of time, control of the media and other means.

The obligation to recognize and protect worker and trade union rights is not just on the Malaysian government, but also on business, corporations, employers, countries from where persons who own or control businesses come from, countries from where the workers come from, consumers of products and services provided, other businesses that have a link with an employer by being within the supply chain or otherwise, and generally everyone in our global community. It is an unacceptable attitude to say it is alright to compromise on worker rights and standards as available in one’s country or even businesses, for so long as one complies with the Malaysian law.

Ruggie’s"Guiding Principles on Business and Human Rights: Implementing the United Nations 'Protect, Respect and Remedy' Framework", is just but one of the standards and guidelines, that should be adopted and followed by both governments, businesses and employers. It is not just sufficient to ratify or sign United Nations(UN) or International LabourOrganisation(ILO) Conventions and Instruments but not do the needful to put into effect these commitments in Malaysia.

We call on the Malaysian government to immediately act to ensure that all the above demands are given effect to ensure justice for workers and trade unions in Malaysia. The rights and welfare of workers and their families must be a priority of any government, and this also include creating protection mechanisms like unemployment benefits when workers are out of work.

We call for the immediate reinstatement of all union and worker leaders including Abdul Jamil Lalaludeen and Chen Ka Fatt from NUBE, Ismail Nasaruddin from NUFAM, Wan Noorulazharfrom EIUWR, and RusainiMamat from NUTEAW.

We also call for Malaysia to immediately ratify ILO Conventions 87, Freedom of Association and Protection of the Right to Organise and Convention, and other important worker conventions. We also call for Malaysia to give full effect to the ILO and UN Conventions that it has ratified including also ILO Convention 98, Right to Collective Bargaining.

Persatuan Hindraf Malaysia (PHM) has called on parliamentarians to amend the laws to stop "overzealous" officials from the Selangor Islamic Affairs Department (Jais) from overstepping their boundaries.

PHM chief P Waythamoorthy today condemned Jais for stopping a wedding at a Hindu temple on Sunday because it suspected that the bride was a Muslim.

Jais sources were reported by Sinar Harian as saying that it used a 1988 law, to prevent Muslims converting out of the faith, to justify its actions for taking the bride away from the wedding in Petaling Jaya.

Waythamoorthy disagreed and was outraged that Jais can do this.

"The raid was unlawful, unconstitutional and encourages unnecessary disturbance to the peace enjoyed between the communities.

"This action by Jais clearly shows disrespect tfor the sensitivities of non-Muslims and their places of worship. Their act is a clear crossing of the boundary of their jurisdiction," he said in a press statement.

Waythamoorthy said Jais' action violated Article 11 of the Federal Constitution, which enshrines the rights of Malaysians to practise freedom of religion.

"Jais or any Muslim authority should not take the religious sensitivities of other faiths for granted.

"As much as Muslims are sensitive to their religion, others have the same feelings too," added the former deputy minister in the Prime Minister's Department.

Waythamoorthy said Jais was fortunate that its actions did not invite rash actions and untoward happenings in the temple on Sunday, noting that the bride was an adult who had grown up a Hindu, who was still working out the mistake of being registered as a Muslim by her neglectful father.

"We have a serious problem in this country. The civil service is dominated by Malay and Muslim-centric officers who bulldoze their personal belief in the supremacy of their religion in the government administration," he added.

On Jan 2, Jais also drew controversy when it raided the office of the Bible Society of Malaysia (BSM) and seized 321 copies of Malay and Iban-language bibles for its investigation.

Two BSM workers were temporarily hauled up for questioning and the case remains unresolved.


The following is the full text of Hindraf's Statement:

Hindraf condemns the action of Selangor Islamic Affairs Department (Jais) yesterday in raiding and interrupting a wedding that was about to take place in a Hindu temple.

The raid was unlawful, unconstitutional and encourages unnecessary disturbance to the peace enjoyed between the communities. This action by JAIS clearly shows disrespect to the sensitivities of Non-Muslims and their places of worship. Their act is a clear crossing the boundary of their jurisdictions.

It was reported by Sinar harian and Malaysiakini that JAIS acted under a 1988 enactment (control and propagation amongst Muslims) which makes it an offense to persuade, influence or incite any Muslim to change their faith.

This act does not confer any kind of rights on the JAIS to raid the temple and stop a Hindu wedding from taking place. The act in itself is clear.

The wedding was taking place with the consent and knowledge of the difficult situation the bride was in ie that she had been converted when she was a child by her father without her knowledge and she had been practicing the Hindu faith since birth.

Further the bride had entered into the marriage on her own will without any coercion or incitement, therefore how is it possible that this enactment is applicable in this matter.

The overzealous attitude taken by the JAIS officers depicts such a free hand they have into interfering into the personal life of a Non-Muslim individual with impunity from the law.

The absolute arbitrary power of these JAIS officers to interfere into the Non-Muslim affairs needs to be stopped immediately when they clearly infringe Article 11 of the supreme law of this country as seen in this matter.

JAIS or any Muslim authorities should not take the religious sensitivities of other faiths for granted. As much as Muslims are sensitive to their religion, others have the same feelings too.

In this case it was fortunate nothing untoward happened in the temple and those present did not react to the unlawful and unconstitutional raid carried by Jais in the Hindu temple.

The controversy of religious status amongst many who claim that they have been converted without their knowledge and the reluctance by the National registration to act according to civil laws in giving the victims of those circumstances a remedy to correct the wrongs not caused by their fault is the main reason for the continuance of such controversies.

We have a serious problem in this country. The civil service is dominated by Malay and Muslim centric officers who bulldoze their personal belief in the supremacy of their religion in the Government administration.
Their behavior is nothing short of bullying assisted by the government organs and machinery in oppressing the Non-Muslim community and their beliefs.

Hindraf calls upon parliamentarians from both divide to move an act in Parliament (which is long due) to correct and amend the legal hurdles that has been in place in protecting the Religious freedom of individuals.

——聆听伊党领袖5月24日新山讲座会答问的感言

2014年5月24日,我与数位人民之友工委出席了伊斯兰党新山区部在新山统一大酒店(Tropical Inn)主办的“什么是伊斯兰刑法”讲座会。四位主讲人分别是伊斯兰党中委祖基菲•阿末博士(Dr. Dzulkefly Ahmad)、吉兰丹州行政议员穆达斯(Mumtaz Md. Nawi)、伊斯兰党支持者大会堂秘书李耀邦(Vincent Lee)以及马来西亚华人穆斯林协会秘书Ann Wan Seng。不久前,华总领袖5月14日前往吉兰丹,向伊斯兰党州政府表态反对落实伊斯兰刑事法。接着在18日,新山中华公会举办“反对伊斯兰刑事法签盖集会”。眼看华社民间组织陆续表态反对伊斯兰刑事法,对坚持在吉兰丹州首先推行伊斯兰刑事法的伊斯兰党领袖构成了与日俱增的压力,我于是产生要了解伊党领袖如何应对这股民间反伊斯兰刑事法运动的强烈愿望。

我在答问环节向祖基菲•阿末的提问

当天有近两百人出席该讲座会,其中以巫裔人士占绝大多数。我细心聆听每位主讲人的论述之后,总觉得主讲人,若不是站在伊斯兰党的立场,就是从伊斯兰教的角度,以各自方式为推行伊斯兰刑事法进行宣传。在交流环节,不少出席者也是从宗教观点提问或表达看法。作为一个民主人权工作者,我听了主讲人的演讲和答问之后,联想到人民之友工委会跟伊斯兰党柔佛州全民团结局在5月4日联合举办的论坛伊斯兰党代表姆加希•尤索拉哇博士(Dr. Mujahid Yusof Rawa)含糊回应关于伊斯兰刑事法的提问,我于是提出了包含以下内容的意见和疑问,请求祖基菲•阿末博士回应。

• 伊斯兰党或民联在第13届大选获得全国人民支持的原因是广大人民对巫统霸权统治深恶痛绝。
• 巫统霸权集团为了确保得到马来选民的支持,以延续并巩固其霸权统治地位,把国家伊斯兰化既是巫统霸权集团在过去时期惯用的统治策略,也是他们在今后时期将会加强的统治策略。
• 巫统霸权统治集团在第13届大选已然失去人民特别是在国家伊斯兰化过程中遭受边缘化的非穆斯林群体的支持。
• 巫统霸权统治集团纵使有意实施伊斯兰刑事法以加强他们对穆斯林群体和穆斯林社会的影响和支配,也不敢轻举妄动。
• 现在,反而是由伊斯兰党部分(掌权)领袖代替巫统霸权统治集团推行伊斯兰刑事法,其结果是导致非马来人社会(不分左、中、右)奋起对抗伊斯兰党,从而导致各族人民反抗巫统种族霸权统治的联合力量遭到破坏和分裂,以至各族人民共同埋葬巫统霸权统治的愿望难以实现。

我认为,伊斯兰党领袖推行伊斯兰刑事法,无疑是服务于巫统种族霸权的统治,而不利于各族人民反抗巫统种族霸权统治的斗争。伊斯兰党(部分)领袖却明知故犯、一意孤行——这难道不是“亲痛仇快”的事吗?站在维护各族人民利益的立场上,我无法接受伊斯兰党当下所采取的倾向巫统种族霸权集团的政治利益的这种做法。

祖基菲•阿末针对我的问题的回应

之后,祖基菲•阿末博士(右图)作出有关回应,其重点内容如下——

• 他理解华人社会的担忧,但是他希望(我)不要持有“民联的分裂是因伊斯兰党推行伊斯兰刑事法所致”的偏见。
• 他强调,伊斯兰党在民联尚未成立的许久年前,即1993年就已提出推行伊斯兰刑事法。推行伊斯兰刑事法,是伊斯兰党连续五次获得吉兰丹州政权对(吉兰丹)选民的承诺。
• 他指出,基于上述情况,若吉兰丹州务大臣提出说,“因为要先推翻巫统国阵,必须展延推行伊斯兰刑事法”人民群众是无法接受这种(出尔反尔)说法的。这是因为人民群众会受巫统的宣传所误导。
• 巫统会向马来民族宣传“伊斯兰党是行动党的工具。他们懦弱。他们仅仅为其政治(野心)服务”(其目的是促使穆斯林远离伊斯兰党)造成伊斯兰党陷入政治困境。伊斯兰党为了摆脱困境,别无选择,必须坚守(伊斯兰教)原则。

如果民联各成员党领袖都尊重《联邦宪法》和民主协商精神,推行与反对伊斯兰刑事法就不应该成为民联内部的主要矛盾,正如此前伊斯兰党宣称他们奋斗的目标是建立“福利国”而不是“伊斯兰国”以体现与民联的伙伴精神和政治合作,如果在全国各族人民埋葬巫统种族霸权统治之前,伊斯兰党在长期掌握吉兰丹州政权的日子里,认真推行发展经济、改善民生的政策,在吉兰丹建立起一个给各族人民带来福祉的“福利州”,作为伊斯兰党带领全国各族人民建立“福利国”的典范,伊斯兰党领袖就无须这个时候在吉兰丹州再祭起伊斯兰刑事法的大旗,来挽救伊斯兰党的政治困境。

全国人民与丹州人民的愿望和要求,孰轻孰重

在非穆斯林看来,伊斯兰党领袖重新祭起伊斯兰刑事法的大旗,无异于意图把吉兰丹变成“伊斯兰州”、意图把马来西亚变成“伊斯兰国”。这意味着伊斯兰党领袖此前所高唱的“福利国”,只是用来骗取全国非穆斯林(选民)选票的宣传花招罢了。

伊斯兰党的这种主张和行动,怎么不叫各族人民特别是遭受边缘化的非穆斯林群体,主要是华族、印(淡米尔)族、伊班族、卡达山杜顺族等少数民族的担忧和愤懑呢?为埋葬巫统种族霸权统治而联合组成的政治联盟——由基本上以不同种族、不同宗教的族群为基础,代表着不同阶级利益的3个主要政党组成的“人民联盟”(简称民联),怎么能不会因为伊斯兰党为了摆脱本身的政治困境又再祭起伊斯兰刑事法的大旗,不顾其他政治盟友的感受而造成难以弥补的分裂呢?

更加重要的是,埋葬巫统种族霸权的统治,完全符合各族人民的根本利益,是各族人民长久以来的共同愿望,是我国现阶段民主运动的政治任务。即使祖基菲•阿末博士等伊斯兰党领袖所强调的“推行伊斯兰刑事法符合吉兰丹州选民的愿望和利益”的说法可以成立,各族人民要埋葬巫统种族霸权统治的政治意义和影响范围,跟吉兰丹州选民要实行伊斯兰刑事法的愿望和要求相比较,孰轻孰重,对全国包括吉兰丹和登嘉楼州的人民都是不言而喻的。

正当伊斯兰党领袖希望人民理解其政治困境,即马来选票流失、政治力量减弱的当儿,伊斯兰党领袖是否有去认真了解非穆斯林群体的困境?巫统种族霸权统治多年来强制执行国家伊斯兰化的结果是,从国家的政治经济、文化教育等领域,到社会生活和宗教信仰等方面;从维护或兴建宗教膜拜场所和坟地的基本权利、涉及穆斯林和非穆斯林之间的孩子抚养权和财产继承权等争议,到最近法庭从新宣判禁止(半岛)非穆斯林使用“阿拉”字眼等等,非穆斯林群体对本身基本权益遭到日愈严重的侵蚀而极度愤懑。伊斯兰党领袖为何不正视这个现实呢?

国家伊斯兰化只符合当下统治集团的利益

国家伊斯兰化只符合意图继续支配马来选票的巫统霸权统治集团的利益,是巫统种族霸权思想在宗教信仰方面的表现。它通过国家机器压迫和剥夺非穆斯林群体的宗教信仰自由权利、对伊斯兰教以外的其他宗教信仰一概采取歧视、排斥甚至消灭的政策,其目的是强制同化非穆斯林群体,迫使非穆斯林最终唯有接受伊斯兰神权统治苟且偷安。因此,国家伊斯兰化完全违背各族人民包括穆斯林群体在生活中平等对待彼此的宗教信仰、各民族各宗教信仰文化共存共荣的愿望。遭遇“308”和“505”两次大选挫折的巫统集团一直妄想通过加强国家伊斯兰化,以巩固其以马来穆斯林为基础的政治力量,从而维持其种族霸权统治,就是因为顾虑到以非穆斯林[主要是半岛的华族、印(淡米尔)族、砂拉越的伊班族和沙巴的卡达山杜顺族)为基础的其他国阵成员党为此遭受人民彻底唾弃,而不敢轻举妄动。

可以这么说,对待国家伊斯兰化的立场就是任何政党或组织如何对待巫统种族霸权统治的检验标准。祖基菲•阿末博士所顾忌的巫统及其代理人对伊斯兰党的政治污蔑,恰恰反映了伊斯兰党领袖非常在乎向穆斯林选民证明其党(比起巫统)具有更加强烈的伊斯兰特征的事实。因此,伊斯兰党领袖在最后一次大选之后,深感其党因马来选票流失而陷入政治困境,于是从新祭起伊斯兰刑事法,一方面向马来选民昭示伊斯兰党更能代表穆斯林,想要争回流失的马来选票,另一方面向非穆斯林宣传伊斯兰刑事法的“好处”,想要争取更多的非穆斯林选票——但是,他们却故意忽视非穆斯林群体在国家伊斯兰化过程中遭受严重压迫的现实。这揭露了伊斯兰党领袖在反对巫统种族主义霸权统治的虚伪性。依我看,伊斯兰党推行伊斯兰刑事法客观上起着分裂我国近几年来逐渐壮大的民主改革运动,帮助巫统霸权集团加强种族主义及伊斯兰化统治的两重作用。

国家伊斯兰化的种族宗教压迫已经来到非穆斯林群体难以继续容忍的临界点。只要伊斯兰党领袖继续进行伊斯兰刑事法的宣传活动,全国各地各民族各宗教信仰人民特别是非穆斯林群体别无选择,唯有团结起来,对巫统伙同伊斯兰党擅自把国家伊斯兰化、压迫国内少数民族和其他宗教信仰者的图谋,展开坚决斗争。随着巫统种族霸权统治集团将国家伊斯兰化的政策逐步加强,以及派遣他们的“第五纵队”潜入人民内部进行分化、打击和收买。因此,由伊斯兰党、人民公正党和民主行动党组成的政治联盟——人民联盟,很有可能因为伊斯兰党执意推行伊斯兰刑事法,或对巫统霸权统治集团所推出的伊斯兰化政策意见不合而宣告分裂。如果这种情况无法避免,便应验伊斯兰教复兴阵线(Islamic Renaissance Front)主席阿末法洛医生(Dr. Ahmad Farouk Musa)所言,马来西亚人民将被巫统政权继续统治另一个50年。

全国各族人民和民主党团对伊党的期望

反过来说,只要伊斯兰党领袖现在悬崖勒马,停止推动伊斯兰刑事法,并且深入非穆斯林社会认识各族人民遭受国家伊斯兰化的痛苦,将民间组织反对国家伊斯兰化的诉求逐步纳入其政治斗争纲领,主动联合民联其他成员党,广泛团结其他民主政党、民间组织、民主人士,毅然投入反对巫统种族霸权统治的民主改革斗争——如果这种情况能够出现,必将重挫巫统推行国家伊斯兰化的进程、瓦解他们利用宗教分化我国各族人民团结的力量以及分裂我国民主改革运动的图谋,从而早日实现在全国范围内终止巫统种族霸权统治的政治目标。这就是伊斯兰党全党上下对我国各族人民反抗巫统霸权统治、推进民主改革运动所能作出的贡献。

在2008年的“308”全国大选以前,我国人民反压迫斗争过去的代表思想是反对巫统种族主义统治,其主要表现在华人族群上世纪70年代的华人大团结运动、80年代的华团民权运动、90年代的华团诉求运动、以及在21世纪初酝酿而在2007年底爆发的兴权会反种族压迫的大规模示威行动。今后,随着国家伊斯兰化进入另一个历史阶段,我国人民的反压迫斗争,将以反对巫统种族主义及伊斯兰教霸权统治作为各族人民争取民主权利的代表思想,这将表现在各族人民主要是非穆斯林群体[主要是半岛的华族、印(淡米尔)族、砂拉越的伊班族和沙巴的卡达山杜顺族),与开明的穆斯林党团和个人团结起来对抗国家伊斯兰化,首先就是反对伊斯兰刑事法的落实。

如果伊斯兰党领袖执迷不悟地推行伊斯兰刑事法,一步一步地为巫统种族霸权集团实现国家伊斯兰化的目标服务,那么现在就可以断言,历史将明确不误地指出,巫统国阵集团固然是我国当下反抗霸权统治和民主改革运动的主要敌人,伊斯兰党当权领袖如今又祭起伊斯兰刑事法的大旗,意图首先在吉兰丹实现一个“伊斯兰州”,作为在全国推行“伊斯兰国”的楷模,确实是扮演了从内部破坏民联的巫统“第五纵队”的角色。如果任何人责怪这个判断是有偏见的,那只因为这些人有意或无意地站到各族人民的对立面,维护种族霸权统治的利益了。我相信,全国各族人民和民主党团对伊斯兰党及其领袖的期望是,放弃伊斯兰刑事法,认真在吉兰丹建立一个惠及各族人民的“福利州”,作为他们所主张的“福利国”的楷模,更为重要的是,跟全国各族人民和民主党团不弃不离,组成一个“消除分歧,共同对敌”的反对种族霸权统治的联合阵线,尽早把巫统主导的国阵统治集团抛弃到历史的垃圾堆中去!作为一个反对种族霸权统治、为我国民主人权而奋斗的工作者,我愿意与伊斯兰党领袖共勉。

人民之友工委会2020年9月27日常月会议针对徐袖珉(英文名: See Siew Min)半年多以来胡闹的问题,议决如下:

鉴于徐袖珉长期以来顽固推行她的“颜色革命”理念和“舔美仇华”思想,蓄意扰乱人民之友一贯以来的“反对霸权主义,反对种族主义”政治立场,阴谋分化甚至瓦解人民之友推动真正民主改革的思想阵地,人民之友工委会经过长时间的考察和验证,在2020年9月27日会议议决;为了明确人民之友创立以来的政治立场以及贯彻人民之友现阶段以及今后的政治主张,必须将徐袖珉从工委会名单上除名,并在人民之友部落格发出通告,以绝后患。

年轻一辈人民之友有感而作


注:这“漫画新解”是反映一名自诩“智慧高人一等”而且“精于民主理论”的老姐又再突发奇想地运用她所学会的一丁点“颜色革命”理论和伎俩来征服人民之友队伍里的学弟学妹们的心理状态——她在10多年前曾在队伍里因时时表现自己是超群精英,事事都要别人服从她的意愿而人人“惊而远之”,她因此而被挤出队伍近10年之久。

她在三年前被一名年长工委推介,重新加入人民之友队伍。可是,就在今年年初她又再故态复萌,尤其是在3月以来,不断利用部落格的贴文,任意扭曲而胡说八道。起初,还以“不同意见者”的姿态出现,以博取一些不明就里的队友对她的同情和支持,后来,她发现了她的欺骗伎俩无法得逞之后,索性撤下了假面具,对人民之友一贯的“反对霸权主义、反对种族主义”的政治立场,发出歇斯底里的叫嚣,而暴露她设想人民之友“改旗易帜”的真面目!

尤其是在新冠病毒疫情(COVID-19)课题上,她公然猖狂跟人民之友的政治立场对着干,指责人民之友服务于中国文宣或大中华,是 “中国海外统治部”、“中华小红卫兵”等等等等。她甚至通过强硬粗暴手段擅自把我们的WhatsApp群组名称“Sahabat Rakyat Malaysia”改为“吐槽美国样衰俱乐部”这样的无耻行动也做得出来。她的这种种露骨的表现足以说明了她是一名赤裸裸的“反中仇华”份子。

其实,在我们年轻队友看来,这名嘲讽我们“浪费了20年青春”[人民之友成立至今近20年(2001-9-9迄今)]并想要“拯救我们年轻工委”的这位“徐大姐”,她的思想依然停留在20年前的上个世纪。她初始或许是不自觉接受了“西方民主”和“颜色革命”思想的培养,而如今却是自觉地为维护美国的全球霸权统治而与反对美国霸权支配全球的中国人民和全世界各国(包括马来西亚)人民为敌。她是那么狂妄自大,却是多么幼稚可笑啊!

她所说的“你们浪费了20年青春”正好送回给她和她的跟班,让他们把她的这句话吞到自己的肚子里去!
