尊重原住民习俗地权,
即刻提控霹雳州政府

我们,以下联署的公民社会组织,谴责霹雳州政府拆除宜力甘榜古聂(Kampung Cunex)原住民架设的反伐木路障及允许伐木公司侵入原住民习俗地。
5月13日,霹雳州政府指非政府组织阻碍该州的发展,因为霹雳州亟需伐木带来的收入。但受影响最大的原住民,往往没参与伐木和发展活动的决策过程,包括此次甘榜古聂的原住民。
许多在霹雳州原住民祖传地(包括半岛其它州属)进行的发展计划,并没有获得原住民的知情同意权,他们也没获得公平的赔偿,这显示霹雳州政府并不承认原住民的基本人权。
马来西亚政府于2007年的联合国大会上支持联合国原住民权利宣言,在国际上承诺保障与尊重原住民的权利,包括宣言中阐明的“自由、事先与知情同意(Free, Prior, Informed Consent)”的原则。
希盟政府也在第十四届大选宣言中再次承诺保障原住民的基本人权,2019年4月22日的布特拉再也原住民大会上也通过136个议决,提出一个捍卫原住民人权的全面架构。
2019年1月,总检察长汤米.汤姆斯前所未有地起诉吉兰丹州政府,限制伊斯兰党领导的州政府为了商业利益破坏原住民的土地。他强调,内阁致力于保护原住民的土地权和福利。
因此,我们促请联邦政府保持政策的一贯性,不应对侵犯吉兰丹州和霹雳州原住民祖传地的做法采取双重标准。总检察长必须即刻起诉霹雳州政府,将人民利益置于利益之上。
我们也要求所有州政府冻结所有现有的伐木执照,在批准任何可影响他们祖传地的发展计划前,邀请原住民参与 “自由、事先与知情同意”的评估。
最后,我们吁请政府全面落实联合国原住民权利宣言,落实保护和尊重原住民权利的责任,保存原住民家园的生物多元性和自然环境。

Respect Orang Asli Customary Land Rights,
Sue the Perak State Government Now!

On the 13th May, the Perak state government gave a statement that they are facing obstacles from NGO with regards to state development which requires logging to channel income for the state, brushing over the fact that many of these logging and development activities were decided without the participation of the communities that were affected, in this case, the Orang Asli of Kampung Cunex, Gerik, Perak.
Many developments in the ancestral territories of the Orang Asli in Perak (and also other states across Peninsular) were carried out without the free, prior, informed consent (FPIC) of the communities and often, they were not compensated fairly – an indicator showing the Perak State Government not recognizing the human rights of the Orang Asli.
These principles are enshrined in the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) which Malaysia has agreed to at the UN General Assembly in 2007, expressing her commitment to protect and respect the rights of the indigenous peoples at the international level.
Pakatan Harapan government has reaffirmed its commitment on protection of the rights of the Orang Asli in the GE14 Manifesto and an overarching framework for the 136 resolutions that were enlisted during the Orang Asli Convention in Putrajaya on 22 April 2019.
In January 2019, the Attorney General Tommy Thomas has also taken an unprecedented move to sue the Kelantan government to restrain the PAS-led state government for destroying indigenous people’s lands for commercial profits. He emphasised that the cabinet was resolved to protect the indigenous people’s land rights and their welfare.
Hence, we urge the federal government to be consistent in policy decision and should not practice double standard in the encroachment of indigenous people’s native lands in Kelantan and Perak. The AG must sue the Perak state government immediately, putting the human rights of people over profits.
We also demand all state government to freeze current logging license and conduct FPIC assessment with the indigenous people prior to any activities and actions that will affect their rights to their native customary lands.
Ultimately, we seek the full implementation of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) by the government to fulfil their fiduciary duty of respecting and protecting the rights of the Orang Asli in tandem with protecting and preserving the rich biodiversity inhabiting in these natural environments which many of the Orang Asli call home.
