赵明福民主促进会与明福家属不满首相安华多次拒见(他们),而决定在即将来临的元宵节(即阳历2月24日)上午11时正,到行动党的半山芭总部,向陆兆福拜年和探问关于明福命案调查的进展。人民之友工委会2024年2月5日(星期一)发表《5点声明》,表达我们对赵明福冤死不能昭雪事件的严正立场和明确态度。

人民之友工委会根据本身以往对全国大选和州议会选举的论述,结合团结政府成立后的政治形势,决定对新古毛州议席补选,于2024年5月8日发表声明,供新古毛选民5月11日投票以至全国各族人民今后行动的参考。

泰国宪法法院判决英拉678亿美元基建项目违宪,导致“大米换高铁”项目流产。这一消息令人叹息。虽然遭遇阻碍,但中国与东盟的经济合作依然在有序展开。据中国网3月10日报道,泰国克拉运河筹建工作启动。

泰国“克拉运河计划” 是指在泰国克拉地峡处挖掘一条沟通泰国湾与安达曼海的运河。克拉地峡位于泰国南部马来半岛上,两侧海域分属太平洋与印度洋,地峡最窄处不足100千米,而 且地势不高,开凿运河基本不需要象巴拿马运河那样调剂水位,开凿的相对成本和运营成本都较低。计划中要开凿的运河宽400米,水深25米,双向航道,适合远洋大船进出。这条运河一旦修成通航,船只将不必穿过马六甲海峡、绕道马来西亚和新加坡,可直接从印度洋的安达曼海进入太平洋的泰国湾。

随着中国经济的持续高速发展,对进口油气资源的依赖度越来越高,运载油气资源的船只经过狭窄、周边情况复杂的马六甲海峡严重威胁着中国的能源安全。 除此之外,近年来美国在“重返亚太”的战略下动作频频,美军有可能驻扎在新加坡樟宜基地进而控制马六甲海峡这一“亚洲能源咽喉”。因此在克拉地峡开凿一条以中国影响力主导的运河,可以绕开受制于人且海盗猖獗的马六甲海峡,大幅改善中国能源安全的状况。

通过对地图的粗略测算,原本从印度洋安达曼海进入太平洋南中国海的“马六甲海峡航线”航程约2600公里,而从克拉地峡开凿运河后的“克拉运河航线”从安达曼海进入南中国海航程约1600公里,航程缩短近1000公里。

走过“黄金十年”的中国—东盟自由贸易区,正把打造自由贸易区升级版、推进多领域互联互通合作、加强金融合作和开展海上合作作为“钻石十年”的重点合作方向。

十年前,中国与东盟建立战略合作伙伴关系,在多方的共同努力下,迎来亚洲发展的“黄金十年”,堪称全球区域合作实现多赢的典范。

中国已连续多年成为东盟最大的贸易伙伴。双边贸易额从2002年的548亿美元上升至2013年的4436亿美元,年均增长21%以上,中国—东盟双边贸易额超越中日贸易额,成为中国在全球的第三大贸易伙伴。中国东盟的合作建成了发展中国家最大的自由贸易区,涵盖19亿人口,双方互利共赢的经贸合作在全球经济低迷情况下显示出勃勃生机。

东盟国家是中国企业“走出去”的首选地之一,也是中国吸引外资的重要来源地。十年间,中国—东盟间的相互投资扩大了四倍,双向投资金额累计已突破1000亿美元,东盟成为中国企业在海外投资的第一大市场。

东盟各国高度重视增强自身的总体经济实力,除了致力建设东盟自由贸易区以外,还在2002年的东盟首脑会议上达成了成立“东盟经济共同体”(AEC)的共识,东盟黄金十年后,“东盟经济共同体”的共识得到进一步强化,也将开创“钻石十年”新辉煌。

泰国地处于中南半岛中心的战略地位,同时也是通往湄公河区域和南亚的重要门户,历史上,泰国便有在克拉地峡修建克拉运河的构想,限于人力物力,克拉运河计划未能实施。

随着中国—东盟自贸区战略合作伙伴关系的推进,克拉运河计划有望成为现实。近日,由柳工、徐工、三一重工等中国企业牵头的克拉运河筹建小组已经开始运作,全部建设所用工程机械设备将由柳工集团联合三一重工、徐工机械等国内工程机械企业通过北部湾金融租赁服务有限公司提供。东盟的“钻石十年”也将收到最好的礼物。

克拉运河位于泰国中南半岛的克拉地峡,根据工程计划,这条100公里的人工运河贯通印度洋和泰国湾,成为亚洲最大的一条人工运河。

克拉运河开通后,东盟贸易区和世界各国之间的贸易将不再通过马六甲海峡,克拉运河相对原有的马六甲航线,直线缩短一千多公里的航程,这为东盟自贸区的物流货运节约了大量的航运成本和时间成本。

届时,东盟、中国和日本乃至世界的贸易体都因克拉运河的开通而受益。

随着克拉运河的修建,东盟的“钻石十年”将更加灿烂辉煌,克拉运河则成为皇冠上的明珠。

我们,人民之友工委会,针对上诉庭在3月7日傍晚判决安华肛交案罪名成立,监禁5年,而人民公正党昨天(3月9日)宣布委派旺阿兹莎“代夫出征”,取代安华出战加影补选一事,发表以下3点声明——

1、在安华准备出征加影州议席后,上诉庭急急忙忙选择在3月7日(周五)傍晚6时许,也就是在离开提名日(3月11日周二)只有一个工作日之际,推翻高庭所作“安华无罪释放”的裁决,而改判“安华罪名成立”,监禁5年。这事件暴露了巫统国阵集团为了维护它们的霸权统治,又一次对安华进行赤裸裸的司法迫害而剥夺其参与议会选举的权利。这事件又一次让人民目睹了巫统国阵统治集团如何利用国家机器来对付足以威胁其统治地位的领袖人物,以及破坏足以动摇其统治霸权的群众运动。各族人民尤其是加影选民,应当在这场加影补选战役中毫不犹疑地给巫统国阵统治集团以迎头痛击,不应再对这个欺骗了各族人民50多年的统治集团存有任何幻想!给代表马华出战的周美芬一个狠狠的教训!

2、我们赞赏与支持,人民公正党改派党主席旺阿兹莎出战加影补选以及在国会内展开一天的杯葛行动的最新决定。我们认为,这项最新决定具有两个重要意义:(1)这体现了人民公正党、民主行动党以及伊斯兰党在派出最适合人选替代安华出战加影补选的决策上,达致三党最理想的共识;(2)这也体现了民联三党将共同遵循人民的意志和愿望,团结一致地在议会外,也要在在议会内对巫统国阵霸权统治及其各种倒行逆施的种族主义政策展开斗争。我们认为,只要议会斗争的条件还存在,人民要求改善生活与改革政治,就不可轻信“不要选举”或“放弃选举”的主张而掉入人民的敌人设下的陷阱。因此,我们认同和支持民联三党领袖的这两项符合人民的利益和愿望的最新决定。

3、由于民联三党领袖依照安华原定的“遏制国阵政府的种族和宗教攻势”与“搞好雪州为入主布城铺下基石”的斗争路线,我们衷心希望民联三党领袖,特别是肩负着重大使命出战加影补选战役的旺阿兹莎,真心诚意听取各民族各阶层人民特别是那些处在最受压迫、最受歧视的族群和阶层人民的心声,义不容辞接受各领域的民间组织提出的诉求,包括由本工委会发起,隆雪华青和甲华堂青以及15名民主人士联署的《2014年加影补选诉求》,按部就班加以落实。如果民联三党领袖能够确实按照各族人民的愿望为各族人民的利益展开民主改革斗争,民联必然获得各族人民群众的支持,不仅在加影补选取得巨大胜利,而且在接下来可能出现的其他议席补选或下一次的国州议会选举以及各种领域斗争中取得一个又一个巨大胜利。否则,最终也难逃为人民群众所唾弃的厄运。

Kami, Sahabat Rakyat Working Committee, mengeluarkan kenyataan seperti dibawah selepas Parti Keadilan Rakyat (PKR) mengumumkan (pada 9hb Mac) Presidennya Wan Azizah Ismail akan menggantikan Anwar Ibrahim sebagai calon baru untuk pilihan raya kecil (PRK) Kajang ekoran keputusan Mahkamah Rayuan menjatuhkan hukuman lima tahun penjara ke atas Anwar Ibrahim kerana pertuduhan meliwat.

1. Pada 7hb Mac (Jumaat lepas), iaitu satu hari bekerja sebelum tarikh penamaan calon PRK Kajang pada 11hb Mac (Selasa), Mahkamah Rayuan tergesa-gesa menerima rayuan pendakwaan dan menetapkan hukuman lima tahun penjara ke atas Anwar yang telah bersedia untuk bertanding dalam PRK Kajang.

Perkembangan ini mendedahkan klik UMNO-BN, demi melindungan pemerintahan hegemoninya, sekali lagi menganiayai Anwar Ibrahim dengan kasar melalui badan kehakiman dan menafikan hak Anwar untuk menyertai pilihan raya. Rakyat turut menyaksikan bagaimana klik pemerintah UMNO-BN menggunakan jentera kerajaan untuk menindas pemimpin-pemimpin yang mampu mengancam kedudukan pemerintahan mereka dan melakukan sabotaj ke atas gerakan massa yang mampu menggugat hegemoni pemerintahan mereka.

Rakyat semua bangsa, terutamanya pengundi Kajang, harus membuangkan segala khayalan terhadap klik pemerintah yang telah menipu rakyat sekian lama, dan dengan tegasnya mengenakan tamparan hebat kepada klik pemerintah UMNO-BN tanpa was-was dalam PRK Kajang kali ini serta memberi pengajaran pahit kepada calon MCA Chew Mei Fun.

2. Kami menghargai dan menyokong keputusan terbaru PKR meletakkan Presiden Parti Wan Azizah Ismail sebagai calon PRK Kajang dan melancarkan aksi boikot sehari sidang Parlimen. Kami percaya bahawa keputusan terbaru ini mempunyai dua maksud yang penting:

(1) Ini mencerminkan Parti Keadilan Rakyat (PKR), Parti Tindakan Demokratik (DAP) dan Parti Islam SeMalaysia (PAS) telah mencapai kata sepakat dalam memilih calon yang paling sesuai untuk menggantikan Anwar Ibrahim dalam PRK Kajang;
(2) Ia juga menggambarkan tiga parti Pakatan Rakyat (PR) akan bersama-sama mematuhi kehendak dan aspirasi rakyat, bersatu di luar mahupun di dalam Parlimen, dalam perjuangan terhadap pemerintahan hegemoni UMNO-BN dan segala jenis dasar-dasar perkaumannya.

Kami berpendapat bahawa selagi kemungkinan perjuangan berparlimen masih wujud, maka perjuangan memperbaiki kehidupan rakyat dan menuntut pembaharuan politik tidak boleh mudah tertipu dan jatuh ke dalam perangkap musuh rakyat yang beria-ia dengan idea "tak mahu pilihan raya" atau "tinggalkan pilihan raya". Oleh itu, kami bersetuju dengan dan menyokong keputusan terbaru pemimpin PR ini yang bersesuaian dengan kepentingan dan aspirasi Rakyat.

3. Memandangkan pemimpin tiga parti PR masih meneruskan garis perjuangan asal Anwar Ibrahim, iaitu "membendung serangan perkauman dan keagamaan daripada BN" dan "mengukuhkan Selangor supaya menjadi batu loncatan untuk menuju ke Putrajaya, kami dengan ikhlas berharap agar para pemimpin PR, terutamanya Wan Azizah yang memikul misi pentinguntuk bertanding dalam PRK Kajang ini dapat mendengar suara rakyat tertindas semua bangsa semua lapisan masyarakat, terutamanya mereka yang paling tertindas dan paling didiskriminasi dengan jujur dan ikhlas. Di samping itu, kami juga berharap mereka akan menerima dan melaksanakan secara berperingkat tuntutan-tuntutan yang dikemukakan oleh pertubuhan-pertubuhan masyarakat, termasuk “Tuntutan-tuntutan PRK Kajang 2014” yang dimulakan oleh Sahabat Rakyat Working Committee dan diendos bersama oleh Pemuda Dewan Perhimpunan China Kuala Lumpur dan Selangor (KLSCAH), Bahagian Belia Dewan Perhimpunan China Melaka dan 15 individu demokrat.

Sekiranya para pemimpin PR dapat memperjuangkan pembaharuan demokratik berdasarkan aspirasi dan kepentingan rakyat semua bangsa, PR sudah tentu akan mendapat sokongan daripada rakyat. Dengan itu, mereka bukan sahaja dapat mencapai kemenangan besar dalam PRK Kajang, malah akan mencapai kemenangan besar dalam pilihan raya kecil lain yang mungkin berlaku mahupun pilihan raya umum dan dalam perjuangan pelbagai bidang kelak. Sebaliknya, PR tetap tidak dapat elak daripada musibah ditolak oleh rakyat.

马来西亚航空一飞机失联最新消息:马航8日就失去联系的MH370航班发布第五份声明,称机上所有乘客的家属已经收到通知,马航同时发布了该航班的所有乘客名单。声明还说,8日早上,国际搜索和救援工作已经展开,目前,海上搜救工作仍在继续,但空中救援会在天亮后重启。

美联社报道,越南空军飞机发现两条大油迹带,当局怀疑这与8日凌晨失去联系的马来西亚航空MH370航班有关。越南政府声明称,这两条油迹带在越南南部被发现,油迹带长度在10-15公里之间,发现的浮油与失联的MH370航班燃油种类一致。

另据意大利安莎社最新消息,马来西亚航空公司失联的飞往北京的MH370航班名单中,今年37岁的意大利乘客路易吉•马拉尔迪(Luigi Maraldi)已经确认其不在飞机上。意大利外交部联系其家人,证实其现在泰国。其家人称路易吉•马拉尔迪的护照于2013年8月1日在泰国被偷,他曾回意大利办理了新的护照后重返泰国。目前有一种可能是有人用他丢失的护照登机。

不过该消息并未得到马来西亚方面的证实。而马来西亚运输部部长此前曾表示:“我们正在考虑有恐怖袭击的可能。”马来西亚总理纳吉布8日晚在召开记者会时,被问及此次失联飞机是否有可能涉及恐怖袭击时表示:“任何原因都有可能,但目前就下定论为时尚早。”

马来西亚航空公司MH370航班客机于吉隆坡时间8日0时41分从吉隆坡出发飞往北京,原定于北京时间6时30分抵达。客机于吉隆坡时间2时40分左右同马来西亚苏邦空中交通控制中心失去联络。机上共载有239人,包括227名乘客,其中150余名是中国人。

观察者网专栏嘉宾、民航评论员张仲麟专业分析马航客机失踪事件,基本排除迫降、劫机等可能性,解读搜救难度为何如此之大。

当今早六点半踏入办公室之时,就已经获悉了马来西亚航空370航班失去联络之事。作为一个民航从业人员,笔者对此类消息非常关心,更何况这飞机上有 着154名同胞。然而随着时间一分一秒过去,当早上八点依然没有马航370航班的消息时,已经有了最坏可能的预感。对于上百个急切等待着亲人消息的家庭, 对于心切154个同胞的整个中国来说,3月8日注定是个难眠之夜。而随着芝加哥朝阳升起,波音也将迎来又一个最长的一日,当然波音对于这种情况也早就不陌 生了。

“失联”是什么意思

要说飞机是如何失去联系的,那就得从飞机如何与地面联系说起。飞行员在飞行中主要的与地面管制人员联系手段是使用甚高频(VHF)无线电进行通话, 通过甚高频无线电飞行员可以在万米高空向飞行情报区的地面管制人员通报自己的状况,而地面管制人员也能相应的发布指令。除了无线电通讯之外,地面管制雷达也是管制人员获取飞机位置信息的重要手段,管制雷达分成两部分,一次监视雷达与二次监视雷达。一次监视雷达的原理很简单,通过扫描获得回波,屏幕上显示的一个个小光点就是天空中飞行的飞机。

然而一次雷达所能发现的只有这些光点,屏幕上的小光点分别是哪些飞机就无法分清了,这时候就需要二次监视雷达获取信息。二次管制雷达向空中的飞机一个个发去问询信号,飞机上的自动问答机收到问询信号后,将管制雷达所发出的信息要求发回去,如航班号,机型,机号,飞行高度,飞行速度,出发地,目的地等信息。二次雷达所获取的信息与一次雷达获得的飞机位置信息结合在一起,组成了最终在地面管制人员终端上所显示的综合信息。


而这次马航370航班失去联络,所指的就是地面与飞机甚高频无线电呼叫不到,一次雷达扫描不到,二次雷达问询不回答,地面管制人员彻底失去了与飞机的联系。当油料所能坚持的最大时间超过之后,所有人不得不做好了最坏打算的准备。

在空难发生的第一时间机组很可能忙于抢救飞机而无暇发出求救信号,或者飞机失事时的状态,如失速,坠落时机组已无力求救。

为何搜索如此困难

失去联系那么久,为何还没找到飞机?为何这么大一台飞机就找不到?当飞机在天上时,还能通过雷达来进行搜寻。然而此次马航370航班失联事件,几乎可以认为飞机迫降了或者坠毁了。雷达自然不可能发现飞机的踪迹。而当飞机失事之后,会启动失事信标,发送无线电信号来标明自己的方位。由于遇难信标的功率 并不大,只有在飞机失事地点附近才能准确接受到遇难信标并进行定位。至于用GPS定位一说,那只能说对于GPS的原理根本不明白。GPS定位是通过接收器 接收GPS卫星信号来获得定位,是一种被动定位方式,完全不可能用于寻找到使用GPS信号的装置的位置。目前可以确定的是,飞机最后的坐标是在泰国湾海域上空,在越南老挝领海交界处。要进行搜索也只能以最后失去联系的地点为圆心展开搜索。

然而很不幸的是距离失去联络海域最近的是柬埔寨与越南,两者海空搜索能力本来就不强,更不用说越南将更多的精力放在了南海海域,而非泰国湾。对于只有3架C212小型执法飞机的越南搜救力量而言,或许这个考验太难了些。而随着进入黑夜,搜索的难度将会进一步增加。最新获得的消息称,美国将派出飞机与 水面舰艇一同参与搜救。有着丰富搜救经验与高技术装备的美国海空军参与搜救,这将是一个好消息。

失联原因的分析

截止到晚上8点为止,依然没有飞机的任何蛛丝马迹,这基本排除了飞机迫降附近机场,或者成功迫降海面的可能性了。如果迫降成功,哪怕在海面上,也会第一时间通过紧急救援频道呼叫。在此或许不得不接受这么一个沉重的事实,那就是马航370航班已然失事。

通常来说飞机事故多发阶段是起降阶段,这两年来发生的主要空中事故也都是在起降阶段发生的。从目前获得的消息来看,最后与地面的联系是在0120, 起飞后40分钟。这时候已经处于高空平飞阶段了,高空平飞阶段并不是一个事故多发的阶段,但目前看来马航370航班就是在这个时候失去联系的,也可以推 断在那个时间段发生了事故。

Flightaware网站上所公布的马航370飞行数据记录,网站上最后更新的时间为凌晨1点02分,此时飞机已飞到万米高空,开始停止爬升进入平流层巡航阶段。
从目前已知信息,机组突然与地面失去联系来看,基本可以排除发动机失去动力这一个可能。暂且不说波音777是双发机,就算双发失效了也在滑翔,机组有足够的时间与地面联系,或者使用紧急救援频道呼叫mayday。哪怕由于发动机失效,停止供电,飞机上也有相应的紧急电源。

至于劫机这个可能性,机组也该有机会与地面联系,或者应答机设置为7500(意为机上发生暴力事件)劫机者也会找个机场降落并提出条件,目前已经可以排除这一种可能了。

而恐怖袭击炸弹高空爆炸这种可能性存在也无法排除。截止到3月8号晚,笔者发现了一条未经证实的令人震惊的新闻,被认为在马航370航班上的意大利 籍旅客Luigi Maraldi并未登上飞机,目前正在泰国,去年8月护照被偷。而今天凌晨,有人手持这本护照登上了马航370航班。排除重名等因素,如果有人手持这本丢 失的护照冒充Luigi Maraldi登上了这班载满中国旅客飞往北京的航班,那这个人又是谁?为何要冒充他人登机?这人与航班失联又有何关系?(马来西亚总理纳吉布8日晚召开记者会时,在被问及此次失联飞机是否有可能涉及恐怖袭击时表示:“任何原因都有可能,但目前就下定论为时尚早。”——观察者网注)

最后则是机械或人为事故了。高空巡航阶段人为操作失误可能性不大,但是考虑到法航447事故就是巡航阶段人为操作失误所引发的灾难,也不能彻底排除 这种可能性。那么就剩下机械故障了,发生如此迅速以至于机组都来不及向地面求救的故障,所能想到的就是飞机在空中解体了。这架机号为9MMRO的波音 777-200飞机在前年就发生过事故。2012年8月9日浦东机场,注册号为9MMRO的马来西亚航空B772与东航飞机发生了剐蹭事故。从当时拍摄的 事故现场图片来看,可以较模糊的看到该飞机尾部9MMRO字样的机号,与本次马航370失联事故飞机机号相同。

从图中清晰可见,该飞机右翼翼尖损伤严重。如果该飞机由于两年前的剐蹭事故导致机翼结构受损,在之后的维修中并没有彻底修复,给机翼结构带来隐患。有可能在执行马航370航班时机翼结构隐患爆发,导致右翼解体从而引发飞机失事。
截止到今(8日)晚上9点,海空搜救行动还在持续展开,已经有7国共同参与搜救行动。最新的消息是越南空军飞机发现了两条疑似与马航370相关的油料带,很可能是该飞机所留下的。

飞机失联已接近20小时(截至8日晚9 时),衷心希望搜救人员能尽早寻找到失联飞机,也祝愿能有幸存者被成功营救。(人民之友部落格9日注:马航代表在客机失联超过36小时后委婉请求乘客家属做好面对最坏情况出现的心理准备。)

新闻发布会于今天(3月8日)下午2时在加影雷斯科特新城酒店(Prescott Hotel Kajang)1楼会议厅举行。发言人为朱信杰(正中)。左起为钟立薇、李振风、陈成兴、杨秀丽、洪佩珊、严居汉、蔡尚諨与覃志强。除蔡尚諨是联署的民主人士,其余皆为人民之友工委。出席的媒体有主要中文平面媒体:《星洲日报》、《东方日报》、《光明日报》、《中国报》,以及网络媒体:《当今大马》、Free Malaysia Today、Bernama。

本文是人民之友工委会与2个民间组织(即隆雪华青与甲华青)与15名民主人士(名单列后)联署的《2014年加影州议席补选诉求》全文内容——

出乎全国人民意料而又不得不特别关注的雪兰莪州加影(KAJANG)州议席补选,即将在3 月11 日提名,23 日投票。我们,以下联署团体和个人,借此向参与这场补选的候选人、各政党团体领袖以及关心我国政治前途的各民族、各阶层人民,表达我们的心声。

巫统主导的国阵统治集团在第13届大选后继续执政,国内物价不断高涨、人民生活更加痛苦,而不满或反抗情绪比以前高涨,霸权统治集团无意改善人民生活而肆无忌惮大事炒作种族与宗教课题而引发诸如非伊斯兰教徒禁用“阿拉”字眼的强烈风波,企图模糊人民对生活痛苦根源的认识,以及转移人民对社会民主改革的目标。作为人民联盟的主要领袖和人民公正党的实权领袖的安华,在上述社会矛盾激化、斗争目标明显的关键时刻,却蓄意制造了这场在他以及人民公正党一些政治精英的对(党)内和对(党)外的政治斗争中都非常重要的加影州议席补选,安华尚且亲自上阵,率领全国人民奔赴这一场他认为具有全国政治意义的战役。因此,这场补选的发生及其意义受到全国各族人民的关注或质疑,以及受到民主人士与非政府组织的议论或非议,是理所当然的事。

我们认为,人民公正党既然以“遏制国阵政府的种族和宗教攻势”与“搞好雪州为入主布城铺下基石”两项主要说辞来回应各族人民对加影补选之所以产生及其意义的疑惑,此外,人民联盟的其他两个成员党即民主行动党和伊斯兰党也都支持安华及人民公正党对加影补选的上述立场,全国各族人民与民间组织(包括传统型的社团组织如商会、工会、会馆、文教等等组织)和现代型的非政府组织(如人权、妇女、环保、宗教等等组织)应该积极参与这场补选,参与的方式主要是发挥本身的独立主动性,尽其可能向候选人和他所代表的政党和政治联盟提出一些体现本身应有的基本权益、同时符合各族人民共同利益的诉求,并组织动员人民群众展示团结力量,促使候选人及其代表的政党和政治联盟接受并落实有关诉求,以期把我国由人民群众主导的民主改革运动推到一个新的里程碑。我们坚信人民群众才是创造历史的主要力量。

我们认为,作为加影州议席补选候选人,并准备入主布城当首相的安华和他所领导的三个政党组成的人民联盟,应该改变在第13 届大选所表现的政治领袖和政治精英高于一切的态度,诚恳放弃其文辞华而不实、意义模棱两可的宣言,认真签署民间组织提出的,但不限于下列的正义诉求,以表示人民联盟改革原有制度的真心,挽回全国人民对人民联盟的信心。否则,加影区的选民以及全国其他各地选民,在这场补选以及接下来的任何补选甚至未来的全国大选,必然会做出明智的决定和回应!

诉求一:消除宗教压迫,推行民族平等

第13 届大选落幕至今仅仅9 个月时间,国阵统治集团又再露骨地显示其滥用国家机器、蚕食各族人民基本权利的种族霸权的本质。近期内爆发的禁止国内半岛的非伊斯兰教徒使用“阿拉”字眼,以及雪州宗教局突击检查马来西亚圣经公会、扣查逾300 本马来文及伊班文版《圣经》并逮捕两名圣经公会负责人到警局盘问事件,显然就是国阵统治集团罔顾《联邦宪法》赋予人民宗教自由权利的规定,利用全面伊斯兰化的宗教制度,以稳固其选票来源,从而巩固其统治地位,并通过种族讹诈以压制敢于反对的政治力量。

因此,民联三党以及其他民主党团应该正面回应巫统来势汹汹的种族讹诈。否则,若让巫统霸权集团继续肆虐横行,各族人民特别是少数民族的宗教信仰与风俗习惯还会受到无理打压与侵蚀。

因此,我们要求候选人明确反对将伊斯兰教律法施加在非穆斯林教徒和人士身上,真实捍卫非穆斯林教徒和人士的宗教自由权利,具体办法如下:

(1)响应3 名民主行动党雪州州议员提出的修改《1988 年雪兰莪非伊斯兰宗教(监控向穆斯林宣教行为)法令》的建议;

(2)维护少数民族的宗教信仰和风俗习惯,并确保各宗教信仰者都能享有平等的权利信奉本身的宗教,并且依据需要拨款协助他们翻新、扩建甚至拨地允许盖建新的膜拜场所。

(3)公平合理对待各宗教膜拜场所,如明确列出地段或建筑物辟为或转为宗教场所的条件与指南,让那些符合申请条件的地段或膜拜场所得以从非宗教用途转换成为宗教用途。

诉求二:公平与干净选举

相较于以往的大选,第13 届大选依旧面对许多舞弊的指控,这情况显示出国阵霸权统治集团依然顽固霸道、漠视人民提出的改革选举的诉求。随后,净选盟成立了由6 名国内外的专才组成的“人民仲裁庭”。这个仲裁庭负责对第13届大选是否出现操纵性立法框架、操作性选票、操作性行政程序作出调查,也对选举委员会在本届大选中是否扮演恰当的角色作出分析。调查结果和有关建议交由净选盟公布。

但是,由国阵统治集团掌控的选举委员会却藐视这个具有代表性与权威性的人民仲裁庭,并以有关仲裁庭背后带有政治议程为由,拒绝委派(选委会)代表出席为期5 天的听证会。这证明了巫统主导的国阵统治集团根本没有改革我国选举制度的丝毫诚意。

我们支持净选盟2.0 代表各族人民提出的对公平与干净选举的8 项诉求。这8 项诉求,完完全全是正义的诉求,迄今仍然是各族人民的普遍愿望和斗争目标。我们支持净选盟2.0提出的“选委会必须全体辞职”的呼吁。我们要求,新的选举委员会吸收净选盟2.0所委派的代表,以取得各族人民的信任和支持。

我们要求,对现有的不合理的选区划分和选民人数进行改革——恢复国家独立时确立的规定,即:不同选区的选民人数差异不应超过15%。

诉求三:废除“新经济政策”和“土著固打制”

1969 年发生了“513 事件”后,“制度性的种族主义”就植根于我国,制造了既成事实的格局,方便了巫统霸权统治集团随心所欲推行“新经济政策”与相关议程。巫统霸权集团一直以来,一方面利用各种国家机器与恶法如《内安法令》(虽已宣布撤销,却由其他法令代替)、《煽动法令》、《官方机密法令》等等,来维持我国种族主义制度的运作——这让异议或抗争者经常面对被扣留或被提控的风险;另一方面明目张胆打着维护“马来主权”的旗号,骗取马来群众的支持来巩固其统治地位——这阻碍了各族人民特别是马来群众认清马来西亚的种族主义歧视和压迫现象和本质。

事实证明,自上个世纪70年代以来实施的“新经济政策”以及其后用其他名目包装的相关政策,只是国阵统治集团及其朋党用以掠夺资源财富以自肥的重要手段,它造就了一小撮富可敌国的马来大资本家和马来资产阶级,广大马来群众依然生活在水深火热之中;“土著固打制”表面上带给马来族群些少的机会和利益,实际上只是巫统霸权统治集团用来麻醉马来群众、分化民族团结的一套工具。

我们要求,废除“新经济政策”和“土著固打制”——只有这样做,国内人才资本才不会外流,外国人才资本才会涌进来,国家社会才会兴旺起来。

诉求四:公平对待各民族母语母文教育

独立56年以来,由于巫统主导的国阵统治集团强硬实行民族压迫和同化政策,处在被统治地位的各民族人民一直遭遇着在政治经济、文化教育、宗教信仰、社会发展等方面的不平等、不合理对待,而异议或抗争者更会遭受打压与迫害。其中,华裔族群争取包括大专院校在内的母语母文教育的生存与发展的事迹令人无法忘怀,印裔族群的淡米尔语文教育已然式微让人扼腕叹息,其他少数民族(如砂拉越的伊班族群和沙巴的卡达山杜顺族群等等)的母语教育几乎无法生存。

国阵统治集团一方面为了全面推行“独尊巫语巫文”的国民教育,处心积虑消灭华文教育,另一方面为了维持长久统治,利用政府拨款(实际上是人民群众缴交的税款)资助某些华小,承诺或实现华裔族群的某些诉求,以博取华裔族群的选票和支持。因此,往往在大选或补选期间,华校才比较有机会拿到政府拨款,华社才比较有机会实现某些诉求,却无法保障华文教育的永续发展。

我们要求:

(1)响应董总特别针对加影州议席补选而提出的三项教育诉求:即(i)全面承认华文独中统考文凭,(ii)批准复办加影育华华文中学并拨款建校,及(iii)协助解决已拖延14年之久的新纪元大学学院雪邦100英亩校地捐献问题;

(2)废除现行的《1996 年教育法令》,代之以公平对待国内各民族母语教育、为国家教育、社会建设和经济发展培养多语人才的多元开放的新教育法令;

(3)制度化拨款予华印(淡米尔)学校及其他少数民族(如伊班、卡达山杜顺)学校,解决少数民族语文教育的生存及发展所面对的障碍和困境;

(4)拨地给全马60 所华文独中,让这些华文独中得以以地养校、茁壮成长;

(5)支持印裔族群促请政府设立淡米尔语文中学的诉求。

Sidang Akhbar telah diadakan pada pukul 2 petang, 8 Mac 2014 di Prescott Hotel Kajang. Sidang ini dipengerusikan oleh Choo Shinn Chei (baju merah di tengah). )Hadirin (dari Kiri) termasuk Cheng Lee Whee, Lee Chen Feng, Tan Seng Hin, Yong Siew Lee, Ang Pei Shan, Nyam Kee Han, Chua Seong Hoo dan Mohd Nasir Prayitno. Chua Seong Hoo merupakan demokrat individu yang menandatangani tuntutan ini. Hadirin lain semua merupakan AJK Sahabat Rakyat Working Committee. Media yang hadir termasuk Sin Chew Jit Poh, Oriental Daily, Kuang Ming Daily, China Press, Portal berita Malaysiakini, Free Malaysia Today dan Bernama.

Isi sepenuhnya kenyataan "Tuntutan-tuntutan Pilihanraya Kecil Kajang 2014" yang diendos oleh Sahabat Rakyat Working Committee dan dua buah pertubuhan masyarakat (iaitu Bahagian Belia Dewan Perhimpunan China Melaka dan Pemuda Dewan Perhimpunan China Kuala Lumpur dan Selangor (KLSCAH) serta 15 orang demokrat (senarai nama disertakan di bawah) adalah seperti berikut:

Hari penamaan calon bagi pilihan raya kecil (PRK) Kajang akan berlangsung pada 11 Mac, manakala hari pengundian pula jatuh pada 23 Mac. PRK luar jangkaan ini harus diberi perhatian khas oleh rakyat seluruh negara. Kami, semua pertubuhan dan individu yang endos dokumen ini dengan ini menyampaikan hasrat kami kepada semua calon PRK ini, para pemimpin parti-parti politik dan pertubuhan masyarakat, serta rakyat semua lapisan semua bangsa yang prihatin terhadap masa depan politik negara kita.

Klik pemerintah Barisan Nasional (BN) yang didominasi oleh UMNO meneruskan pemerintahan selepas PRU 13. Ketidakpuasan dan emosi penentangan rakyat makin hari makin membara kerana kehidupan rakyat semakin menderita, sementara harga barangan melambung tinggi. Klik pemerintah hegemoni UMNO-BN yang berniat untuk mengelirukan kesedaran rakyat terhadap punca kesengsaraan kehidupan dan mengalihkan tumpuan rakyat terhadap matlamat reformasi demokratik masyarakat terus mengapi-apikan dan membesar-besarkan isu perkauman dan agama sehingga mencetusnya krisis larangan penggunaan perkataan “Allah” oleh penganut bukan Islam.

Konflik sosial tersebut semakin kritikal dan matlamat perjuangan juga semakin jelas. Pada saat-saat genting sebegini, Anwar Ibrahim sebagai pemimpin utama Pakatan Rakyat (PR) dan pemimpin ‘de facto’ Parti Keadilan Rakyat (PKR) telah merancangkan PRK Kajang dengan sengajanya. PRK ini sangat penting sama ada dalam perjuangan politik dalaman parti mahupun diluar parti bagi pihak Anwar dan elit politik PKR tertentu. Malah, Anwar sanggup meletakkan dirinya sebagai calon dalam PRK ini dan memimpin rakyat seluruh negara menuju satu medan perjuangan yang dianggapnya mempunyai makna politik nasional. Maka, tidak hairan isu kewujudan dan makna PRK ini diambil berat atau dipersoalkan oleh rakyat semua kaum di samping dibincang atau dikritik oleh individu-individu demokratik dan NGO-NGO.

Memandangkan PKR memberi dua alasan iaitu, (i) untuk membendung serangan perkauman dan keagamaan daripada BN, dan (ii) menjadikan Selangor sebagai batu loncatan untuk menuju ke Putrajaya untuk membalas keraguan rakyat semua bangsa terhadap makna dan keperluan PRK Kajang ini; Parti-parti lain dalam PR iaitu Democratic Action Party (DAP) dan Parti Islam Se-Malaysia (PAS) turut menyokong pendirian Anwar Ibrahim dan PKR terhadap PRK Kajang yang dinyatakan di atas, kami berpendapat rakyat semua bangsa seluruh negara dan pertubuhan-pertubuhan masyarakat (termasuk pertubuhan tradisional seperti pertubuhan perniagaan, kesatuan sekerja, pertubuhan yang berdasarkan asal-usul, pertubuhan kebudayaan dan pendidikan dan lain-lain) serta pertubuhan bukan kerajaan (NGO) moden seperti pertubuhan yang memperjuangkan and melindungi hak asasi manusia, wanita, alam sekitar, agama dan sebagainya harus menyertai PRK ini dengan aktif. Pertubuhan-pertubuhan tersebut boleh menyertai PRK ini, secara bebas dan berotonomi, dengan menyuarakan tuntutan-tuntutan yang melindungi hak dan kebajikan asas masyarakat yang mereka wakili yang seiring dengan kepentingan bersama rakyat semua bangsa. Pada masa yang sama, pertubuhan-pertubuhan tersebut harus menggemblengkan rakyat untuk menunjukkan kuasa rakyat bagi mendesak calon dan parti atau barisan yang diwakili oleh calon tersebut menerima dan kemudiannya menunaikan tuntutan-tuntutan tersebut. Kita berharap gerakan reformasi demokratik yang dipelopor oleh rakyat jelata akan mencapai satu milestone yang baru. Kami percaya bahawa rakyat merupakan kuasa utama yang mencipta sejarah.

Kami berpendapat bahawa Anwar Ibrahim selaku calon PRK Kajang dan Perdana Menteri in waiting yang bersedia menawan Putrajaya dan PR yang dipimpin oleh beliau, tidak harus bersikap sepertimana dalam PRU 13 yang mengagungkan pemimpin politik dan golongan elit politik. Mereka tidak harus menggunakan deklarasi yang berbunga-bunga tetapi tidak praktikal dan membawa makna yang samar-samar, sebaliknya harus endos tuntutan-tuntutan yang dikemukakan oleh pertubuhan masyarakat (tidak terhad kepada tuntutan ini) secara ikhlas. Dengan itu, barulah dapat menunjukkan keikhlasan PR dalam mereformasikan sistem sedia ada dan seterusnya memenangi keyakinan rakyat seluruh negara terhadap mereka. Jika tidak, pengundi-pengundi Kajang mahupun pengundi seluruh negara pasti akan membuat keputusan dan balasan yang bijak dalam PRK Kajang dan PRK-PRK lain, malahan dalam pilihan raya umum yang akan datang!

Tuntutan pertama : menghapuskan penindasan agama, melaksanakan kesamarataan bangsa

Klik pemerintah Barisan Nasional (BN) telah menunjukkan wajah sebenar hegemoni perkauman mereka yang menyalahgunakan jentera negara dan menindas hak asasi rakyat semua kaum hanya 9 bulan selepas PRU13. Insiden menghalang rakyat bukan Muslim di Semenanjung Malaysia mengguna perkataan “Allah” dan serbuan Jabatan Agama Islam Selangor (Jais) ke Persatuan Bible Malaysia (PBM) dan merampas lebih daripada 300 buah bible versi Bahasa Melayu dan Bahasa Iban serta menahan dua pegawai PBM ke balai polis untuk siasatan akhir-akhir ini jelas merupakan tindakan klik pemerintah BN membelakangkan hak bebas beragama yang diperuntukkan dalam “Perlembagaan Persekutuan” dan memperalatkan sistem keagamaan yang telah mengalami pengislaman yang lengkap, untuk mengukuhkan sumber undi dan kedudukan memerintah mereka. Klik pemerintah BN turut cuba menindas mana-mana kuasa politik yang berani untuk menentang dalam hal ini melalui ugutan perkauman mereka.

Oleh itu, parti dalam Pakatan Rakyat (PR) harus menyahut ugutan perkauman UMNO dengan balasan secara terus dan terbuka. Sebaliknya, jika membenarkan klik hegemoni UMNO untuk terus berleluasa, adat resam dan agama rakyat semua kaum terutamanya kaum minoriti pasti akan terus dihakis dan ditindas.

Oleh itu, kita menuntut calon-calon untuk mempertahankan hak kebebasan beragama orang bukan Islam dengan menentang secara jelas dan terbuka undang-undang Islam diguna pakai ke atas orang bukan Islam, langkah-langkah khusus seperti berikut:

(1) Menyokong cadangan pindaan ke atas Enakmen Agama Bukan Islam Selangor (Kawalan Pengembangan di Kalangan Orang Islam) 1988 yang dikemukakan oleh tiga ADUN DAP Selangor.

(2) Memelihara kepercayaan, agama dan adat resam bangsa minority, memastikan penganut semua agama mempunyai hak yang sama untuk menganut mana-mana agama, dan menyediakan dana untuk membantu mereka mengikut keperluan bagi pengubahsuaian, pengembangan atau memperuntukkan tanah untuk membina tempat ibadat baru.

(3) Melayan tempat ibadat semua agama dengan adil dan saksama, seperti menyenaraikan dengan jelas dan terbuka syarat-syarat dan garis panduan bagi lokasi dan bangunan yang hendak dijadikan atau menukar menjadi tempat-tempat ibadat. Meluluskan permohonan yang telah memenuhi syarat kelayakan untuk bertukar daripada tujuan bukan agama untuk tujuan agama.

Tuntutan kedua : Pilihan raya yang Adil dan Bersih

Berbanding dengan pilihan raya yang lepas, masih banyak aduan tentang penipuan dalam PRU 13. Ini menunjukkan kedegilan dan keangkuhan klik pemerintah BN yang terus mengabaikan tuntutan reformasi sistem pilihan raya yang dikemukakan oleh rakyat. Selepas PRU, BERSIH 2.0 telah menubuhkan ‘Tribunal rakyat’ yang terdiri daripada enam orang pakar dari dalam dan luar negeri. Tribunal ini bertanggungjawab menjalankan siasatan sama ada penyelewengan dalam pengendalian kerangka perundangan, manipulasi undi dan prosedur pentadbiran berlaku dalam PRU 13. Tribunal rakyat juga akan melihat dalam ketepatan peranan SPR dalam PRU kali ini. Keputusan dan cadangan siasatan dan analisis diumumkan oleh BERSIH 2.0.

Namun, SPR yang dikuasai oleh klik pemerintah BN terus memperkecilkan Tribunal rakyat yang mempunyai perwakilan dan yang berwibawa ini. SPR enggan menghantar wakil untuk menghadiri sidang Tribunal yang berlangsung selama lima hari dengan alasan bahawa terdapat agenda politik di sebalik Tribunal tersebut. Ini membuktikan klik pemerintah UMNO-BN tidak ikhlas langsung untuk mereformasi sistem pilihan raya negara kita.

Kami menyokong lapan tuntutan pilihan raya yang adil dan bersih yang disuarakan oleh BERSIH 2.0 mewakili rakyat semua bangsa. Kesemua tuntutan yang adil dan saksama ini masih merupakan aspirasi bersama dan matlamat perjuangan rakyat semua bangsa sehingga kini. Selain itu, kami turut memberi sokongan terhadap seruan BERSIH 2.0 bahawa semua anggota SPR wajib meletak jawatan. Kami menuntut agar SPR yang baru menerima wakil dari BERSIH 2.0 sebagai anggotanya untuk meraih kepercayaan dan sokongan rakyat semua bangsa.

Kami juga menuntut reformasi dijalankan terhadap ketidakadilan dalam persempadanan kawasan pilihan raya dan jumlah pengundi dalam satu-satu kawasan pilihan raya. Peraturan yang ditetapkan semasa kemerdekaan negara iaitu perbezaan jumlah pengundi antara kawasan pilihan raya tidak harus melebihi 15
peratus (%) patut dipulihkan semula.

Tuntutan ketiga : Mansuhkan “Dasar Ekonomi Baru” (DEB) dan “Sistem Kuota Bumiputera”

Selepas Peristiwa “Mei 13” berlaku pada tahun 1969, “institusionalisasi perkauman” telah berakar dan mengujudkan satu keadaan fait akompli di negara kita. Keadaan ini telah memudahkan klik pemerintah hegemoni UMNO melancarkan DEB dan agenda-agenda berkaitan dengan sesuka hati. Selama ini, di sebelah tangan, klik hegemoni UMNO mempergunakan jentera pemerintahan negara dan akta yang zalim seperti ISA (digantikan dengan akta lain walaupun telah dimansuhkan), Akta Hasutan, Akta Rahsia Rasmi (OSA) dan sebagainya untuk mempertahankan pelaksanaan sistem perkauman negara kita. Penggunaan akta-akta zalim menyebabkan mana-mana pihak yang berbeza pandangan atau berani menentang sentiasa menghadapi risiko ditahan atau didakwa. Di sebelah tangan yang lain, klik hegemoni UMNO secara terang-terang menipu sokongan massa Melayu dengan slogan mempertahankan “Ketuanan Melayu” untuk mengukuhkan kedudukan memerintah mereka. Ini telah menghalang rakyat berbilang bangsa terutamanya massa Melayu dari memahami fenomena dan sifat asas diskriminasi dan penindasan yang berfahaman perkauman Malaysia.

Fakta membuktikan bahawa pelaksanaan DEB sejak tahun 1970-an dan dasar-dasar lanjutan atas nama berlainan hanya merupakan kaedah utama klik pemerintah BN dan kroni-kroninya merampas sumber kekayaan untuk memenuhi kepentingan sendiri. Ia telah menghasilkan satu kelas kapitalis Melayu dan segelintir kapitalis besar Melayu yang kaya-raya manakala massa Melayu umum tetap hidup merana dan menderita. “Sistem kuota bumiputera” pula seolah-olah menawarkan peluang dan kepentingan yang terhad kepada masyarakat Melayu. Sebenarnya, ia hanya alat yang digunakan oleh klik pemerintah hegemoni UMNO untuk membius massa Melayu dan memecahkan perpaduan antara rakyat semua bangsa.

Kami menuntut agar DEB dan “Sistem kuota bumiputera” dimansuhkan. Hanya dengan cara ini, penghijrahan cendekiawan dan modal negara kita ke luar negeri (brain drain) dapat dihentikan, dan sebaliknya cendekiawan dan modal luar negeri akan masuk ke negara kita, untuk memajukan negara dan masyarakat.

Tuntutan keempat : Layanan samarata kepada Pendidikan Bahasa Ibunda Semua Bangsa

Klik pemerintah UMNO-BN melaksanakan dasar penindasan dan asimilasi kaum secara paksaan sejak negara mencapai kemerdekaan pada 56 tahun yang lepas. Oleh itu, rakyat semua bangsa yang berada di kedudukan diperintah telah dilayan secara tidak samarata dan tidak berpatutan dalam bidang politik, ekonomi, kebudayaan, pendidikan, agama, kepercayaan, pembangunan sosial dan sebagainya selama ini. Mereka yang berpendapat berbeza atau yang berani menentang akan ditindas dan dianiaya. Antaranya, perjuangan masyarakat Tiong Hua menuntut menghidupkan dan membangunkan pendidikan Bahasa Ibunda termasuk institusi pendidikan tinggi masih dikenangi, keadaan pendidikan Bahasa Tamil yang semakin merosot pula amat mendukacitakan, pendidikan Bahasa Ibunda kaum minoriti yang lain (contohnya kaum Iban di Sarawak dan kaum Kadazan-Dusun di Sabah) sudah hampir pupus.

Di satu segi, klik pemerintah BN cuba sedaya-upaya untuk menghapuskan pendidikan bahasa Cina dan Tamil demi melaksanakan pendidikan nasional yang hanya mengagung-agungkan Bahasa Melayu secara menyeluruh, di segi yang lain, untuk mempertahankan pemerintahan selama-lamanya, pemerintah menggunakan peruntukan kerajaan (sebenarnya merupakan cukai yang disumbang oleh rakyat) untuk membantu sekolah rendah Cina (dan Tamil), beri janji atau melaksanakan tuntutan tertentu bangsa Tiong Hua (dan India) agar memancing undi dan sokongan masyarakat Tiong Hua (dan India). Oleh itu, peluang untuk sekolah bahasa Cina (Tamil) memperoleh peruntukan kerajaan dan masyarakat Tiong Hua (India) mencapai tuntutan tertentu adalah lebih tinggi dalam tempoh pilihan raya umum atau pilihan raya kecil. Namun, pembangunan lestari pendidikan Bahasa Cina (Tamil) tidak dapat dijamin.

Kami menuntut:

(1) Menyokong tiga tuntutan yang dikemukakan oleh Persekutuan Persatuan-Persatuan Lembaga Pengurus Sekolah Cina (Dong Zong) sempena pilihanraya kecil Kajang, iaitu: (i) Mengiktiraf Sijil Peperiksaan Bersepadu (UEC) secara menyeluruh, (ii) Meluluskan dan memperuntukkan tanah untuk pembinaan Sekolah Menengah Yu Hua, Kajang, dan (iii) Membantu menyelesaikan isu tanah Universiti Kolej New Era di Sepang yang telah berlarutan selama 14 tahun.

(2) Mansuhkan Akta Pendidikan 1996 (Akta 550) , dan mengganti dengan satu akta baru yang terbuka dan berbilang yang melayan pendidikan bahasa ibunda semua bangsa dengan samarata, dan mampu menghasilkan modal insan celik pelbagai bahasa bermutu tinggi demi pendidikan negara, pembangunan masyarakat dan perkembangan ekonomi.

(3) Memperuntukkan peruntukan secara sistematik kepada sekolah-sekolah bahasa Cina dan Tamil, serta sekolah bangsa minoriti lain (seperti Iban, Kadazan-Dusun), untuk mengatasi rintangan dan dilema yang dihadapi oleh pendidikan bahasa ibunda bangsa minoriti dalam usaha menghidupkan dan membangunkan sekolahsekolah bahasa masing-masing.

(4) Peruntukkan tanah untuk kesemua 60 buah sekolah bahasa Cina persendirian (Chinese Independent School) supaya sekolah-sekolah ini boleh terus berkembang dengan dana yang dijana daripada tanah yang diperuntukkan.

(5) Menyokong tuntutan masyarakat India untuk membina sekolah menengah Bahasa Tamil.

We, the 54 undersigned civil society groups, trade unions and organizations are disturbed by the news that Malaysian Airlines (MAS), a government linked company continues to violate worker and trade union rights. Recently, MAS commenced disciplinary action against Mohd Akram bin Osman, the Secretary General of the National Union of Flight Attendants Malaysia (NUFAM), and 30 other NUFAM members. The show cause letter dated on or about 14/2/2014 asked why disciplinary action should not be taken against them by reason of their participation in an ‘illegal’ gathering on 27/11/2013 at the Ministry of Human Resources in Putrajaya. 

On 17/2/2014, Mohd Akram received yet another show cause letter with new allegation, and he has been suspended with half pay. 

The National Union of Flight Attendants Malaysia (NUFAM) is a registered trade union, and it had sought recognition from Malaysian Airlines, the employer of some of its members. Recognition is a legal requirement in Malaysia before an employer can be compelled to sit down, negotiate and agree to a Collective Bargaining Agreement(CBA). When MAS rejected the application, the Director General of Industrial Relations(DGIR) conducted a secret ballot which involved all qualified employees, and NUFAM succeeded in getting 62.73% of the votes, and thereafter on August 2013, the DGIR issued the formal letter acknowledging NUFAM as a recognized union. It must be noted that in Malaysian law, MAS, as employer, would have had to agree on the list of qualified employees entitled to vote before the secret ballot, and as such challenging the result and the subsequent recognition of the Union is bad.

Sadly, on 4/10/2013, MAS challenged the decision of the Minister to accord recognition to NUFAM, and filed a Judicial Review application in the High Court. MAS also allegedly applied for an interim stay order thus depriving NUFAM the ability to move forward towards a Collective Bargaining Agreement(CBA).

On 29/11/2013 MAS wrongly terminated Ismail Nasaruddin, the President of NUFAM, without even having a Domestic Inquiry, hence denying him the right to be heard and a fair hearing. Ismail was first suspended and then terminated allegedly by reason of a statement he issued in his capacity as President of NUFAM, which appeared in the media, which amongst others stated :- ‘…NUFAM Secretariat said it is calling on the prime minister to review Jauhari's contract and remove him as the CEO of MAS, which is a government appointed position, unhappy that there has been no changes in resolving the cabin crew's problems…’ It also raised other worker issues (The Sun Daily, 8/11/2013, NUFAM calls for resignation of MAS' CEO).

MAS send him a show cause letter on 8/11/2013, which also immediately suspended him. Thereafter, Ismail received another letter terminating him on 29/11/2013. According to a Malaysiakini report, it is alleged that MAS said Ismail had acted in contradiction with his duties as a chief steward of the airline by issuing the statement.(Malaysiakini, 14/11/2011, MAS suspends chief steward for criticising CEO). This is absurd as the statement was issued in the capacity of a Union President, not a mere employee whereby even an ordinary employee should never be denied his freedom of opinion or expression.

In response, 43 civil society groups and trade unions, including the International Trade Union Confederation(ITUC), issued a Joint Statement on 3/12/2013, entitled, “MAS Must Immediately Revoke Suspension of Union President Ismail Nasaruddin Worker Right Issue Should Be Resolved By Negotiations Not ‘Union Busting’. 

Then, in December 2013, disciplinary action was taken by MAS against about 10 NUFAM members allegedly based on comments made by them in their NUFAM Facebook Group. They were all suspended, but thankfully the disciplinary action seem to have been discontinued against 9. However, one Flight Attendant Ms Farahtina Kassim is still suspended from her flying duties since 8th December 2013 and even though she is now receiving full wages, she is being deprived of her flying allowance which constitutes a substantial sum of her ordinary take-home income. 

Now in February 2014, the show cause letter is against some 30 employees. The most recent allegation of participation in an ‘illegal gathering’ at the Human Resource Ministry is absurd given the reason that it a fundamental right for workers and/or their unions to file complaints and make representation to the government, including the Human Resource Minister. There has also been no known report or actions taken by the police or relevant authorities that indicated that any ‘illegal gathering’ even took place on 27/11/2013 at the Ministry. In any event, even if workers went to the Ministry not during their working hours, MAS certainly cannot make this a worker misconduct. Being convicted of serious crimes may be a basis for commencement of misconduct, but here there seem to have been no arrest, investigation or even prosecution at all. One also wonders whether there is ‘mala fide’ on the part of MAS to suddenly in February 2014 to issue show cause letter with regard to things that happened in November last year.

On or about 14 February 2014, Ms Farahtina Kassim and 3 others were terminated.

It is suspected that the timing of these recent actions by MAS may have been because the MAS’s judicial review at the High Court challenging of the recognition accorded Minister to NUFAM was fixed for 18/2/2014, which now has been adjourned to 27/3/2014. 

Taking into consideration all these actions of MAS, it is difficult not to come to the perception that MAS is on a ‘union-busting’ mission, which also includes persecution of Union leadership and those active in NUFAM.

Malaysia, being a member of the international community, must also act in accordance with International Standards including Ruggie’s Guiding Principles on Business and Human Rights: Implementing the United Nations “Protect, Respect and Remedy” Framework , whereby in cases of government-linked companies like MAS, the obligation is even greater. The Guiding Principles do state that “States should take additional steps to protect against human rights abuses by business enterprises that are owned or controlled by the State, or that receive substantial support and services from State...”. 

No worker, group of workers or unions should be barred from making public statements to the media or otherwise in the struggle for worker rights and human rights. This right is clearly acknowledged in the Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms, commonly known today as the UN Human Rights Defender Declaration.

We call on Malaysian Airlines to immediately cease all ‘union busting’ activities including the commencement and continuation of disciplinary actions against members and potential members of NUFAM.

We call on MAS to immediately discontinue the High Court action challenging the recognition of NUFAM, and to immediately sit down and work towards a Collective Bargaining Agreement with NUFAM.

We call again on MAS to immediately and unconditionally reinstate Ismail Nasaruddin, the president of the Union, Ms Farahtina Kassim and the 3 other flight attendants that have been terminated.

We call on MAS to recognize and respect worker rights including the freedom of association and the right of qualified employees to join the Union.

We call on the Malaysian government, being also a member of the International Labour Organization (ILO), and also having substantial influence in MAS, a government linked company, to ensure that worker rights and union rights are respected by MAS.

We call on Malaysia to immediately amend or repeal all laws that hinder or delay the speedy formation of trade unions and entry into Collective Bargaining Agreement with employers.

推翻乌克兰政权的抗议者们对祖国怀有美好憧憬。他们手持标语,呼吁向欧盟靠拢、终止俄罗斯干涉内政、推翻窃国贼亚努科维奇、建立廉洁政府。但是,他们最根本的要求与许多人几十年来奋斗的目标一样,即对抗腐败、蛮横的专制政府。他们渴望按规则办事的民主政体。

个中缘由众人皆知。大体上讲,民主国家比非民主国家更加富裕,卷入战火的机率较小,反腐败更加有力。从深层次看,民主国家让人们直抒胸臆,决定子女和本人的命运。全世界这么多人、这么多地方、愿意付出这么大代价,一起为了民主之理念而奋斗,这是其不朽魅力最好的证明。

然而,最近基辅等地的欢呼声背后夹杂着焦虑,因为好几个国家都上演了同一种令人不安的运动模式。民主聚集在重要广场。政府默许恶棍反击,但在民众的坚强护卫和全球新闻媒体的聚焦下,政府被迫让步。全球欢呼政权垮台,愿为建立民主政府伸出援助之手。可是,赶走独裁者容易,建立行之有效的民主政府则困难得多。新政府举步维艰,经济疲软,结果整个国家没比革命前好多少。这就是阿拉伯革命和十年前的乌克兰橙色革命的故事。2004年,亚努科维奇被街头抗议赶下台,2010年又被选上总统(其中有大笔俄罗斯资金卷入),然后反对派再度上台,结果国家状况还是一样糟糕。

民主正在经历艰难时世。独裁者被赶下台以后,反对派大多无法建立行之有效的民主政府。甚至在那些业已建立民主制度的国家,体制问题已经变得十分明显,社会上弥漫着对政治的幻灭情绪。然而,仅仅几年前,民主还大有统治世界之势。

20世纪下半叶,民主在那些最困难的地域生根发芽——遭纳粹重创的德国,穷人最多的印度,1990年代经历过种族隔离的南非。反殖民浪潮创造了一大批民主化的亚非国家,民主政府取代了专制政权:希腊(1974)、西班牙(1975)、阿根廷(1983)、巴西(1985)和智利(1989)。苏联垮台创造了一批中亚的新兴民主国家。美国智库自由之家(Freedom House)统计,截至2000年,全世界共有120个民主国家,占全世界总人口的63%。

那一年,超过100个国家的代表在华沙齐聚一堂,参加世界民主论坛(World Forum on Democracy),宣布“人民意志”乃是“政府权威之基础”。美国国务院发布报告,宣称各种各样的威权主义、极权主义政府形式都已经“试验失败”, “现在看来,民主取得了最终胜利”。

打了那么多胜仗以后,自然会冒出这种想法。但往后退一步,冷静地来看,民主的胜利没有那么多必然性。民主政制滥觞于雅典,之后过了两千多年,启蒙运动才把民主推上政治模式的前台。18世纪,只有美国革命创建了可持续的民主。19世纪,君主主义者一直试图对抗民主力量,实现复辟。20世纪上半叶,新兴民主政体在德国、西班牙和意大利都失败了。1941年,全世界只剩11个民主国家,罗斯福担心“民主的火焰将被野蛮人熄灭”。

20世纪晚期的进步势头在21世纪终止了。今年,全世界约40%的人口将参加自由、公平的选举,这是一个前所未有的数字。但是,民主在全球的发展停滞了,甚至可能已经逆流。自由之家认为,2013年是全球自由指数下降的连续第8个年头,其顶峰是本世纪之初,随后便一路下滑。1980至2000年间, 民主只是遭遇一些小挫折,但2000年以来,面临的障碍越来越多。民主的问题已经没法用简单的数字来呈现。许多名义上的民主国家已经滑向专制政权,民主只剩选举这一外在形式,缺少民主制度有效运转所需要的人权和体制保障。

胜利能够点燃人们对民主的信心,例如政权更迭之际的开罗和基辅,但随后便再度熄灭。在非西方地区,民主屡屡崩溃。而在西方内部,民主常常与债台高筑、运作失灵等字眼联系在一起,损害其国内外的名声。民主永远有批评者,但现在,西方内部出现种种缺陷,其海外形象日益脆弱。于是,原来的批评声音重新被加以严肃对待。民主失势,原因何在?

民主失势有两个原因

有两个原因。其一是2007-08年的金融危机,其二是中国崛起。金融危机造成的心理创伤与经济损失一样大。它揭示了西方政治体制的根本性弱点,破坏了西方人固有的自信。西方政府数十年来持续发放福利,任凭债务不断升高,政客们以为他们已经超越了繁荣泡沫的循环并解除了风险。许多人对本国政治体制不再抱有任何幻想——尤其是当银行家们为自己订制高额奖金时,各国政府却掏出纳税人的钱为银行纾困。金融危机让华盛顿共识招致新兴世界齐声谴责。

同时,中国共产党打破了民主世界在经济发展方面的垄断。哈佛大学前校长萨默斯(Larry Summers)观察到,美国每30年生活水平翻一番,而中国过去30年间每10年生活水平翻一番。中国的精英阶层认为,他们的模式——共产党紧密控制, 以及稳定地选贤任能——比民主效率更高,更能避免僵局。中国领导人每十年左右换一届,按照完成施政目标的能力选拔干部。

批评者们谴责政府用各种措施控制民意,无论是关押异议者或审查网络言论。他们批得没错。不过,中国政府严密控制的决心反过来也证明了对民意的关切。 同时,中国领导人有能力处理国家建设方面的重大问题,而这些问题可能困扰民主国家数十年。例如,中国仅用了两年时间就实现2.4亿农民享受养老保险——这要比美国公共养老保险体系的总人口多得多。

许多中国人愿意在经济发展的前提下忍受现行体制。2013年皮尤全球态度调查(Pew Survey of Global Attitudes)显示,85%的中国人对本国发展方向“十分满意”,而在美国这一数字仅为31%。复旦大学的张维为提出,民主正在破坏西方国家,尤其是美国,因为民主使得政治僵局制度化、轻视决策、还产生了小布什这样的二流总统。北京大学的俞可平提出,民主使得一些简单事情“过于复杂和琐碎”,让“某 些擅长甜言蜜语的政客误导民众”。同样来自北京大学的王缉思观察到,“许多引进西方价值观和政治制度的发展中国家正在遭遇社会动荡和骚乱”,中国则提供了 另一种模式。从非洲(卢旺达)到中东(迪拜)、东南亚(越南),都在严肃对待这一意见。

什么更重要?财富还是权利?(来源:皮尤研究中心)

面对2000年以来一系列的民主派失望情绪,中国的发展显得更加强势。俄罗斯的民主派首先遭遇重大挫折。1989年柏林墙倒塌,苏联的民主化进程似乎不可阻挡。1990年代,俄罗斯在叶利钦领导下醉醺醺地朝民主走了几步。但1999年末,他将权力移交给普京——一名克格勃特工。从那以后,他分别两度担任总理和总理。这位后现代沙皇已经摧毁了俄罗斯的民主实质,遏制新闻自由,关押反对派,同时,他还维持着表演——每个人都可以投票,只要让普京先生获胜。委内瑞拉、乌克兰、阿根等地的独裁者依样画葫芦,没有完全抛弃、而是维持着民主的假象。这让民主的信誉进一步受损。

另一重大挫折是伊拉克战争。2003年美国领导的侵略战争结束后,传说中萨达姆拥有的大规模杀伤性武器并未兑现。随后,小布什又把战争的借口换成了自由与民主。“自由国家协同一致推动民主,乃是敌人失败的先声。”他在总统连任讲话上说。这已经不只是机会主义了:小布什真诚地相信,只要独裁者主宰中东,这片土地就是恐怖主义的土壤。但这让民主进程遭受重创。左翼人士找到了新的证据,证明民主不过是美帝国主义的遮羞布。现实主义外交家则认为,当前伊拉克日益动荡的局势再度表明,美国领导的民主化进程是社会不稳定的解药。而福山等清醒的新保守主义者则将其视为民主水土不服的又一例证。

第三个严重挫折是埃及。穆巴拉克政权2011年垮台,浪潮般的抗议活动让人们看到希望,以为民主将在中东地区传播开来。但颂歌随即变成悲鸣。埃及大选的赢家不是自由派(各立山头,荒唐得让人绝望),而是穆尔西的穆斯林兄弟会。穆尔西把民主当作赢家通吃的体制,将穆兄会塞入政府,赋予自己几近无限的权力,创建穆斯林永远占大多数的上议院。2013年7月,军方介入逮捕埃及首位民选总统,关押穆兄会高层人士,杀害数以百计的抗议者。埃及局势与叙利亚战争、利比亚无政府状态一道打破了阿拉伯之春的希望。

同时,民主阵营的某些新成员成绩不佳。南非自1994年引入民主体制以来,一直是由非洲人国民大会统治。该党越来越自私自利。土耳其一度将温和的伊斯兰教与繁荣、民主结合在一起,而现在正堕入腐败与专制的深渊。孟加拉、泰国和柬埔寨的反对党要么抵制大选,要么拒绝接受选举结果。

所有这一切都证明,维持民主正常运转是一项非常漫长的工作,那种以为民主可以自己迅速生根发芽的想法已经烟消云散。虽然民主如小布什和托尼•布莱尔所说是“普世的追求”,但它还是一种基于文化的实践。西方国家几乎都是在建立复杂的政治制度很长时间以后才落实选举权,实现强有力的公民组织和宪法权利, 而西方社会一贯珍视个人权力与司法独立等理念。

美国和欧盟已非民主榜样

不过,原本视为民主范例的体制最近几年却变得过时而无用。美国已成为政治僵局的代名词。这个国家如此痴迷于党派之争,以至于过去两年间两度站在债务违约的悬崖边缘。分割选区以谋取选举优势的行为也侵蚀了美国民主。这种行为鼓励极端主义,因为政客们只顾吸引“死忠”选民,抛弃了大量的普通选民。金钱获得了美国历史上前所未有的政治影响力。数以千计的说客(平均每位国会议员有超过20名说客)让立法过程变得更为冗长和复杂,让特殊利益集团更有机会参与其中。所有这一切给人造成的印象是,美国民主是可以卖的,富人权力比穷人大,尽管说客和金主们宣称政党开销是在践行言论自由的权利。结果是,美国的形象—— 乃至民主本身——遭受可怕的冲击。

欧盟也不是民主的榜样。1999年引入欧元主要是技术官僚的决策;只有两个国家(丹麦和瑞典)就此问题举行全民公决(结果都是否决)。巩固欧盟权力的《里斯本条约》遭选民们错误地投票否决。欧元危机最困难的日子里,欧元精英们强迫意大利和希腊用技术官僚取代民选领导人。欧洲议会修补民主赤字的努力失败了,这一机构本身遭到忽视与鄙夷。欧盟已成为孕育民粹主义政党的沃土,荷兰自由党的基尔特•威尔德斯(Geert Wilders)和法国国民阵线的勒庞等人宣称,将捍卫普通百姓,对抗傲慢、无能的精英。希腊的金色黎明正在考验民主国家对纳粹式政党的容忍限度。原本用来遏制欧洲民粹主义的机制,如今却让它死灰复燃。

甚至在民主的心脏地带,它也遭受着严重的结构性问题,而非小毛病。bold自民主的黎明——19世纪晚期以来,民主通过民族国家和全国性议会得以体现。人民选出代表,在一定时期内行使国家权力。但这种安排从上到下均遭到冲击。Boldend

从上层来看,全球化改变了一国政治的根基。国家领导人将一大部分权力移交给全球市场和跨国主体,例如贸易与金融。结果,政治家无法向选民兑现承诺。 IMF、WTO、欧盟等国际组织影响力越来越大。自然,人们会问:单个国家如何处理气候变化、偷逃税款等顽疾?政治家们为了应对全球化,丧失了审慎的品格,将权力送给某些领域未经选举的技术官僚。央行独立决策的国家数量从1980年的约20个增加到现在的逾160个。

来自底层的挑战更为严峻:加泰罗尼亚和苏格兰等民族可能独立,印度各邦和美国的市长们。他们都想从中央政府手中夺回权力。另外,卡内基国际和平基金会的莫赛斯•奈姆(Moisés Naim)指出,NGO和说客等“微观权力”正在扰乱传统政治结构,无论民主或独裁国家的政治家日子都将更加难过。互联网让微观权力的组织和宣传工作变得更加便利;观众们每个星期参与一次生活秀的投票,网民们轻点鼠标便可发出联署信,在这样的世界,每隔几年才轮到一次的政治选举越来越与时代脱节。英国议员道格拉斯•卡尔斯维尔(Douglas Carswell)将传统政治比作HMV——一家业已破产的英国唱片店——人们通过Spotify(一家流媒体服务网站)想听什么就听什么、想什么时候听就什么时候听。

调查显示逾半数选民“根本不信任政府”

但是,民主面临的最大挑战既不是来自上层,也不是来自底层,而是中间——选民本身。柏拉图关于民主的主要忧虑是市民“沉湎于日常生活的享乐”。这的确是真知灼见。民主政府逐渐习惯于背负庞大的结构性债务,借钱满足选民的短期需求,忽视长期投资。法国和意大利已经30多年没有实现过财政平衡。金融危机骤然暴露了此类以借债度日的民主国家的真面目。

随着危机后的刺激政策逐步缩小,政客们现在必须直面两难困境。经济持续增长、信贷宽裕的日子可没有这些烦恼。但政客们要想说服选民接受财政紧缩,那么他们的选票箱将会很难看。增长放缓、财政吃紧,导致利益集团争夺有限资源的竞争将更加激烈。更糟糕的是,这种竞争是在人口老龄化的西方世界展开。老人投票率比年轻人高,更有组织性(譬如强大的美国退休人员协会),因此他们的选举影响力更大。老人在数量上占据绝对优势。许多国家现在面临过去与未来的斗争, 既有福利与未来投资的斗争。

日益蔓延的厌倦情绪让民主雪上加霜。发达国家的党员数量持续下降:仅仅1%的英国人现在参加政党,而1950年的数字是20%。选民数量也在下降, 一项针对49个民主国家的研究显示,选民数量自1980-84年至2007-13年间下降了10个百分点。2012年针对7个欧洲国家的调查显示,逾半数选民“根本不信任政府”。同年Yougov公司针对英国选民的调查表明,62%的受访者认为“政客永远在撒谎”。

同时,“闹着玩儿”和“游行抗议”之间的界限越来越模糊。2010年,冰岛的“最好党”(Best Party)承诺将公然腐败,却赢得足够选票,成功走进雷克雅维克市议会。2013年,四分之一的意大利选民支持格里罗——一位喜剧演员。如果人们真是一无所求,这种对政治的普遍厌倦情绪也许是健康的;但选民实际上有很多要求。结果将造成恶劣、不稳定的影响,一方面依赖政府,一方面却鄙视政府。这种依赖关系使得政府过度扩张、背负过多债务,而鄙夷的情绪剥夺了政府的合法性。民主的机能失调与坏脾气接踵而来。

心脏地带的民主问题有助于解释其他地方遭遇的困难。20世纪民主之所以运转良好,一部分原因是美国的霸权:其他国家自然而然想要模仿世界领袖。但随着中国的影响力越来越大,美国和欧洲失去了榜样的魅力和推广民主的胃口。奥巴马政府现在似乎被恐惧所缠绕,害怕民主会造成政权腐败或帮衬圣战主义者。既然美国政府连预算都通不过,更谈不上对未来的任何规划,那其他发展中国家为什么要把民主当作理想政体呢?既然欧元国家的精英们为了财政原则而踢走民选领导人,那独裁者们为什么要听从欧洲的民主教诲呢?

与此同时,新兴世界的民主国家遭遇了发达世界的同样问题。这些国家也受到短期开销的束缚,拿不出长期投资。巴西允许公务员53岁退休,却造不出一个 现代化的机场。印度给客户们小恩小惠,却没钱投资基础设施建设。各国的政治体制被利益集团所绑架,被反民主的恶习所破坏。英国历史学家帕特里克•弗伦奇 (Patrick French)写道,印度下院所有30以下的议员均出自政治世家。甚至资本家们都不再愿意支持民主:许多印度商业大亨一直在抱怨,印度的混乱民主造就糟糕的基础设施,而中国的威权体制造出了高速公路、漂亮的机场和高速铁路。

以前,民主也曾退却。1920、1930年代,共产主义和法西斯主义来势汹汹:西班牙1931年恢复议会制时,墨索里尼将其比作在电气时代使用煤油灯。1970年代中期,西德总理维利•勃兰特声称,“西欧民主只剩二三十年的时间;然后它将滑落,失去动力和方向,陷入独裁者包围的海洋”。如今事情没那么糟糕,但针对民主的优越性和必然性这一理念,中国造成的威胁远比共产主义来得大。

然而,中国令人震惊的前进步伐有其深层次缺陷。精英阶层变得自我循环、自私自利的小圈子。50个最富有的全国人大代表拥有的财富总额达947亿美元,是50个最富有的美国国会议员的60倍。中国的经济增长率从10%降到了8%,未来可能继续下降——对于依靠经济增长维持合法性的政权来说,这是巨大 的挑战。

托克维尔在19世纪时指出,民主的外表总是看起来比内在虚弱:表面上各种混乱,实际上却具有很多内在力量。产生新的领导人,提供新的政策,民主国家能够比专制国家采取更加新颖的策略处理问题,虽然寻找正确的政策可能来来回回花费很多时间。但新兴民主国家和老牌民主国家若想确保胜利,都必须打牢根基。

必须对民选政府进行分权制衡

麦迪逊(James Madison)和密尔(John Stuart Mill)等现代民主的奠基者最让人诧异的是他们的清醒态度。他们将民主视为有力、但不完美的机制:需要审慎设计,发挥人类的创造力,但还要制约反常的人性,确保机器正常工作,不断加油、调试、试验。

清醒的品格在建立民主制度伊始尤为重要。最近之所以出现那么多失败的民主试验失败,原因之一就是过于看重选举,轻视了民主的其他必要因素。例如,国家的力量必须得到制衡,言论自由、结社自由必须得到保障。那些最成功的新兴民主国家,秘诀之一便是克服了多数主义(majoritarianism)的诱惑——赢得大选以后,多数派即可为所欲为。印度从1974年(除了实施紧急状态的那几年)、巴西自1980年代中期以来,两国都得以保持民主政体至今,原因都只有一个:限制政府权力,保障个人权利。

强有力的政制不但能够促进长期稳定,还可以减少少数派篡权的机率。它还能够支持打击腐败——发展中国家的祸根。相反,新兴民主国家受挫的第一个信号就是民选领导人逾越权力——通常是以代表大多数人的名义。穆尔西想方设法要把穆斯林兄弟会的支持者塞进埃及上议院。亚努科维奇削弱了乌克兰议会的权力。普 京以人民的民意践踏了俄罗斯的独立机构。若干非洲国家领导人正在实行残暴的多数主义——取消总统任期限制,或如乌干达总统约韦里•穆塞韦尼2月24日所做 的,惩罚同性恋行为。

这类反自由的行为发生时,即使受到该国国内大多数人支持,外国领导人也应当大声喝止。但是,最需要吸取教训的是新兴民主政体的设计者:他们应当看到,对于健康的民主政体而言,强有力的分权制衡的重要性不亚于选举权。甚至谋求独揽大权的政客也应当从埃及和乌克兰吸取教训:要不是穆尔西和亚努科维奇谋取权力,激怒同胞,前者就不会呆在监狱里,被送上法院的被告席,后者也就不会流亡海外。

即使是成熟的民主国家也要注意自身的制度建设。全球化和数码革命使得某些最受推崇的政治体制变得陈旧不堪。制度完备的民主国家需要将自身体制升级换代,解决本国问题,重新拾起民主的国际威望。某些国家已经开始有所准备。美国参议院采取措施,加大参议员阻挠提名的难度。一些州引入公开初选,并将划分选区的工作交给独立委员会。还有别的措施。改革政党资金政策,公布所有金主的名字,这也许能减少特殊利益集团的影响力。欧洲议会可以要求议员提供公款开销的发票。意大利议会有太多享受高薪的议员,上下议院权力过于均等,导致任何议案都难以通过。 可是,改革者必须有大魄力。限制特殊利益集团的最好办法是限制政府项目数量。解决政治厌倦情绪的最好办法是政客们少说大话。质言之,政府越小,民主就越健康——这一理念可追溯至美国革命。“建立人统治人的政府过程中,”麦迪逊提出,“最大的困难是:你必须先让政府控制民众;然后让它控制自己。”有限政府的概念是二战后民主复兴的必要因素。《联合国宪章》(1945)和《世界人权宣言》(1948)设定了各国政府不可践踏的人权与规则,即使大多数人希望政府这么做。

这些分权制衡的理念乃是出于对暴政的恐惧。但如今,尤其是在西方,扼杀民主的敌人越来越隐蔽。一个是政府规模。政府持续扩张,导致个人权利受损,特殊利益集团受益。另一个敌人是政府允诺空头支票的恶习,要么是发放根本承担不起的福利,要么是发动赢不了的战争(例如打击毒品)。选民和政府都必须认可限制政府扩张权力的欲望。譬如,央行的独立决策成功遏制了1980年的通货膨胀。现在正是时候,应当在更大范围内限制政府权力。成熟的民主国家,与新兴民主国家一样,都需要对民选政府进行分权制衡。

政府可以通过各种方式进行自我限制。他们可以严控财政支出——例如瑞典已经承诺根据经济发展平衡预算规模。他们还可以引进“日落条款”,强迫议会每 十年重审一遍法律。他们还可以请求超越党派利益的委员会来设计长期改革方案。瑞典的独立委员会提出符合实际的改革措施,包括加大私人养老金份额,根据人口 预期寿命调整退休年龄,使得该国的养老金体系免于崩溃。智利在协调铜产品市场活力与民众希望分享利润的呼声之间做了很好的协调工作。该国还实行严格规定, 确保适应经济周期,指定专家委员会分析市场涨落。

对于虚弱的民主国家来说,赋予智者与好人以更大权力,这难道不是一剂良药吗?不尽然。无私的规则可以防止人们选择导致破产和社会停滞的政府支出方案,或者保护少数族裔免于迫害。但是,技术官僚的统治也有其局限性。在财政政策和福利改革等重大领域,权力应谨慎行使,过程必须公开、透明。

一些权力向上集中,由领导人和技术官僚决策,那么另一些权力则应下方给普通民众,以取得制衡。难点在于,如何利用全球化与本土化这两股力量,不回避、不抗拒。既有的民主国家面临的两股力量——上层的全球化,下层的微观权力——如果取得平衡,就能够增强民主,而非破坏民主。

托克维尔提出,本土的民主常常是最好的民主形式:“市镇集会对于个人自由的意义,就像小学的科学课一样;它教导人民如何在力所能及的范围内使用、享受民主。”市长的支持率通常是全国性政客的两倍。现代技术能够帮助实行现代版的托克维尔式市镇集会,推动公民参与与创新。过度的网络民主形式(每件事都要反反复复的投票)可能会受到特殊利益集团操纵。但技术和直接民主能够相互制衡,打个比方,独立的预算委员会可以评估发起投票的成本和可行性。

某些地方政府正在逐渐取得平衡。最鼓舞人心的例子是加利福尼亚。加州的直接民主体制允许公民投票审议互相矛盾的政策,例如提高财政支出和降低税率, 同时,封闭的党内初选和选区划分滋长了极端主义。但最近五年,加州引入一系列改革措施。这其中一部分是慈善家、投资家贝格鲁恩(Nicolas Berggruen)的功劳。加州设立“长期规划”委员会,制衡选票的短期利益,还引进了公开初选,并将划分选区的工作交给独立委员会。加州还成功实现预算平衡——州参议院主席斯坦伯格(Darrell Steinberg)称之为“近乎超现实”的成就。

芬兰政府设立了类似的独立委员会,为养老金体系的未来规划建言献策。同时,芬兰尝试利用电子化民主:议会必须审议任何超过5万人联署的动议。但需要做的工作还有很多——结合技术官僚与直接民主,上层与下层的代表性——如果民主想要恢复健康的话。美国第二任总统约翰•亚当斯曾说过“民主不会永远存在。它会衰弱、耗尽,然后自杀。从来没有哪个民主政体最终没有自杀。”显然他错了。民主是20世纪意识形态之争的伟大胜利者。但如果民主还想延续20世纪的辉煌战绩,它必须在幼时得到一丝不苟的呵护,成年后孜孜不倦地雕琢。

The State Council Information Office of the People's Republic of China published a report titled "Human Rights Record of the United States in 2013" on Friday.

Following is the report's full text:


Foreword

The State Department of the United States, which posed as "the world judge of human rights," made arbitrary attacks and irresponsible remarks on the human rights situation in almost 200 countries and regions again in its just-released Country Reports on Human Rights Practices for 2013. However, the U.S. carefully concealed and avoided mentioning its own human rights problems. In fact, there were still serious human rights problems in the U.S in 2013, with the situation in many fields even deteriorating.

-- In 2013, 137 people died in 30 mass killings, which caused four or more deaths each, in the U.S.. A shooting rampage in the headquarters of the Naval Sea Systems Command in Washington, D.C. left 12 people dead.

-- The U.S. engaged in a tapping program, code-named PRISM, exercising long-term and vast surveillance both at home and abroad. The program is a blatant violation of international law and seriously infringes on human rights.

-- The use of solitary confinement is prevalent in the U.S.. About 80,000 U.S. prisoners are in solitary confinement in the country. Some have even been held in solitary confinement for over 40 years.

-- The U.S. still faces grave employment situation with its unemployment rate remained high. Rates of unemployment for the lowest-income families have topped 21 percent. The homeless population in the U.S. kept swelling and it had climbed 16 percent from 2011 to 2013.

-- There are a large amount of child laborers in the agricultural sector in the U.S. and their physical and mental health was seriously harmed.

-- Frequent drone strikes by the U.S. in countries including Pakistan and Yemen have caused heavy civilian casualties. The U.S. has carried out 376 drone strikes in Pakistan since 2004, causing deaths of up to 926 civilians.

-- The U.S. remains a country which has not ratified or participated in a series of core UN conventions on human rights, such as the International Covenant on Economic, Social and Cultural Rights, the Convention on the Elimination of All Forms of Discrimination against Women, the Convention on the Rights of the Child, and the Convention on the Rights of Persons with Disabilities.


I. On Life and Personal Security

The U.S. was haunted by an increasing number of violent crimes in 2013 with frequent occurrence of firearms-related criminal cases, public information show. American citizens' lives and personal safety are threatened by an increasingly dangerous environment.

The number of violent crimes has risen sharply. According to the Uniform Crime Reports, released by the Federal Bureau of Investigation (FBI) in 2013, the U.S. registered 1,214,464 violent crimes in 2012, of which 14,827 are murders and nonnegligent manslaughters, 84,376 forcible rapes, 354,522 robberies and 760,739 aggravated assaults. According to statistics revealed by the Bureau of Justice on October 24, 2013, the rate of violent victimization increased from 22.6 victimizations per 1,000 persons age 12 or older in 2011 to 26.1 in 2012.

On April 15, 2013, twin bombings ripped through Boston Marathon, leaving three dead and 264 injured. Among the killed was an 8-year-old. U.S. authorities called the bombings a terrorist attack (USA Today, December 6, 2013).

The Washington Post reported on January 1, 2014, that Robert Senquan Spencer, 21, was dead from a shotgun blast on a Southwest Washington street, becoming the District's 80th homicide victim of 2013. The District had 103 homicides in 2013 - a sharp increase from 88 in 2012.

American citizens keep the world's largest number of privately owned guns. According to figures released by the FBI in 2013, the total number of background checks conducted for gun sales in 2013 add up to 21,093,273, beating the previous 2012 record of 19,592,303 by 1,500,970 (www.townhall.com, January 7, 2014). As of 2013, there were about 300 million guns in the U.S.. On average, more than 100,000 Americans are being shot each year, and 30,000 deaths are caused by the use of guns. Victims are either killed in gun-related crimes or died in suicide or nonnegligent manslaughter. The U.S. government failed to take effective measures to control guns.(www.gunfaq.org, www.guncrimestatistics.com).

After the mass shootings in Colorado and Sandy Hook Elementary School in 2012, there were strong calls in the United States for stricter controls on firearms. On April 17, a bipartisan bill to support expanded background checks on firearms was blocked in the Senate. Previously, plans for a ban on assault weapons and high-capacity magazines had already been removed from the gun-control bill (www.bbc.co.uk, April 17, 2013). At the same time, states in the U.S. continue to loosen their gun laws. On January 5, Illinois became the last state in the U.S. to allow average citizens to carry around concealed firearms. Anyone with firearm owner's identification card in the U.S. is allowed to pack heat in places except the no-go zones including schools, parks and restaurants (www.usatoday.com, January 8, 2014).

Gun violence is rampant in the U.S.. There are 11,000 Americans killed by gun violence every year (www.telegraph.co.uk, December 17, 2013). Information collected regarding types of weapons used in violent crime showed that firearms were used in 69.3 percent of the nation's murders, 41 percent of robberies, and 21.8 percent of aggravated assaults, according to the Uniform Crime Reports released by the FBI in 2013. Every year, there is serious gun violence in the U.S.. On October 21, 2013, Attorney General Eric Holder said the average number of mass shooting incidents has tripled in recent years. According to Justice Department figures on mass shootings, 404 people were shot and 207 people were killed from 2009 to 2012 (www.huffingtonpost.com, October 21, 2013). According to a report published on the USA Today on December 16, 2013, 137 people died in 30 mass killings - four or more people killed, not including the killer - in 2013.

On September 16, 2013, civilian contractor and military veteran Aaron Alexis, a resident of Texas, went on a shooting rampage after he entered the headquarters of the Naval Sea Systems Command in Washington, D.C. in the morning, killing 12 people and injuring several others. An eye witness said the gunman began shooting from a fourth-floor overlook in the hallway and was aiming down at people in the building's cafeteria on the first floor. Aaron Alexis was shot dead in a 30 minutes' exchange of gunfire with authorities (www.usatoday.com, September 17, 2013).


II. On Civil and Political Rights

The U.S. government took liberty in monitoring its citizens, which shocked the world. Tortures in the U.S. prisons raised concerns. Elections and the checks-and-balances systems were plagued by malpractices and inefficiency, impairing civil interests.

The U.S. government exercises massive and unrestrained information tapping on its own citizens. Edward Snowden, a former Central Intelligence Agency (CIA) employee, revealed a tapping program carried out by the National Security Agency (NSA), code-named PRISM. Under the program, the U.S. intelligence, by virtue of data provided by nine Internet companies, including the Microsoft, Google, Apple, Facebook, and Yahoo, and other major telecom providers, tracked citizens' private contacts and social activities recklessly (www.washingtonpost.com, June 7, 2013).

The website of The Washington Post revealed on June 7, 2013, that the NSA and the Federal Bureau of Investigation (FBI) were tapping directly into the central servers of some Internet companies, and users' data, extracting their emails, chats, audio and video data, documents and photos in real time, and putting certain targets and their contacts under full surveillance. According to a government document disclosed by The New York Times on September 29, 2013, the NSA, since November 2010, had been exploiting its huge collections of U.S. citizens' data to identify their associates, their locations at certain times, their traveling companions, and other personal information. The scrutiny program, which links U.S. citizens' phone numbers and e-mails in a "contact chain", exposed large amount of citizens' privacy to the government. The website of the Guardian, a British newspaper, revealed on June 6, 2013, that one of the largest U.S. telecommunications providers, the Verizon Business Network Services Inc, was required to provide to the NSA all the telephony metadata within its system, including telephone numbers, locations and call durations. Germany's Spiegel Online reported on September 7, 2013, that internal NSA documents showed that the U.S. intelligence has the capability of tapping user data from the iphone, devices using Android as well as BlackBerry, a system previously believed to be highly secure. The NSA developed cracking programs and tapped users' data held on the three major smart phone operating systems, including contact lists, SMS traffic, and location information about where a user has been. The NSA is able to infiltrate the computer a person uses to sync their iphone, and the script programs enable additional access to at least 38 iphone features.

The journal.ie reported on June 14, 2013, nine major international civil liberties groups issued joint declaration that the U.S. federal government's secretive scrutiny program, PRISM, is a breach of international conventions on human rights. The joint declaration said, "Such vast and pervasive state surveillance violates two of the most fundamental human rights: the right to privacy and to freedom of expression."

The U.S. federal narcotics officers and other agents, in cooperation with American Telephone & Telegraph, can not only gain access to all the clients' phone records, but also all the phone calls made through the company's telephone exchangers (The Huffington Post, December 20, 2013). The Los Angeles Times' website, www.latimes.com, reported on September 26, 2013, the FBI has long used drone aircraft in domestic investigations, exercising clandestine surveillance over the public. The website also reported, the U.S. federal prosecutors secretly obtained records of telephone calls from more than 20 telephone lines belonging to The Associated Press and its journalists in a two-month period in early 2012 (www.latimes.com, May 13, 2013).

Inmates treated inhumanely in prisons. The use of solitary confinement is prevalent. According to news reports, in U.S. prisons, inmates in solitary confinements are enclosed in cramped cells with poor ventilation and natural lights, isolated from other prisoners, a situation that will take tolls on inmates' physical and mental health (www.bbc.com, June 12, 2013). About 80,000 U.S. prisoners are in solitary confinement, including nearly 12,000 in California. The California's Pelican Bay prison has more than 400 prisoners who have been in isolation for over a decade. In many cases, the inmates are isolated for up to 23 hours per day in cells measuring 3.5 by 2.5 meters (www.reuters.com, August 23, 2013). Some have even been held in solitary confinement for over 40 years(www.cbc.ca, October 4, 2013). In the prison system of the New York state, about 3,800 prisoners are in solitary confinement every day (online.wsj.com, Feb. 19, 2014). The then 49-year-old prisoner, William Blake, had been held in solitary confinement for 26 years, locked in a cell furnished with only one iron bed (www.dailymail.com, March 15, 2013). In 2013, the United Nations Special Rapporteur on torture Juan Mendez repeatedly urged the U.S. government to abolish the use of solitary confinement. He argued, even short-term solitary confinement can be counted as torture (www.bayview.com, October 14, 2013). In California state prisons, 30,000 inmates began hunger strikes on July 8, 2013 in protest of the use of solitary confinement. The hunger strikes lasted two months (www.latimes.com. September 15, 2013).

On January 29, 2014, the British Daily Mail's web edition published New York photographer Scott Houston's photos featuring working and living conditions of inmates in Arizona State's prisons. The images show, inmates are shackled together while working and eating, five on one chain, with just nine feet between them. Houston said, he was left with the impression that the chain gangs working together were similar to the days of slavery. "You could go back 200 years."

Election becomes the game of a few. A great number of researches showed that the American's influence on policy is proportional to their wealth. About 70 percent of the population, who are on the lower wealth and income scale, have virtually no influence on policy whatsoever. They are effectively disenfranchised. Only a tenth of one percent essentially get what they want, i.e. they effectively influence policies (www.salon.com. August 17, 2013). The U.S. citizens get less and less enthusiastic about election. The mayoral election of Los Angeles in May 2013 only had 23.3 percent of the city's registered voters cast a ballot. And the winner got 222,300 votes, just 12.4 percent of the registered voters (www.latimes.com, June 11. 2013).

The checks-and-balances system has become an impediment to actions. On October 1, 2013, the U.S. federal government, except for its core functions, entered a shutdown, after Congress failed to pass the budget bill as the Democrats and Republicans failed to agree on the "Patient Protection and Affordable Care Act." Francis Fukuyama, a senior fellow at Stanford University's Center on Democracy, Development, and the Rule of Law, wrote in an article published on October 4, 2013, on The Washington Post's website, the American system of checks and balances gradually becomes a "vetocracy". "It empowers a wide variety of political players representing minority position to block action by the majority and prevent the government from doing anything." The U.S. government shutdown is the very result of such vicious checks and balances. A new poll found "Americans entered 2014 with a profoundly negative view of their government, expressing little hope that the government can or will solve the nation's biggest problems." According to the poll conducted by the AP-NORC Center for Public Affairs Research, half respondents said American system of democracy needed either "a lot of changes" or a complete overhaul (www. huffingtonpost.com, January 2, 2014). The U.S. president, in his State of the Union Address in January 2014, also criticized the U.S. democratic system full of bickering and debates. "When that debate prevents us from carrying out even the most basic functions of our democracy -- when our differences shut down government or threaten the full faith and credit of the United States -- then we are not doing right by the American people."


III. On Economic and Social Rights

Despite the fact that the economy is recovering, the U.S. citizens' economic and social rights are still under challenge.

Unemployment rates are high in the US. Employment rates for 25-to 54-year-olds were lower in 35 states in fiscal 2013 than in 2007. In 2007, nearly 80 of every 100 people aged 25 to 54 in the United States had a job. In the 12 months ending June 2013, only about 76 of every 100 people in that age group were working (www.pewstates.org, November 27, 2013). According to a report by the CNBC on September 16, 2013, in 2012, the average length of unemployment for U.S. workers reached 39.5 weeks, the highest level since World War II. Rates of unemployment for the lowest-income families topped 21 percent, nearly matching the rate for all workers during the 1930s Great Depression. The overall unemployment rate for U.S. veterans stood at 6.9 percent in October 2013. A total of 246,000 post-9/11 vets are looking for jobs (www.edition.cnn.com, November 11, 2013). According to the 2014 State of the Union, "even in the midst of recovery, too many Americans are working more than ever just to get by... And too many still aren't working at all."

Wealth gap in the US is widening. Statistics released by the U.S. Census Bureau in September 2013 showed more than 47 million U.S. people living in poverty in 2012, and that the poverty rate reached 15 percent. The data also indicated about 6.4 million people aged 65 and older were poor (www.reuters.com, November 6, 2013). New research using the U.S. Internal Revenue Service data from 2012 all the way back to 1913 found that the current gap between America's rich and poor is the widest in history. The richest 1 percent's share of total household income was a record 19.3 percent in 2012. The top 10 percent of U.S. households controlled 50.4 percent of total income in 2012, the highest figures seen since 1917. In the U.S., the top 1 percent saw their incomes recover by 31.4 percent during 2009 and 2012, accounting for 95 percent of the total gain recognized in the U.S., whereas the bottom 99 percent had to content themselves with growth of only 0.4 percent (www.globalpost.com, September 10, 2013). The U.S. 2014 State of the Union noted that average wages in the U.S. have barely budged, and inequality has deepened.

Labor unions see eroding leverage. According to data released by the PEW on April 15, 2013, in 2012, unions lost 400,000 members, and states like Indiana and Wisconsin have clipped the organizing rights of state employees and others. Labor leaders see the largest growth potential in the private sector, however, according to Bureau of Labor Statistics data, only 6.6 percent of private-sector workers belong to a union. On July 18, 2013, the city of Detroit filed for bankruptcy, making it the largest-ever municipal bankruptcy in U.S. history. Despite the objections from unions including the American Federation of State, County and Municipal Employees, the United Auto Workers as well as local retiree associations, a U.S. bankruptcy judge ruled that Detroit is eligible for bankruptcy protection. Representatives of the unions and retirees argued that the decision turned a blind eye to the appeals of the unions. Local citizens took to the streets to protest with anger (www.usatoday.com, December 3, 2013).

Working conditions and pay are declining. On April 18, 2013, a deadly blast at a fertilizer plant in Texas killed 14 people, left 200 others with injuries and caused some toxic gas concern. It was reported that the Occupational Safety and Health Administration, being chronically underfunded, has never inspected the plant since 1985 (www.huffingtonpost.com, June 4, 2013; www.salon.com, May 17, 2013). A report titled "Farm Worker Conditions Likened to Modern Slavery" and carried by the Huffington Post on February 1, 2013 quoted a migrant worker as saying that the piece rate has not changed in over 30 years. The report also said that one farm worker dies on the job every day and hundreds more are injured, noting that relevant authorities have failed to exercise effective monitoring and law enforcement regarding the working conditions for farm workers. The USA Today reported on December 5, 2013 that fast-food workers planned one-day labor walkouts at fast-food restaurants in 100 cities, claiming that they can not survive on a minimum wage of 7.25 dollars per hour, or about 15,000 dollars a year. The campaign was called "Fight for 15"-- pressing for a minimum wage of 15 dollars per hour (www.usatoday.com, December 5, 2013).

Homeless population is growing. A report by the Los Angeles Times on November 22, 2013 said the homeless population in the U.S. had climbed 16 percent from 2011 to 2013. Los Angeles County's homeless population rose 15 percent from 2011 to 2013, to 57,737 people. According to data released by the U.S. Coalition for the Homeless in November 2013, the number of homeless New Yorkers in shelters had risen by more than 71 percent since 2002, and each night more than 60,000 people, including over 22,000 children, experience homelessness.

Social security in the US is problematic. A U.S. Census Bureau report released on September 17, 2013 said that in 2012, a total of 15.4 percent, or some 48 million people in the U.S. were uninsured. The share of people relying on the government for health insurance edged up slightly to 32.6 percent, from 32.2 percent a year ago. Whether they have insurance or not, people spent more on health care in 2012 than in 2011 (www.edition.cnn.com, September 17, 2013). According to the U.S. Federal Funds Information for States, some major programs, including most K-12 educational-support programs; the Low Income Home Energy Assistance Program for the poor; the Special Supplemental Nutrition Program for Women, Infants and Children; Funds to administer the Unemployment Insurance program; Child nutrition programs and other programs starting on or after October 1 could be affected by the federal government shutdown in 2013 (www.pewstates.org, September 26, 2013). When the funds run out on December 28, 2013 for a program created during the recession to supplement the federal emergency benefits for jobless people and efforts to renew the benefits stalled in the U.S. Senate, about 1.3 million jobless Americans who were receiving the benefits averaging about 300 dollars a week had been affected (www.usatoday.com, December 27, 2013).


IV. On Racial Discrimination

Racial discrimination systematically exists in the U.S society. The situation of ethnic minorities' human rights is grim.

Racial discrimination is prevalent in the field of law enforcement and justice. According to a survey carried out in 2012, at least 136 unarmed African-Americans were killed by policemen or security guards in the year (www.un.org, September 3, 2013). Unarmed black youth Jonathan Ferrell, 24, sought help after a car accident, but was shot multiple times and killed by police (New York Daily News, September 16, 2013). Black lady Diggles, 25, was handcuffed and brutally beaten by two white cops for an unpaid fine (www. dailymail.co.uk, June 4, 2013). Racially biased stops and interrogations often occur at streets. The U.S. district judge declared that at least 200,000 stops were made by New York police without reasonable suspicion (www.usatoday.com, August 18, 2013). A latest report released by the American Civil Liberties Union revealed that despite the fact that marijuana use was about the same for both black and white Americans, blacks were four times as likely as whites to be arrested for marijuana possession. One primary reason is that racial bias prevalently exists in the field of justice (www.usatoday.com, June 24, 2013). Similarly, even though data collected have shown that white women use drugs at roughly the same rate as minority women, two-thirds of women in state prisons incarcerated for drug offenses are Hispanic or black (www.humaneexposures.com, December 12, 2013).

In July 2013, protests took place in several cities in the U.S. after a white neighborhood watch volunteer George Zimmerman was not found guilty of murdering black youth Trayvon Martin by gun shot (www.abc.net.au, July 15, 2013). The U.S. civil rights leader Jesse Jackson said that "the American legal system has once again failed justice" (www.bbc.co.uk, July 14, 2013). On September 3, 2013, the Working Group of Experts on Peoples of African Descent with the United Nations Human Rights Council and Special Rapporteur on contemporary forms of racism lodged a joint appeal, asking the American government to reinvestigate into the Martin case as soon as possible and review the laws that may lead to racial discrimination against African-Americans (www.un.org, September 3, 2013).

Racial discrimination is rampant in public places. The Los Angeles Times reported on December 2, 2013, racial and sex discrimination exists in the employment and daily workplaces of the Los Angeles Fire Department. From 2006 to 2010, payouts in Los Angeles Fire Department discrimination and harassment cases cost more than 17 million U.S. dollars. New York Daily News reported on October 26, 2013, black star Rob Brown bought his mom a 1,350 U.S. dollars watch at Macy's, but was suspected of using a fake credit card after being racially profiled by the store. The police handcuffed and detained him for an hour. According to a report by huffingtonpost.com on October 23, 2013, black college student Trayon Christian was buying a 350 U.S. dollars belt at Barneys, but a Barneys sales clerk believed the transaction was fraudulent and called police. Despite showing the officers the receipt for the belt and his ID, he was still handcuffed and taken to a local precinct. Christian's attorney said that "His only crime was being a young black man."

Some mainstream media, social organizations and politicians publicize racist comments. On October 16, 2013, American Broadcasting Company's Jimmy Kimmel Show aired a segment saying "kill everyone in China" and promoted racial hatred. It aroused unease and protests from Asian Americans especially Chinese Americans (www.washingtonpost.com, November 8, 2013). The American Family Association, one of the leading religious right groups, claimed that "Latino voters are greedy and lazy socialist, and that's why they don't vote for Republicans" (www.voiceofrussia.com, March 30, 2013). A white women Colorado lawmaker insinuated, via mentioning barbecue and chicken, poor habits and diets should be considered factors to the life expectancy and diseases of blacks. Her remarks were regarded as having a tendency to racism (www.usatoday.com, August 22, 2013).

Encroachment on indigenous peoples' rights prevalently exists. On February 13, 2013, Anaya, the United Nations Special Rapporteur on the Rights of Indigenous Peoples highlighted high rates of violence against American indigenous women by non-indigenous men. On September 10, Anaya reiterated the obstacles to implementing the law on ensuring Indian children's wellbeing and called on the U.S. government to take all necessary measures to safeguard the human rights of Indian children (www.unsr.jamesanaya.org, February 13, 2013). On September 10, 2013, the Minority Rights Group International accused the U.S. Capital Energy Belize, Ltd of oil exploration in Belize's Maya communities without consent of indigenous peoples (www.minorityrights.org, September 10, 2013).


V. On Women and Children's Rights

Sex discrimination is still serious, and children's rights are not well protected in the United States.

Women are facing serious employment discrimination. According to a report carried by the Los Angeles Times on December 2, 2013, the ratio of women firefighters in the uniformed ranks remains at just under 3 percent -- the same as in 1995. Women's salary is far lower than men's. On average in 2012, women made about 81 percent of the median earnings of male full-time wage and salary workers, according to figures released by the U.S. Bureau of Labor Statistics on March 20, 2013 (www.bls.gov, October 2013). Women's average annual income is 11,500 U.S. dollars less that that of men's. African American women are paid 69 cents for every dollar paid to all men, and Latinas are paid just 58 cents for every dollar paid to all men, according to data from the U.S. Census Bureau's annual survey (www.nationalpartnershipforwomen&families.org, September 17, 2013).

Women and children experienced frequent violent attacks and sexual assaults. In 2013, lawsuits on female suspects being strip-searched were frequently reported. According to a report from the Chicago Tribune on October 10, 2013, several bones were shattered in a woman's face after she was arrested for drunk-driving. She was shoved, beaten and strip-searched by police. Domestic violence is still serious in the U.S.. According to a report by the National Network to End Domestic Violence in 2013, a survey conducted in September 2012 showed in just one 24-hour period, local domestic violence programs across the country provided help and safety to 64,324 domestic violence victims. Sadly, 10,471 requests of domestic violence victims went unmet on that same day due to lack of funds (www.nnedv.org).

U.S. female soldiers experienced frequent sexual harassment and assault. According to the website of the Military Times, 6.1 percent of active duty women say they experienced unwanted sexual contact in 2012 (www.militarytimes.com, May 7, 2013). From 2010 to 2012, there was a 35 percent increase in sexual assault and harassment cases in the military. Fourteen percent of military victims report their assaults and 64 percent of convicted sexual perpetrators were discharged from the military (www.airforcetimes.com, July 23, 2013). Cases of children sexual abuse and exploitation occurred frequently. According to a report on the website of Los Angeles Times on July 29, 2013, the Federal Bureau of Investigation launched a three-day sex-trafficking sweep in 76 cities in July 2013. Some 105 sexually exploited teenagers, some as young as 13, were rescued during the nationwide campaign. Nearly all of them are girls.

Children's security can not be effectively protected. Children's security in family is a prominent problem. According to a report carried by the Chicago Tribune on November 16, 2013, 111 children lost their lives from abuse or neglect in Illinois in 2012, a year of record child deaths from abuse and neglect. The majority died before they were one year old. Nationally, the number of child deaths from abuse and neglect was 1,545. According to a report from the Los Angeles Times on December 18, 2013, child abuse is serious under California's privatized foster care system. The system is so poorly monitored that foster care agencies with a history of abuse can continue caring for children for years. In Los Angeles County, at least four children died as a result of abuse or neglect over the last five years in homes overseen by private agencies. Children have become frequent victims of violent crimes. According to a report carried by the Chicago Tribune on September 15, 2013, all summer long, wounded little children arrived in Chicago's emergency rooms at a pace of about one a week. Victims' parents had this revelation: "We're not safe anywhere!"

Large amount of child labors in agriculture. According to the 2012 childhood agricultural injury survey conducted by the National Institute for Occupational Safety and Health, 41,310 youth under the age of 16 were hired on farms. But a representative from the Children in the Fields Campaign believed there were about 400,000 to 500,000 kids who were working in the fields in 2012. Some types of chores, such as agricultural machine operation and pesticide spraying, have directly threatened children's health, security, or even life (www.usatoday.com, October 25, 2013). Statistics released by the National Children's Center For Rural And Agricultural Health and Safety in December 2013 showed that 38 children were injured in agriculture-related accidents each day in the U.S.. In March, 2013, the National Public Radio and the Public Broadcasting System broadcast in-depth stories about a 14-year-old child who was engulfed by grain and killed while working in a silo in Illinois. And 20 percent of the victims of grain engulfment are young workers (stopchildlabor.org, March 29, 2013).


VI. On Violations of Human Rights against Other Nations

The Untied States is the world's biggest violator of human rights of non-American persons and has been strongly denounced by the international community in cases of the PRISM program, drone strikes, Guantanamo Bay Detention Camp and prisoner torture around the globe.

A large number of overseas surveillance projects conducted by the U.S. violated other countries' sovereignty and the civil rights of their people. State heads and other leaders, diplomatic agencies and citizens of other countries have long been under surveillance of the U.S. National Security Agency (NSA). According to a classified document provided by whistleblower Edward Snowden, the NSA monitored the phone conversations of 35 leaders of other countries and collected five billion pieces of information every day through tracking cell phone movements around the world (www.theguardian.com, October 25, 2013; swampland.time.com, December 4, 2013). In April 2013, the United Nations special rapporteur on the promotion and protection of the rights to freedom of opinion and expression Frank La Rue noted in a report that "the United States renewed the Foreign Intelligence Surveillance Amendment Act of 2008 extending the Government's power to conduct surveillance of non-American persons located outside the United States, including any foreign individual whose communications are hosted by cloud services located in the United States" (UN document A/HRC/23/40). On September 9, 2013, the UN Human Rights Chief Navi Pillay expressed concern about the impact of the U.S. surveillance on the individuals' right to privacy and other human rights during the opening of the 24th session of the UN Human Rights Council in Geneva (www.ohchr.org, September 9, 2013). The UN General Assembly adopted a resolution of protecting the right to privacy in the digital age at its 68th session on December 19, 2013, stressing that unlawful, arbitrary surveillance, interception, and data collection are a breach of the right to privacy and freedom of expression. Some countries condemned the U.S. as a violator of human rights, as well as the UN Charter principles of respect for national sovereignty, territorial integrity and non-interference in internal affairs (www.un.org, December 19, 2013).

Frequent drone strikes by the U.S. have caused a large amount of non-American civilian casualties. According to the Bureau of Investigative Journalism, an independent not-for-profit organization in the UK, the U.S. has carried out 376 drone strikes in Pakistan since 2004, and up to 926 civilians were reported dead (www.reuters.com, October 22, 2013). On May 9, 2013, the Peshawar High Court in Pakistan ruled that the U.S. drone strikes on targets in Pakistan illegally breached national sovereignty and were in "blatant violation of Basic Human Rights" and provisions of the Geneva Conventions, according to the New York-based Open Society Foundations (www.opensocietyfoundations.org, May 28, 2013). On December 12, 2013, a U.S. drone mistakenly targeted a wedding convoy in Yemen's al-Baitha province after intelligence reports identified the vehicles as carrying al Qaeda militants, with 14 people killed and 22 others injured, two Yemeni national security officials told CNN (www.edition.cnn.com, December 13, 2013). In October, the UN special rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism Ben Emmerson, urged the U.S. to disclose more information about its drone programs (www.un.org, October 31, 2013). The UN special rapporteurs on extrajudicial executions and on the protection of human rights while countering terrorism focused on the issue of civilian casualties caused by drone strikes in their reports to the third committee of the UN General Assembly. The U.S. refused to account for those strikes and take measures to reduce civilian casualties as requested by the UN or other government organizations (www.un.org, October 31, 2013).

The U.S. tortures prisoners in other countries and regions. In March 2013, the special rapporteur Ben Emmerson noted in a report that on September 17, 2001, the former U.S. President Bush authorized the Central Intelligence Agency (CIA) to operate a secret detention program which involved the establishment of clandestine detention facilities known as "black sites" on the territory of other states, and allegedly authorized the CIA to carry out "extraordinary renditions." Despite wide criticism against the CIA's illegal action, no American official has so far been brought to justice (UN document A/HRC/22/52). The program saw terror suspects spirited to secret prisons around the globe without legal process, interrogated and sometimes tortured (www.independent.co.uk, February 18, 2013). The Open Society Foundation said at least 136 individuals were reportedly extraordinarily rendered or secretly detained by the CIA (www.opensocietyfoundations.org, February 5, 2013).

Guantanamo Bay detainees' human rights were severely damaged with many of them held there indefinitely without trial. On October 3 2013, the Office of the UN High Commissioner for Human Rights said on its official website the continuing indefinite incarceration of the detainees amounts to arbitrary detention and is in clear breach of international law (www.un.org, October 3, 2013). A total of 92 Guantanamo military prisoners joined in the hunger strike that began in February 2013, to protest indefinite incarceration and bad treatment (www.ohchr.org, October 3, 2013). Force feedings were carried out. Inmates were chained to chairs by Army guars, tubes were inserted through their noses by Navy medical workers (www.upi.com, April 24, 2013). The UN human rights office announced that the force feedings of prisoners at the Guantanamo Bay Detention facility is a breach of international law (www.commondreams.org, May 1, 2013). On October 3, 2013, the special rapporteur on torture noted indefinite incarceration, solitary confinement, force feeding are a breach of international law (www.ohchr.org, October 3, 2013). The UN High Commissioner for Human Rights said in May 2013 that the Guantanamo Bay camp is a typical case of violating human rights while countering terrorism (www.ohchr.org, October 3, 2013).

The U.S. denies the right to subsistence and development of people in developing countries. On October 29, 2013, the 68th session of the UN General Assembly adopted its twenty-second consecutive resolution calling for an end to the U.S. decades-long economic, commercial and financial embargo against Cuba, with a recorded vote of 188 in favor to 2 (the U.S. and Israel) against with 3 abstentions. The General Assembly criticized the U.S. for violating the Cubans' right to subsistence and development (www.ohchr.org, October 29, 2013). The U.S. is indifferent to the right of development of people in developing countries. In September 2013, the twenty-fourth session of the UN Human Rights Council adopted the resolution reaffirming the declaration on the right to development, with a recorded vote of 46 to 1 (the U.S.), with no abstentions (UN document A/68/53/Add.1).

鉴于徐袖珉长期以来顽固推行她的“颜色革命”理念和“舔美仇华”思想,蓄意扰乱人民之友一贯以来的“反对霸权主义,反对种族主义”政治立场,阴谋分化甚至瓦解人民之友推动真正民主改革的思想阵地,人民之友工委会经过长时间的考察和验证,在2020年9月27日会议议决;为了明确人民之友创立以来的政治立场以及贯彻人民之友现阶段以及今后的政治主张,必须将徐袖珉从工委会名单上除名,并在人民之友部落格发出通告,以绝后患。

年轻一辈人民之友有感而作


注:这“漫画新解”是反映一名自诩“智慧高人一等”而且“精于民主理论”的老姐又再突发奇想地运用她所学会的一丁点“颜色革命”理论和伎俩来征服人民之友队伍里的学弟学妹们的心理状态——她在10多年前曾在队伍里因时时表现自己是超群精英,事事都要别人服从她的意愿而人人“惊而远之”,她因此而被挤出队伍近10年之久。

她在三年前被一名年长工委推介,重新加入人民之友队伍。可是,就在今年年初她又再故态复萌,尤其是在3月以来,不断利用部落格的贴文,任意扭曲而胡说八道。起初,还以“不同意见者”的姿态出现,以博取一些不明就里的队友对她的同情和支持,后来,她发现了她的欺骗伎俩无法得逞之后,索性撤下了假面具,对人民之友一贯的“反对霸权主义、反对种族主义”的政治立场,发出歇斯底里的叫嚣,而暴露她设想人民之友“改旗易帜”的真面目!

尤其是在新冠病毒疫情(COVID-19)课题上,她公然猖狂跟人民之友的政治立场对着干,指责人民之友服务于中国文宣或大中华,是 “中国海外统治部”、“中华小红卫兵”等等等等。她甚至通过强硬粗暴手段擅自把我们的WhatsApp群组名称“Sahabat Rakyat Malaysia”改为“吐槽美国样衰俱乐部”这样的无耻行动也做得出来。她的这种种露骨的表现足以说明了她是一名赤裸裸的“反中仇华”份子。

其实,在我们年轻队友看来,这名嘲讽我们“浪费了20年青春”[人民之友成立至今近20年(2001-9-9迄今)]并想要“拯救我们年轻工委”的这位“徐大姐”,她的思想依然停留在20年前的上个世纪。她初始或许是不自觉接受了“西方民主”和“颜色革命”思想的培养,而如今却是自觉地为维护美国的全球霸权统治而与反对美国霸权支配全球的中国人民和全世界各国(包括马来西亚)人民为敌。她是那么狂妄自大,却是多么幼稚可笑啊!

她所说的“你们浪费了20年青春”正好送回给她和她的跟班,让他们把她的这句话吞到自己的肚子里去!
