黄业华@赵明福民主促进会2025-05-25呼吁 民主行动党5名内阁部长(即陆兆福 、哥宾星、倪可敏、沈志强和杨巧双)集体辞去部长职位,向人民谢罪。国内各大媒体竞相作出详尽报道,引起了各族人民的广泛关注,尤其是引起了民主行动党基层党员以及华印社会底层民众的巨大共鸣。

赵明福民主促进会与明福家属不满首相安华多次拒见(他们),而决定在即将来临的元宵节(即阳历2月24日)上午11时正,到行动党的半山芭总部,向陆兆福拜年和探问关于明福命案调查的进展。人民之友工委会2024年2月5日(星期一)发表《5点声明》,表达我们对赵明福冤死不能昭雪事件的严正立场和明确态度。

人民之友工委会根据本身以往对全国大选和州议会选举的论述,结合团结政府成立后的政治形势,决定对新古毛州议席补选,于2024年5月8日发表声明,供新古毛选民5月11日投票以至全国各族人民今后行动的参考。

The 2007 May Day Organizing Committee would like to invite all working men and women from Johor Bahru and southern Johor area to attend a peaceful assembly on the coming 1st May.

The program will start from 10am, at Dataran Bandaraya Johor Bahru. It is not only to celebrate the eight-hour workday that our predecessors had fought for, but also to defend the basic rights that belong to all. The Labour Day Organizing Committee is a non-partisan group consisting of non-government organizations and political parties from the southern region of Johor that are concerned about the well-being of the workers and democracy. The Committee will demonstrate the very tradition and spirit of the Labour Day in Johor Bahru this year.

Since 1994, we have been upholding the tradition and spirit of the Labour Day dated back to 1st of May 1886 by way of holding major assemblies of the working class to put forward their demands. The workers in the United States of America at the time worked for 14-16 hours a day, some even up to 18 hours while merely earning low wages. On 1st of May 1886, workers from the U.S.A. and Canada staged a major strike to force the capitalists to implement the eight-hour workday standard. Despite endless attacks and suppressions from the capitalists and the government, the workers’ perseverance in the struggle eventually won them the eight-hour workday.

The Labour Day is to commemorate the working class of the past who made efforts to fight for basic rights, such as eight-hour workday which had been deprived by the capitalists. This serves to inspire the present and future working men and women to carry on with the spirit and to better the achievement of the predecessors. This is the true tradition and spirit of the Labour Day.

Half a century after we achieved Independence, the well-being of the people should be the priority and the rights of the people should be respected. However, the basic rights of the working class are still being jeopardised. Urban pioneers/settlers, being the low-income group in the urban area, are deprived of the fundamental right of adequate housing, as illustrated in the recent Kg Berembang case where houses were callously demolished. Factory workers are forced to work over-time while the right to unionize is being suppressed by the employers. Prevalent sexual harassment and gender discrimination in work places ceaselessly threaten female workers. Plights of foreign labour being cheated and bullied are widely reported. Privatization policies to be implemented will no doubt further deteriorate the living condition of workers. Hence, May Day Organizing Committee 2007 has made “50 Years of Independence, Workers Remain Enslaved” as the theme of the Labour Day celebration this year.

Presently, the employers make use of the Labour Day vacation to organize carnival-like activities for their employees, in the hope that the workers will eventually forget about the traditional spirit of the day. The capitalists will coerce workers into longer working hours in the name of increasing productivity, thereby causing physical exhaustion and mental depression among workers.

1st of May in the year 1994 was a historic day for workers in Malaysia. More than 3000 people, consisting mostly of estate workers and urban settlers, held a large-scale demonstration at the Merdeka Square. Main organizers of the event included CDC (Central Development Committee), JSPB (Committee of Urban Pioneers Support) and Alaigal (meaning in Tamil – “continuous struggle”), who have been involving themselves in the struggle for equal rights of the oppressed and marginalized groups in our society.

Since then, the celebration has been successfully held on May Day every year. The theme of celebration of each year is shown below:

1994 – Estate Workers and Urban Settlers Are Entitled to Housing Rights; Abolish Forced Eviction
1995 – Estate Community Should Be Included in the Rural Development Plan
1996 – For “Monthly Wage Campaign”
1997 – People Want Justice – Wage, House/Land and Inflation
1998 – Economic Crisis: Employer Are Protected, Workers Are Oppressed
1999 – Malaysian Workers Want Genuine Change
2000 – Workers Want Minimum Wage Act
2001 – A Just Development for All
2002 – Return Us Workers’ Rights: Wage, Job and Union
2003 – Capitalists’ War, Workers in Destitute
2004 – Workers for Genuine Democracy
2005 – Globalization Jeopardizes Workers’ Rights; Stop Privatization of Water and Hospital
2006 – Stop the Privatization of Water Supply and Healthcare Service
2007 – 50 years of Independence, Workers Remain Enslaved

Although the theme of the celebration differs each year, we have been consistent in our principal position, that is, to express the aspirations of workers and to demand for workers’ rights regardless of social circumstances.

The world history of the Labour Day shows that workers’ rights, including the freedom of assembly, were obtained by persistent and unrelenting struggles. Prior to 2003, the Labour Day celebration was carried out without police permit. However, the police took the initiative to grant the celebration an assembly permit in 2003. This shows that the police could have granted the assembly permit without our own application. After years of effort, we have successfully overcome numerous obstacles, including the repression by the authority. There is now new democratic practice of allowing the annual celebration of workers’ day without any permit.

国家独立 50年,工人仍受殖民统治

今年,马来西亚半岛将欢庆独立50周年. 今年,也是国际五一劳动节的第 121周年。然而,我国不同种族、宗教信仰和领域的工人阶级,仍未摆脱殖民统治,尤其在下列几个方面, 工人们还未能享有他们应有的权利:

1. 工人们的劳动成果,

2. 工人们言论与结社自由的权利,

3. 工人们享有福利与和谐生活的权利。


由于当权者妄顾大多数人民的意愿,偏袒资本家和朋党的利益,我们,作为马来西亚发展骨干的劳工阶级,感到被压榨, 生活负担越来越沉重。

国家独立50年來,当政者理应确保国家资源公平分配给各族人民. 然而, 工人阶级依然是一个被边缘化的群体;更令人发指的是,资本家依旧贪得无厌, 不断榨取工人的血汗. 政府执行的是一味偏袒富裕者的新自由主义政策。

在这富有意义的五一劳动节,为了摆脫一切变相殖民统治的政策,我们工人阶级,特此提出下列诉求:

1. 制定《最低薪金法令》,并废除廉价劳工的政策。

2. 签署国际劳工组织的《保障工人权利与福利的公约》 。

3. 自动成立职工会的权利、废除歧视劳工的法令及一些允许资方蓄意解雇劳工的法令。

4. 实行不含种族歧视或性别歧视,但以需求为考量的经济政策。要求一个公平和惠及我国居民的发展模式;任何发展计划,必须经过讨论, 并得到我国居民的同意后才能实行。

5. 所有涉及自由贸易协定(FTA )签署的过程与決定,必须得到人民的同意。

6. 停止强行逼迁城市开拓者, 并尊重他们的居住权利。废除和停止使用《紧急法令》逼迁城市开拓者。所制定的人民房屋政策必须考虑到人民的负担能力,屋价廉宜、地点适中及环境舒适。

7. 确保女性在不受歧视的环境中工作,并制定《防止性骚扰法令》。

8. 给予外籍劳工同等保障,以免他们受到资方、警察、志愿警卫队及移民厅官员不平等对待。

9. 停止影响人民基本福利的私营化计划,如: 水供设备及医疗保健服务等。

10. 废除压迫和歧视人民的法令,尤其是《内安法令》、《官方机密法令》、《大专法令》、《社团法令》及《印刷与出版法令》。

11. 制定《资讯自由法令》。

12. 拨出足够的土地与津贴, 大力发展农业,以确保国内生产量足以应付全国人民的基本粮食需求。避免农业企业化,鼓励农民合作社的推行。

13. 建立一个廉洁、可靠、有效率的政府, 不贪污、不与朋党利益挂勾与不滥权。要求设立一个干净和公正的选举制度,并成立可靠、独立自主及可信赖的选举委员会(SPR )。

属于工人伟大的纪念日 - 五一劳动节

今年 2007年五一劳动节筹备委员会呼吁新山及柔南地区的工友们在五一劳动节当天出席属于我们的和平集会。活动时间由早上十时起,地点在新山大钟楼草场旁。我们不仅仅要捍卫先辈辛苦争取回来的 八小时工作制,而且要争取回属于人民的其他权益。 甫成立的五一委员是由柔南地区关心工人权益、社会民主的数个非政府组织以及政党组成的超越政党组织。今年2007 年五一劳动节筹备委员会将在新山把劳动节最传统的精神呈现出来。

基于秉持五一最传统的精神的使命,从 1994年起,我们也把自 1886年 5月1 日起工人通过大型集会表达立场的行动方式给继承下来。那个时代的 美国,工人们每天要劳动14至16个小时,有的甚至长达18个小时,但工资却很低。1886年5月1日美国和加拿大的工友举行总罢工,迫使资本家实施八小时工作制。当时在罢工工人中流行着一首 " 八小时之歌" ,歌中唱道:" 。。。我们从船坞、车间和工场,召集了我们的队伍,争取八小时工作,八小时休息,八小时归自己!" 虽然遭受到资本家的反击、当权者的镇压,先辈们仍然英勇地斗争,最后争取到现今的八小时工作制。

纪念劳动节最重要的意义,便是庆祝过去工人们艰辛地奋斗,争取回来的种种被资方剥夺的基本权利,例如 八小时工作制 。这是为了鼓舞现在和未来的工人秉持同样的精神,继续捍卫这些先辈们的斗争果实,争取其他属于工人的权益。这是劳动节最传统的精神。

我国独立了半个世纪,人民应该当家作主,权利应被尊重,可是辛勤劳动的工友们的基本权益依然被侵蚀。开拓城市的低收入人民的居住权岌岌可危,例如吉隆坡干榜伯仁邦人民的房屋随时可以被发展商拆除。工厂的工友经常被逼迫加时工作,组织工会争取集体利益的权利率率遭到雇主剥夺。女性的工友在工作场合面对诸多性别歧视以及性骚扰。外籍的劳工被欺骗越洋过来,在这里被欺凌的案件比比皆是。接下来许多的私营化政策无异促使工人们的生活雪上加霜。于是,今年 2007年五一劳动节筹备委员会将劳动节的活动主题设定为:"国家独立 50年,工人依然被殖民"。

纵观现今有些雇主藉着劳动节假日举办消遣与聚餐活动,让工人们逐渐淡忘这个节日的最传统的精神。于是当工人们都不了解劳动节意义时,资本家就会理所当然以提高生产力换取更大的利益下,催促工人每日工作超出八小时,而造成工人们不仅体力劳累而且精神与心理上的不平衡。这也是资本家们最乐意见到的结果。

1994 年5月 1日是历史性的一天。大约 3000名以园丘工友和城市开拓者为主的人民在独立广场举行了规模盛大的示威。主要促成单位包括 CDC(社群发展中心)、JSPB (城市开拓者支援委员会)、ALAIGAL (不断斗争)都是长期和被压迫、被边缘化社会群体共同争取权益的草根性非政府组织。起初,提出举行大型集会的固然是非政府组织,实际上顾虑最多的也是这些人士。后来,反而人民更加坚持以示威的方式来提出人民的劳动节诉求。当天早上十点,来自四面八方的群众聚集在首都独立广场。纵然警方多次尝试阻扰,但是这项和平集会依然进行了长达一个小时半的示威活动。

之后这项活动都成功地在每一年五一进行。每年的主题如一下所示:

1994 - 园丘工友与城市开拓者应该享有居住权;废除强硬逼迁行动

1995 - 将园丘社群纳入郊区发展计划

1996 – 支持"月薪运动"

1997 - 人民要求公正 – 薪金、房屋 /土地以及通货膨胀

1998 - 经济危机:雇主被庇护,工人被压迫

1999 - 马来西亚工人争取真正的改变

2000 - 工人争取最低薪金法

2001 - 为全民的公平发展

2002 - 归还工人的权利: 薪金、工作、工会

2003 – 资本家的战争,工人水深火热

2004 – 工人争取真正的民主

2005 – 全球化侵蚀工人的权利;停止水供和医院私营化

2006 – 停止水供服务和医疗服务私营化

2007 – 国家独立50年,工人依然被殖民

虽然每一年的活动主题不同,但是我们都贯穿相同的基本立场,即无论社会面临什么变化,我们坚持表达工人的心声,我们工人要求应该得到的属于工人的权利。第一次成立五一劳动节筹备委员会是在 1998年。当年的劳动节活动是由数个非政府组织以及国会反对党联合成立的 1998年五一劳动节筹备委员会举办。是年的活动在室内的雪兰莪中华大会堂井井有条地举行,超过 1500人出席。

全世界五一的历史证明了工人的每一项权利都要经过不断地艰辛的争取回来的,包括集会自由的人权。 2003年以前,我们整十年来的五一活动,不曾申请过集会准证。但是 2003年警察部队主动给与集会准证。由此证明了不必申请之下,警察是可以给与集会准证的。比起往年, 2003年这回人民获得了优待。警方礼貌地协助人们的巴士到场。事先得到五一劳动节筹备委员的认同后,镇暴队留驻于远处。人民再度将集会地点从新移到独立广场,只是气氛平静许多。经过这么多年的努力,我们终于成功地克服重重困难,包括有关当局的镇压,最后打开一个允许人民继续举办这类集会活动的民主空间。

前言

维護达教育的运动是華社爭取世界公认的基本人权母语教育的运动。这场运动历时超过半个世纪. 由于它是一场群众运动, 所以它历久不衰.

华教运动发展中所产生问题应广泛征询意见, 尽可能通过集思广意, 让華族社群公开讨论。

2007226日,《星洲日报》头版, 头条新闻报道董总前主席郭全强的专访。在专访中郭先生表示,董教总应主动与身为主要执政党—巫统见面,以消除彼此间的[误会]”接着, 星洲日报用了四大版报道了教育部长,希沙慕丁的专访, 发表似乎对華教有利的言论. 接踵而來的, 就是执政党內的马華要员, 也发表了相关言论.

自此以后, 各类大众媒体也陸续表了一些评论文章。这些文章对上述言论作了深入淺出的分析, 确实值得一读.

人民之声(新山支会)谴责日前日本首相安倍晋三否认日本政府在二战期间曾强征慰安妇的言论

人民之声表示,日本必须向德国看齐,以真诚的忏悔和具体的行动,才能弥补过去所犯下的罪行。我们认为,安倍否认慰安妇被强迫的言论,与日本政府过去篡改历史教科书、参拜靖国神社等等做法是同出一辙。这些做法都是毫无忏悔之意,不愿正视过去历史上所犯下的过错。

&nb sp; 人民之声表示,二战期间被日军强迫充当慰安妇的女性,其人权受到了严重地侵犯。他们都是无辜,被迫充当军妓。否认慰安妇受日军强迫,是对亚洲各国多达20万名慰安妇的极大侮辱。许多受害者依然尚在人间,他们的血泪控诉,就是铁一般的证据。日本政府必须对这项错误 0340;言论,做出慎重的道歉。

人民之声表示,日军在二战期间俘虏女性迫充当慰安妇,是一项不容争辩的事实。单在马来西亚,几乎所有日军驻扎的地点,都设有“慰安所”。这些慰安所遍布全马,如:新山、芙蓉、吉隆坡、太平等各地。日军在这些受害者以及家属身上留下一辈子都无法磨灭的伤痕。无数的慰安& #22919;承担着沉重的心理压力,而不愿公开自己的姓名和遭遇

在妇女节来临之际,日本首相的言论令人感到万分遗憾。我们呼吁日本政府应该在妇女节来临之际,让这些过去受到残暴对待的慰安妇得到一个合理的交代,而不是一再发表扭曲历史事实的言论,令她们受到第二度伤害。

最后,人民之声希望大家在欢庆妇女节期间,不要忘记还有一群广大的慰妇女,至今依旧没获得适当的对待。若她们一息尚存之前,无法获得应有的对待,这将会是她们生命中最大的遗憾。故此,我们吁请各界人士,尤其是人权组织和各大社团的妇女组织,认真看待这项问题。另 2806;,日本必须政府拿出承担错误的勇气,才能抹去这些历史上的污点。


推介首份州属人权报告 — 柔佛州人民之 友工委会发表《2006 年柔佛州 人权报告》

大马人民之声(新山支会)于2006年1 月21日,在新山人民之友联络所(JH1),举行"2006年马来西亚人权状况"交流会上,推介 柔佛州人民之友工委会发表的首份《2006年柔佛州人权报告书》。

《2006年柔佛州人权 报告书》是大马有史以来的第一本州属人权报告。自1995年,大马人民之声每年都会在世界人权日当天发表《马来西亚公民与政治权利报告书概述》,而今年除了该报告书概述以外,人民之声也在柔佛州人民之友工委会的努力下,破天荒完成了首份柔佛州人权报告。

《报告书》可被誉为检验州政府在维护和保障人民的基本权利(人权)的"年中成绩单"。而以违反人权的案例做为检验的标准,正可以评估现在的执政者是否称职。

《2006年柔佛州人权 报告书》是依据2006年全年与人权相关的新闻报导,和人民之声所接获的违反人权事件的投诉,而撰写的报告。《报告书》里共概括了 9个章节,包括无审讯扣留、警察滥权事件、社会治安不宁、言论与集会自由、地方议会政府、居住与环境权利、宗教自由、母语教育权利和难民、寻求批护者与无证件移民。

《2006年柔佛州人权 报告书》是由柔佛州人民之友工委会主席罗明亮和数位委员包括杨培根律师、执行秘书郑文辉、钟立薇、李建杰、黄智能、吴振宇、谢映红和徐秀敏,在交流会上发表和汇报。

2006年柔佛州人权报告(序言)

柔佛州人民之友工委会于2007年1月21日发表了《2006年柔佛州人权报告》。以下是该报告书的序言,请开启贴上的文件以阅读全文。

2006年终,柔佛州发生了历年来最严重的大水灾,使不少人陷入水乡之中,造成的损失更是难以被估计。在面对严重水患时,柔佛州政府显得措手不及,各种救援工作和行动都无法在第一时间被启动,这赤裸裸的显露出他们应对灾难时的智慧和应变能力,都处于坐以待毙的情况!救灾行动无法制止各种流言,也显示出政府的公信力备受考验,这也是政府作业和资讯不透明化的后遗症。

2006年依然困扰柔佛州人民的大事是,社会治安不宁的问题。居住在柔佛州的人民无不人人自危,无论在家中、出外或上班,都战战兢兢担心自己和家人成为匪徒的目标。在民间更有人自讽说,"没有被匪徒抢过的人,不算是新山人!"虽然治安问题所造成的财物损失和人命的伤亡已敲响了警钟,但是执政者和警方依旧无法提出一套有效恢复社会治安的解决方案。

警察滥权的事件,在这一年里还是层出不穷。今年死于柔佛州警察拘留所的案件共有两宗,这些案件都还没有召开验尸庭调查死亡原因。另外,警察涉及使用不当的暴力手段对付民众和发生警察贪污滥权的案件,使民众对警方失去信心。

位于新邦令金的扣留营更是柔佛州人权记事本的污点。该扣留营中扣押了许多不经审讯的被扣留者。马来西亚政府曾批评美国在关塔摩湾监狱(Guantanamo Bay)进行无审讯的扣押,然而在马来西亚国土上,政府依然利用《内安法令》、《紧急法令》和《危险毒品法令》剥夺国人获得公平审讯的权利。

除了现有法令依然钳制公众的言论和集会的自由,公众人士也面对来自执政党和反对党及一些民间极端分子的打压。

另一项关系全柔人民的议题是,地方议会政府的行政及作业不透明化。不少例子显示,身为"父母官"的县市议员,不但无法为民众解决民生问题,反而时常成为问题的制造者。这也可以追索到县市议员并非通过民主选举制度被遴选和委任。

没有对居住和大自然环境保护工作做出妥善的规划和执法,也在困扰着我们日常生活。最好的写照莫过于,非法埋毒废料事件、自来水不清洁和最近发生的大水灾。

宗教间的包容和互相尊重,也在这一年内受到严峻的考验。宗教膜拜场所在缺乏沟通和安排下被拆毁,更使雪上加霜,增加彼此间的猜疑。

国民型学校面对不公平对待,已是屡见不鲜的事实。无论从常年资源分配、拨款、学校增建或教师职员数量不足等等老问题,依旧没有从根本性的解决。

难民、寻求庇护者与无证件移民依然是遭到严重剥夺人权的被边缘化群体。无论是在工作上、生活环境或人生安全,他们都是没有受到保障的一群。

执政者需对柔南大水灾负上责任

大马人民之声(新山支会)对于柔佛州连续发生两次大水灾表示非常遗憾。我们认为,身为执政的政府需要给与人民一个满意的答复,向人民解释为何柔佛州无法避免一而再的面临水灾的危害,而不是将责任推卸为"天意"!

首先,柔佛州政府需要向人民交代,为何在每一年无论中央和州政府都拨出巨款治理水利和防洪,然而只因一次的气象转变,季候风将豪雨降落在柔佛州境内,却使人民连续两次遭到严重水灾的危害?况且在平时,许多现在严重水灾的地区,也不时发生闪电水灾,只是情况不比现在严重和在同样时间发生,而得不到关注。政府是否有将人民交付的血汗税收,用在适当的地方?

第二,为什么不论是否在灾区,柔佛州境内的道路和桥梁都不堪雨水的一击,纷纷不时发生泥土崩塌就是地陷?马来西亚本来就是多雨水的国家,为何当局在修建道路和桥梁时,并没有将这因素考虑在内?而到现在只简单的将问题归咎于天灾。到处可见,始而复终都有修补不好的道路和填补不完的坑洞?一笔笔巨大的款项,也一并被雨水冲走。

第三,政府在批准和进行所谓惠及全民的发展计划,和具有高度�shy;济利益的高�shy;和�shy;林开发时,是否有作出防范天灾的长远规划?无可否认的,许多发生严重水患的地区都是高度被开发的地区。人民还没有享受到所谓�shy;济发展的好处,却被迫付出难以估计的代价!

第四,政府需要具有透明度的将灾情讯息和造成水灾的真正�shy;因公诸于世。政府不应该在严重讯息不流通时,任由谣言满天飞,和将导致水灾的�shy;因仅仅归咎于雨量过多,而没有对自己的失责进行检讨!更离谱的是,政府并有在发生灾害后思考要如何避免再次发生同样的不幸,而是沾沾自喜的强调"我们下次会做得更好"。

第五,身为人民父母官的县市议会,为何无法做到未雨绸缪的准备?所谓"天有不测风云,人有旦夕祸福",灾害总不会在未来临前预先警告,平时不懂得居安思危的县市议员,在这次灾害中,赤裸裸的显露出他们应对灾难时的智慧和应变能力,都处于坐以待毙的情况!

总的而言,人民之声认为身为执政的政府官员们需要为这次的柔南大水灾负上最大的责任。并且为所有有可能发生的灾害做好万全的准备,所谓"多一份准备,就少一份灾害"。为了让人民进一步监督政府的作业,恢复地方议会选举更是刻不容缓,好让人民从执政的最小单位敦促政府。

2006年柔佛州人权报告

无审讯扣留

2006年,我国政府继续援引《内安法令》、《紧急法令》和《危险毒品法令》,剥夺我国人民获得公平审讯的权利。位于柔佛州的新邦令金扣留营便实施《紧急法令》和《危险毒品法令》审讯扣留的扣留营。

根据大马人民之声所获得的数据,至今仍然有超过700人在《紧急法令》下,无审讯扣留在新邦令金扣留营由于政府所提供的官方数字前后矛盾,究竟情況是否有所改善或已恶化,则很难下结论。同时,政府也没有公布2006年还在《危险毒品法令》下被扣留者的数字。

政府在国会透露, 2005年,共有2530人在《危险毒品法令》下被拘捕; 1260人被无审讯扣留; 99人被释放和1171人的扣留令被延长。根据柔佛州扫毒组总监透露,2005年柔佛州共有1130人在《危险毒品法令》下被拘捕。另外有5人者则被怀疑涉及贩卖毒品, 和一位迪斯科业主先在《危险毒品法令》下扣留,然后《紧急法令》下被无审讯扣押在新邦令金扣留营

200512月,更有一位无审讯扣留者S.亨利S.Henry)被关进新邦令金扣留营数小时后,被发现悬梁自尽。国家人权委员会曾为此事召开验尸庭听证会。但是, 国家人权委员会调查无法肯定: 是无限期的无审讯扣留,导致死者自寻短见。

警察滥权事件

虽然警察部队领导人不断提出口头承诺, 要整顿警察部队和制止警察滥用权力,可是纵观过去一年的纪录,警察滥权的情况依然没有改善。

今年3月,在士古来警察局内发生了一宗警察拘留期间死亡案件。现年27岁的萨拉华南(Sarawanan Meyalagan警察扣留3天后,死于拘留所内。虽然,死者的家属和人民之声已数次提出, 要求进行死亡调查的验尸庭审讯,但是有关方面至今没有做出任何回应。

2006年岁末(1230日),昔加末巫罗加什警察局扣留所内,有一名涉嫌拥毒女嫌犯——现年24岁的丽札娜——据称, 攀上警局扣留室一道6尺高的铁栏跃下, 送往医院途中身亡。警方只是将这起扣留所内死亡案件简单列为自杀案处理。不过,死者的丈夫并不相信妻子会自杀。

2006年发生的警察滥权事件,更是层出不穷。124日,两名年龄只有13岁的少年,在律师的陪同下召开记者会,申述他们被昔加末警方拘捕. 协助调查爆窃案期间,被警察掌掴、拳打、脚踢、电击、以警枪指头威胁,进行逼供

今年2月,一名印裔船厂技工, 好奇探问一起交通事故的发生经过,却被值勤的交通警察殴打致左手臂断裂。在他拒绝跟随警方到警察局后,该交通警察更对他拳打脚踢。过后, 他遭警方以“侮辱执法人员”罪名扣留。

7月间,数名拥有“退伍警员俱乐部”证件的冒充警员,在网络咖啡座殴打和导致一名青年遍体鳞伤。[? 这不能把帐记在警察身上]

10月间,一名拖车员偕妻子追查拖欠金融公司轿车时,疑激怒自称为“武吉安曼”的男警员,结果拖车员妻子被抢走手提袋及手机。事后,男子竟声称遭勒,以致拖车员遭警方拘捕及提控,有关男子却逍遥法外。[? 这是不是警察干的]

同月,一名手机代理公司职员在载送大批新款手机途中,遭5名便衣警员持枪拦截,并被扣押上车“游车河”2小时. 其间700多台手机不翼而飞。在他前往报案时,他被命令接受尿液检验。过后,被警方扣留7小时之久,而且都是被警方用手铐反扣。

根据公众人士申诉,2006年在柔佛州也发生了不少宗警察赂的事件。今年3月间,3名自称警务人员的男女,以恐吓、误导性手法向民众募捐。 他们声称, 该名来自振林山五间店黄姓手机零售与维修商人,售卖假货,索取750令吉,作为协助“解决问题”的费用。在多次追问下,他们才表示, 这笔款项是广告费, 在马来西亚退伍警察协会出版的特刊上, 刊登广告。

7月,一名从事资源回收业务的妇女申诉,多次遭便衣刑警上门勒索。她所雇用的4名持有合法签证的缅甸裔员工,及作业的小型罗里,也因为她无法交付该警员所索取2千元,被警方“扣留”。

同月,3名男子自称是关税局执法人员,以怀疑走私为由,截停一名华裔男子的罗里,“充公”该名男子的手机及300令吉现款,并殴打当事人和将他推倒在地。[?这不是警察所为]

根据2006年柔佛州立法议会的新闻报导,在过去10年(1996 - 2006),柔佛州境内的大马皇家警察部队,共有24人因涉及贪污案件而遭反贪污局调查。

社会治安不宁

2006年,柔佛州治安不宁的问题已敲响了警钟,并引起了民怨沸腾。攫夺匪横行、白天夜晚破门行窃、绑架勒索、连环抢劫等等,无不一一显示警方和执政者无法保障人民能在安居乐业的情况下生活。新山更被邻国新加坡比喻为“犯罪之城”,向该国旅客提出劝告. 然而, 执政者和警方,只一味的否认和出示所谓破案率高的数据,企图掩盖自己的无能,并无法让人信服。

根据首相兼内部长在国会回答提问时, 指出,柔佛州2006年首7个月的犯罪率高达19004宗,与去年同期相比增加了2577宗。于8月上任的柔佛州警察总长表示,警方将通过4项策略,分别以警员巡逻、全面监控罪案黑区(设置闭路电视)、警察之友及加强警民合作关系,打击罪案。

攫夺匪在新山横行,更是到了人人自危的地步。420日,从亚罗士打到新山公干的张诗玲(24岁),在新山丽雅花园前方路段遭攫夺后,伤重毙命;724日,一名妇女苏哈娜(35岁)驱车接送两名孩子回家,在抵达家门时,遭一名匪徒以刀砍向颈部,不幸身亡;

811日,现年18岁的程素妗从柏伶花园住家,步行到淡杯柏伶娱家城上班途中被攫夺,并遭攫匪以利刀砍伤后颈,导致后脑着地当场毙命;此案件引起全国人民的关注,但是警方却指责媒体不应对此案件作出诸多的猜测,并在案发现场,扣留了一名报馆摄影记者的记者证;警方也在现场“扣押”两名向记者投诉治安问题的居民问话。

823日,新山攫夺匪将书记吴宝仪拖拉大约20尺,导致脊椎受伤;111日,一对巫裔夫妇共乘电单车至新山地不佬大道8公里处,遭2名电单车匪攫夺。夫妇俩的电单车被踢翻撞柱,丈夫哈利送院后,重伤不治。其余被攫夺案件,所造成的受伤和财务损失,更是数不胜数。

清早出门派报的派报员,更成了攫夺匪下手干案的受害者。711日,柔佛州新山派报同业公会召开记者会表示,为保护派报人不至于频遭匪徒攻击和抢夺,公会已议决: 会员不会在凌晨时分派报纸,而选择在安全时段工作。

71日,一名70岁高龄的刘姓派报员,在新山百万镇被歹徒拦路包围,企图抢劫。这已是刘老从今年5月至今,第三次被歹徒拦劫。811日,麻坡杨氏(42岁)派报员成了劫匪的目标. 数天后(18日),不幸再次遭匪徒打抢。同月15日,新山古姓(53岁)派报员清晨骑电单车, 准备领取当天报纸时,在路上遭5名匪徒以钢盔猛击头部,翻在马路上, 腰包被抢走。

74日,一名金商偕女儿及员工,从银行提出20万令吉钜款,在大马花园交通灯处,遭4名匪徒拦截被抢. 75日,3名枪匪假扮传销商,混入位于新山彩虹花园的传销公司产品说明会中,抢走约80名传销商超过10万令吉的财物。

除此以外,在柔佛州内也发生了数宗银行提款机连环遭盗走的案件. 有关的劫提款机案件, 先后发生在新山柔佛再也花园(724日凌晨)、新山百万镇(724日上午7时)、新山百合花园(728日凌晨)、居銮大洋园(84日凌晨)。816日更发生了匪徒持巴冷, 刺伤当值警员,还夺走巡逻警车。99日,5名刀匪横行新山,在深夜连环抢劫6间油站。12月间,新山区频频发生手机店被打劫案件,使业者蒙受财务损失. 更被匪徒拳打脚踢,蒙受肉体上的创伤。

除了劫匪横行以外,在过去的一年里柔佛州也发生了不少宗劫杀、弃尸案。829日,新山南警区主任证实, 吗晒油棕园发现女焦尸, 警方把它列为谋杀. 天,一名青年疑遭砍死, 焚烧,弃尸古来义山. , 一名印尼华人何金峰(译音)在古来疑遭劫杀。

2006年在柔佛州内,也发生了数宗商人遭绑劫勒索案件。126日,一名板厂东主在新山地不佬工业区,遭匪车掳走。111日,3名蒙面匪, 持短枪和短刀,在峇株巴辖一所私人住宅前,掳绑一名商人的幼子。126日,一名新加坡商人在士乃工厂巡视业务时,遭4名匪徒绑架,在古来一处, 禁锢4天。

面对居民对警方的指责,警察最好的开脱就是: 警员人手不足; 以警方现有的人力与物力无法照顾极大的范围; 警官的工作量太, 导致警官旷工失责事件。执政成员党也乐于和警方一唱一和,“积极”举办无法治本的“警民对话会”、成立夜间巡逻队、成立自卫警报网等等。

诚然,罪案并没有因此而减少。最讽刺的是,于9月初成立的新山马青先锋反犯罪案小组进行“夜间巡逻行动”. 攫夺匪徒模仿他们, 穿上反光背, 进行干案。马青迫不得已, 澄清. 小组才展开不到两周的巡逻, 已停止活动

言论与集会自由

今年46月间,由柔佛州14个政党及非政府组织组成的“柔佛州人民反对燃料涨价联盟”,在柔佛州, 8个县通过群众演说大会和街头表演方式,表达对政府调高燃料价格的不满,将反对燃料涨价的讯息广泛地传达给民众。

722日, 11条款联盟在新山一家酒店举办第4场“联邦宪法维护全民权益”座谈会,遭到数百名示威者干扰和破坏. 在警方的要求下,座谈会被迫提早结束。柔佛州巫统青年团及回教党青年团, 双双要求警方及宗教局, 阻止该座谈会的举办。一场合法的座谈会, 在一群破坏分子威吓下, 被迫草草结束. 警方本应维護宪法保障下的基本人权 宗教自由, 确保座谈会的顺利进行.

113日,超过50名工大生连同社会人士,聚集在新山顺利花园玛珠街(俗称报馆街)举行和平请愿. 他们当街表演简短的话剧,嘲讽媒体被垄断所带来的恶果。反对媒体被垄断和平集会,是在面对警方人员不断干扰及阻止中,坚持进行整个活动。

地方议会

1967年起停止的地方议会选举,至今仍然还没有恢复。县市议员的委任,就成了执政党安插亲信,掌握政治资源的管道。2006年岁末(1228日及31日),柔佛州新邦令金范围内马华公会支会, 接二连三召开记者会,炮轰该党柔佛州联委会, 推荐县市议员, 排除异己。他们指出,当地的县市议员的遴选“由数人操纵,采取独裁、偏袒与霸道手段”。这进一步证,必须恢复地方议会选举,人民选出县市议员。

除了发生遴选县市议员的风波外,由于被委任的县市议员不需面对选民的裁决,县市议会往往都在进行黑箱. 一些本来属于县市议员的工作,如解决路灯、马路安全、沟渠阻塞等民生问题,现在则需“劳动”国州议员甚至部长级人物出面,才能解决。州内的部分地方政府, 不但没有协助民众解决问题,反而成为问题的制造者,为民众带来不便。

今年2月上任的新山市长,走马上任第二天就带着市政局官员巡视市区,表示将着手改善新山市民最不满的三大问题:水沟堵塞、马路坑洞和垃圾处处。他也表示,今年新山市政局将会增加拨款至1千万令吉, 兴建与维修道路。同月,新山市政局也宣布将拨出650万令吉, 进行提升道路与排水系统工程,以解决市中心闪电水患与交通阻塞问题. 预期工程可以在12月间完成。

今年10, 新山市长已擢升为柔佛州秘书. 续任的新市长, 也表示其首要任务就是, 要解决新山中心逢雨成灾问题. 然而,新山市至今仍然还没摆脱水患与交通阻塞的问题,反而变本加厉。

11月,新山中区市议会进行水沟提升工程,造成沟渠崩裂,殃及民宅厨房倒塌。然而,到现场视察和给予协助的,是反对党领袖和该区州议员。事后,市议会也没有表示, 是否会对这起疏忽事件做出赔偿。

柔佛州政府规定,饮食业者在申请更新营业执照前,必须先安装过滤器, 处理食物残渣。这项政策的出发点是, 为了避免河流进一步受到污染。然而,新山中区市议会却强制当地饮食业者, 只能与市议会“认可”的5家承包商合作, 更换油槽过滤器。每台过滤器的价格, 比市价高出一倍。有人揭发,5家承包商, 其中一家, 公司性质處于 “冬眠”(dormant狀态; 另一家公司, 地址竟然是一所戒毒中心; 另一家公司, 商业注册不但提供营业性质,公司地址都沒有 这些怪现象, 引起业者的不满和争议。

在这一年里, 古来区淹水也是司空见惯的事情。政府在过去的10年内,共进行了3次大型治水工程。单单在过去2年内,就耗资了150万令吉来推行古来区治水工程。可是每逢大雨时,古来21哩多个花园住宅区却变成了泽国。市议会的治水工程,并不能妥善解决水灾问题. 没有任何地方政府官员, 因失责而需要负起责任。水利灌溉局全国总监这种现象, 归咎于房屋发展迅速。

2005年未,昔加末县议会公布提高33163戶人家的产业税,经提高后的产业税,引起不少民众的反弹。截至今年1月,县议会共接获4944份上诉信。413日,昔加末中华公会,发动签名运动,号召市民反对县议会该项不合理的产业税调整。18日,利民达的一些村民高举大字报和拉布条,抗议县议会的产业税重估, 出现不公平和暴涨的现象。他们表示,县议会的这项调整,将木屋及廉价房屋的产业税调高,却降低高级住宅区的产业税。经过10个月的重估后,直至1129日,昔加末县议会才公布

大马人民之声(新山支会)订于上述日期,时间和地点,举行" 2006年马来西亚人权状况"交流会。在交流会上,我们將推介大马人民之声发表的2006年马来西亚公民与政治权利报告书概述》和柔佛州人民之友工委会发表2006年柔佛州人权报告书》。


2006年间,马来西亚的人权状况有改变吗?在首相阿都拉主政的第三个年头里,并没履行他上任时的承诺,即:改善公民自由权利,对付贪污及重整警察部队的承诺。令人感到担忧的是,越来越多偏激狭隘、煽动种族情绪和具有法西斯主义倾向的言论陆续出现。限制公众言论自由的举措逐渐加强,媒体业更出现垄断又集中的现象。


今年,人民之声首次发表了《 2006年柔佛州人权报告书》,目的是为了让柔佛州居民了解本州的人权状况。《报告书》检验了过去的一年里,柔佛州到底发生了哪一些违反人权的事件。

2006年柔佛州人权报告书》里共概括了9个章节,包括无审讯扣留、警察滥权事件、社会治安不宁、言论与集会自由、地方议会政府、居住与环境权利、宗教自由、母语教育权利和难民、寻求批护者与无证件移民。


本会借此机会 ,邀请大家前来参加这个意义深远的人权活动,并希望大家共同为推动我国人权事业的发展而作出努力。

PREAMBLE

1. Acknowledging the impact of changing geopolitical realities in the present global order on a multi-cultural country like Malaysia and recognising the diversity of situations, experiences and perceptions in our context, we believe that there is a common basis for the protection of human rights.

2. Human rights are the foundation of the holistic well-being of all humans in all spiritual, moral, mental, physical and social aspects. With these rights come the responsibility to protect and respect the well-being of other individuals and communities in society, as well as to ensure a harmonious relationship between humankind and the natural environment.

3. In a developing country like Malaysia, recognition and respect of the right to political, social, cultural and economic self-determination of all peoples are fundamental to the protection of our dignity and equality; and to justice, peace and freedom in our country.

4. The promotion of human rights is indivisible to the pursuit of a holistic and just development. We believe that all forms of expression and choices about the processes of economic development in this country must be respected.

5. We note that the Malaysian government has not ratified the International Covenant on Economic, Social and Cultural Rights and the International Covenant on Civil and Political Rights. In addition, other United Nations Conventions such as the Convention Against Torture, the Convention on the Elimination of All Forms of Racial Discrimination, the Convention on the Elimination of All Forms of Discrimination Against Women, and the United Nations Convention on the Rights of the Child, have not been ratified as well. We strongly believe that the ratification, and effective implementation, of these standards is vital to the promotion of human rights in Malaysia, and urge the Government to do so immediately.

Article 1 - Universality

1. Human rights are universal. Universal human rights standards are rooted in our many and rich cultures. Human rights are universal in value and are of universal concern.

2. Human rights afford protection to all of humanity, including special groups such as children, minorities and indigenous peoples, workers, refugees and displaced persons, people with disabilities and the elderly.

3. Whilst we recognise and advocate cultural pluralism, those cultural practices which derogate from universally accepted human rights must not be tolerated.

Article 2 - Indivisibility

1. Human rights, be they economic, social, cultural, civil and political rights, are indivisible and interdependent. The protection of economic, social and cultural rights requires full respect by governments for the exercise by peoples of their civil and political rights.

2. Poverty denies people much of their basic economic and social rights. However, the poor must never be denied their right to speak, to organize, and to exercise their right to participate in decision-making in the development process on the grounds that they must first be fed, housed and educated.

3. We affirm that one set of rights can never be used to bargain for another set of rights.

Article 3 - Women's Rights as Human Rights

1. Women's rights are human rights. Women's rights must be addressed in both the public and private spheres of society, in particular the family.

2. The patriarchal system is manifest in all institutions, attitudes, social norms and values in our society. It takes many forms and cuts across class, culture, caste and ethnicity. It must be eradicated.

3. All forms of discrimination against women are to be eliminated.

4. Violence against women is one of the main instruments by which patriarchy perpetuates itself, and thereby the subjugation, oppression and exploitation of women.

Violence against women is a violation of women's basic human rights and must be eradicated if there is to be social justice and equity.

Violations of women's human rights are not simply individual acts of violence.

Within all areas of human rights - whether civil, political, economic or social - human rights violations against women take specific forms. Entrenched structures and practices such as caste, customary law, the family, and religion continue to discriminate against women.

Economic and social institutions which are exploitative oppress women, and legal institutions which claim to dispense equal justice are in fact gender biased.

5. To provide women a life with dignity and self-determination, women must be guaranteed inalienable equal economic, social, political and religious rights.

Article 4 - Development

1. The right to holistic development is a basic human right. In order to attain socially equitable and environmentally sustainable development, there must be respect for civil and political rights as well as social, cultural and economic self-determination of all people.

People's participation in the development process is essential to ensure that development is socially just and culturally appropriate.

2. Human development is dependent on resources provided by our natural environment.

The protection and the sustainable use of these resources is integral to the well-being and survival of all peoples, in particular those communities that live in close harmony with their environment, and for future generations.

3. Our models of economic development need to be recast in recognition of the fragility of the present ecological crisis and the growing inequities of the present economic systems.

Alternative development frameworks need to be constructed using culturally and socially appropriate models, drawing from, in particular, the experiences of the indigenous communities of our country.

Article 5 - Democracy

1. True democracy cannot be separated from holistic development. Each is essential for the attainment of the other.

2. Democracy is more than the ritual casting of a ballot once every few' years. True democracy involves ongoing participation by the people at all levels so that the people can determine their political status and freely pursue their economic, social, cultural and spiritual development.

3. Participatory democracy must permeate all levels of human living the home, the workplace, the local community and the nation.

Article 6 - Development and the world order

1. The present world order allows the arbitrary control and domination of development by the powerful in the North, abetted by elites in the South. This gross injustice perpetrates vast social and economic disparities both globally and nationally and denies individuals and communities the right to social, cultural and economic self-determination.

2. The development process at the international level must also be guided by the same principles of participatory democracy, equity and justice.

3. The United Nations must be democratised through the abolition of the veto and permanent membership of the Security Council, and an enhancement of the powers of the General Assembly.

4. The external debt of the chronically poor nations of the South aggravates poverty and thus violates the human rights of their peoples. These debts should be written off. Other debtor nations of the South should be allowed to reschedule their debts and not be further burdened by structural adjustment policies.

5. The present policies of the Group of Seven and North-dominated institutions such as the International Monetary Fund, the World Bank, and the General Agreement on Tariffs and Trade inflict gross human rights violations on the poor of the South. This must be stopped.

6. Every person and community has the right to have direct access to international institutions to seek redress.

Article 7 - Environment

1. Everyone is entitled to live in a clean, healthy, safe, and sustainable environment free from agricultural and industrial pollution.

2. All peoples and nations have a right to participate in decisions regarding local, regional, and global environmental issues such as nuclear arsenals, storage, transportation, and dumping of toxic wastes, pollution, and location of hazardous industries.

Article 8 - Equality and Non-Discrimination

1. All persons are born free and equal in dignity and rights.

2. There shall be no discrimination in the rights and privileges of persons based on their ethnic origin, class, social status, age, sex, mental and physical being, language, religious belief, sexual identity or political conviction.

3. There shall be a more just distribution of wealth, power and opportunities without distinctions based on ethnic origin, age, sex, mental and physical being, language, religious belief, sexual identity or political conviction., The government and private sector should formulate and implement policies to achieve this end.

Article 9 - Equal access to basic needs

1. All persons. are entitled, irrespective of ethnic origin, age, sex, mental and physical being, language, religious belief, sexual identity or political conviction to sufficient food, clothing, shelter, education, energy, water, medical care, social services, information, public amenities and a clean and safe environment to maintain a standard of living adequate for the dignity, health and well-being of the person, the family and the community.

2. Everyone has the right to live and die with dignity and to social protection against unemployment, sickness, disability, old age, death or abandonment in circumstances beyond the person's control.

Article 10 - Employment

1. Everyone has the right to full employment with fair working conditions, a safe working environment and with a humane and democratic management.

2. All workers must receive equal pay for the same job done irrespective of gender and ethnicity.

3. All workers must receive a fair and just wage that allows the person and family to maintain an adequate standard of living.

4. All workers are entitled to job security, the right to organize and join a union of the person's choice, and exercise the right to take all forms of industrial action in a peaceful manner.

Article 11 - Education, language and culture

1. Everyone has the right to free primary and secondary education which shall be compulsory. The state shall provide the social, economic and legal mechanisms to ensure the above right. Higher education which includes technical and vocational education should be made available within the resources of the country to all, irrespective of gender, ethnicity and socioeconomic background.

2. All persons have the right to choose and practise their own religion, beliefs and traditions.

3. All persons have the right to use and learn their own languages and maintain their cultural traditions and identity.

4. National minorities have the right to carry on their own educational activities, including the maintenance of schools and higher educational institutions and the use and teaching of their own language; provided that this right is not exercised in a manner which prevents the members of these minorities from understanding the culture and language of the community as a whole and from participating in its activities in order to attain national unity and integration.

Article 12 - Rights to personal security

1. Everyone has the right to live in peace and be free from fear of arbitrary arrest and detention without fair and public trial.

2. No person shall be tortured or subjected to cruel or degrading treatment or punishment by individuals, police, military or any other state agency.

3. Everyone has the right to legal counsel forthwith upon arrest, to be presumed innocent until proven guilty, to be equally protected by the law and to be given a fair and public trial.

4. Everyone has the right to freedom from persecution and to obtain asylum in other countries.

5. Everyone shall have the right to move freely in and out of the country.

Article 13 - Freedom of association and assembly

1. Everyone is entitled to organize or participate in meetings, forums, gatherings, discussions, and other peaceful activities without having to obtain the prior permission of any state body.

2. Everyone has the right to join or form any Organisation including political organisations of their choice and conduct peaceful activities.

Article 14 - Freedom of expression and access to Information

1. Everyone has the right to freedom of opinions and responsible exercise of the freedom of expression without interference and persecution.

2. Everyone is entitled to seek, receive and impart information and ideas through an independent and responsible mass media free of political censorship and monopoly.

3. The media of mass communications shall not be subject to licensing at the discretion of government.

4. Mass communication media owned by the state must be governed and run by an autonomous impartial board made up representatives appointed by the state, the nongovernmental sector and opposition political parties.

Article 15 - Children

1. Every child is entitled to

a) adequate food, clothing, shelter and medical care for healthy physical growth.

b) a stable environment to encourage healthy mental and emotional growth.

c) proper supervision and education in basic moral values and social ethics.

d) live in a clean, healthy, and peaceful environment.

2. Children should not be deprived of a childhood which has adequate education, recreation, and social interaction with other children.

3. Children shall not be forced into child labour, prostitution and other forms of abuses.

4. All governments shall ratify and implement the rights of children to survival, protection and development and participation as embodied in the Convention on the Rights of Children.

Article 16 - Indigenous peoples

1. Indigenous peoples are entitled to self-determination. By this is meant their natural and inalienable rights to retain and control the land and all resources found on their traditional territories, and the right to choose their own way of life.

2. They have the right to practise and develop their culture and indigenous religion and to maintain their cultural identity. They shall also be provided with ample opportunity for material progress.

Article 17 - People with disabilities

1 . People with disabilities shall be recognized as members of society and have the right to adequate care in their daily lives.

2. They shall have the right to equal opportunity in education and employment and to be given adequate access to all basic public and social amenities.

3. They shall have the right to participate in the planning of the services for people with disabilities.

Article 18 - Refugees and Foreign Workers

1. All refugees should have access to the United Nations High Commissioner for Refugees, other possible form of assistance and to recognition as refugees. They should not be forcibly returned to their home country especially at the risk of persecution.

2. Foreign workers should have access to all basic amenities, fair working conditions, a just and equal wage, a safe working environment, and also a channel to redress discrimination and exploitation.

Article 19 - Human Rights Education and Training

1. Human rights education and training empower people to prevent human rights violations and nurture respect for the human rights of others.

2. Human rights education and training are central to the promotion and protection of human rights.

3. Comprehensive human rights education and training programmes both in and out of school shall be developed by the government and non-government sector.

Article 20 - National emergencies, derogations and judicial independence

1. No government shall declare a state of emergency except when a real danger exists to the very existence and life of the nation; and all declarations of state of emergency shall be abrogated immediately when the need for their perpetration no longer exists.

2. Even under a validly declared emergency, governments shall not deny nor violate the following rights and freedoms: right to life, right to recognition of personal dignity and legal personality, freedom of conscience and of religion, freedom from torture, retroactive penal measures, and cruel punishment, the right to leave from and return to one's own country, the right to habeas corpus, the right of access to civil courts and to fair, public and speedy trial.

3. The protection of human rights requires an independent and socially responsible judiciary.

4. We call for the establishment of international, regional, and national mechanisms for the promotion and protection of human rights with guarantees of independence, impartiality and accessibility.

WE CALL FOR:

The repeal of the Internal Security Act (ISA) and other laws providing for detention without trial, the Official Secrets Act, the Printing Presses and Publications Act and the amending of all our national laws to bring them in line with the human rights standards stated in this declaration.

The government to ratify immediately the International Covenant on Civiland Political Rights ; the International Covenant on Economic, Social and Cultural Rights; Convention on the Elimination of all forms of Discrimination Against Women; Convention Against Torture and the United Nations Convention on the Rights of the Child.

工委会议决:将徐袖珉除名

人民之友工委会2020年9月27日常月会议针对徐袖珉(英文名: See Siew Min)半年多以来胡闹的问题,议决如下:

鉴于徐袖珉长期以来顽固推行她的“颜色革命”理念和“舔美仇华”思想,蓄意扰乱人民之友一贯以来的“反对霸权主义,反对种族主义”政治立场,阴谋分化甚至瓦解人民之友推动真正民主改革的思想阵地,人民之友工委会经过长时间的考察和验证,在2020年9月27日会议议决;为了明确人民之友创立以来的政治立场以及贯彻人民之友现阶段以及今后的政治主张,必须将徐袖珉从工委会名单上除名,并在人民之友部落格发出通告,以绝后患。

年轻一辈人民之友有感而作


注:这“漫画新解”是反映一名自诩“智慧高人一等”而且“精于民主理论”的老姐又再突发奇想地运用她所学会的一丁点“颜色革命”理论和伎俩来征服人民之友队伍里的学弟学妹们的心理状态——她在10多年前曾在队伍里因时时表现自己是超群精英,事事都要别人服从她的意愿而人人“惊而远之”,她因此而被挤出队伍近10年之久。

她在三年前被一名年长工委推介,重新加入人民之友队伍。可是,就在今年年初她又再故态复萌,尤其是在3月以来,不断利用部落格的贴文,任意扭曲而胡说八道。起初,还以“不同意见者”的姿态出现,以博取一些不明就里的队友对她的同情和支持,后来,她发现了她的欺骗伎俩无法得逞之后,索性撤下了假面具,对人民之友一贯的“反对霸权主义、反对种族主义”的政治立场,发出歇斯底里的叫嚣,而暴露她设想人民之友“改旗易帜”的真面目!

尤其是在新冠病毒疫情(COVID-19)课题上,她公然猖狂跟人民之友的政治立场对着干,指责人民之友服务于中国文宣或大中华,是 “中国海外统治部”、“中华小红卫兵”等等等等。她甚至通过强硬粗暴手段擅自把我们的WhatsApp群组名称“Sahabat Rakyat Malaysia”改为“吐槽美国样衰俱乐部”这样的无耻行动也做得出来。她的这种种露骨的表现足以说明了她是一名赤裸裸的“反中仇华”份子。

其实,在我们年轻队友看来,这名嘲讽我们“浪费了20年青春”[人民之友成立至今近20年(2001-9-9迄今)]并想要“拯救我们年轻工委”的这位“徐大姐”,她的思想依然停留在20年前的上个世纪。她初始或许是不自觉接受了“西方民主”和“颜色革命”思想的培养,而如今却是自觉地为维护美国的全球霸权统治而与反对美国霸权支配全球的中国人民和全世界各国(包括马来西亚)人民为敌。她是那么狂妄自大,却是多么幼稚可笑啊!

她所说的“你们浪费了20年青春”正好送回给她和她的跟班,让他们把她的这句话吞到自己的肚子里去!
