这篇声明志期2011928

新加坡内政部于2011923日所发表的声明,充满了他们在过去的冷战时代所惯用的诸如共产党统一战线活动以及马克思主义者密谋的说辞(按此看全文)其意图显然是用来证明在内安法之下他们的专制任意的逮捕行动是合法的,并继续让人民对他们心存恐惧和害怕。

内政部声明根本无法回答我们16人声明所涉及的最为重要的无审讯扣留的课题。我们16人之中,没有人曾被提上法庭依法审讯。政府对我们(政扣者)施予关押监禁的根据,仅仅是内部安全局官员的单方面报告,或者是政扣者受到拷打盘问、冷冻虐待、剥夺睡眠等各种折磨以及无限期扣留恐吓,而被迫作出的供词。

《世界人权宣言》第九条说任何人不得加以任意逮捕、拘禁或放逐。新加坡是这个宣言的签字国之一,理应遵守《世界人权宣言》的这项规定。

我们重申,内安法令是让执政党用来对付那些对其统治权力有所威胁的任何人、进行逮捕与无审讯扣留监禁的一项残酷的法律。它的存在对新加坡造成的影响是使到人民遭遇残废重创和恶毒伤害,已经超过半个世纪了。

我们谨此呼吁新加坡政府设立一个独立的调查委员会,以调查政府对我们16人以及所有在内安法令下遭遇逮捕、无审讯扣留监禁的前政治扣留者所作的指控是否有正当理由。尤其是新近有许多历史学家和前政治扣留者所出版的书刊、回忆录和举办的座谈会所揭露的许多事实,跟对当年有关事件的官方论述,是不同的。我们强烈要求新加坡政府应有这样的品格德行和政治勇气,设立一个旨在求取真理与透明运作的调查委员会。

The Ministry of Home Affairs’ statement of 23 September 2011 contains the usual rhetoric, inundated with Cold War parlance such as “Communist United Front activities” and “Marxist plot” (Click Here for Full Statement). Its intent is clearly to justify the act of arbitrary arrest under the ISA and instil fear in the people.

The statement fails to address the most important concern of the 16 of us, which is indefinite detention without trial. None of us was brought to trial before a court of law. Our imprisonment was solely based on the statements of ISD officers and statements extracted from us while we were subjected to torture, cold room treatment, deprivation of sleep and the threat of indefinite detention.

Article 9 of The Universal Declaration of Human Rights to which Singapore is a signatory declares: No one shall be subjected to arbitrary arrest, detention or exile.

We reiterate that the ISA is a draconian law that allows the ruling party to arrest and imprison without trial anyone it deems a threat to its power. Its impact on Singapore over the past half a century has been both crippling and pernicious.

We call upon the Government of Singapore to set up an independent Commission of Inquiry to investigate if the allegations made against us as well as all former ISA-detainees are justified. More so when recent publications, memoirs and panel discussions by historians and ex-ISA detainees have given accounts different from the official narrative on the events of those years. We urge the government to have the moral and political courage to set up such a commission in the interest of truth and transparency.

We welcome Malaysian Prime Minister Najib Razak’s announcement that his government would repeal the Internal Security Act (ISA) and the Emergency Ordinance.  He said the changes are aimed at “having a modern, mature and functioning democracy which will continue to preserve public order, ensure greater civil liberties and maintain racial harmony.” We look forward to the Malaysian Prime Minister fulfilling his promise to his people.

Singapore inherited the ISA from Malaysia. This law has been in existence for more than half a century and its impact on society is both crippling and pernicious. Its life began soon after the Second World War as the Emergency Regulations in 1948 when the British used it to put down strong anti-colonial movements. In 1955, the Preservation of Public Security Ordinance incorporating the Emergency Regulations was passed. When Singapore joined Malaysia in 1963, the Federation of Malaya’s Internal Security Act 1960 became part of our law

The Ministry of Home Affairs claims that:
            “ … A person arrested under the ISA in Singapore may be held in custody for 30 days after which an Order of Detention or Restriction Order must be issued or else the up to person must be released unconditionally.

In Malaysia, the period of custody is up to 60 days…” (ST 17.9.2011).

This comparison is irrelevant because political detainees in Singapore have been imprisoned for periods which far exceed those in Malaysia.  Dr Chia Thye Poh was imprisoned for 26 years. Dr Lim Hock Siew was imprisoned for 20 years.  Mr Lee Tee Tong was imprisoned for 18 years and Dr Poh Soo Kai and Inche Said Zahari for 17 years.
 
The Ministry further claims that the Advisory Board is a safeguard against abuse under the ISA. The protection accorded by the Advisory Board is spurious, if not a farce. Several of us have appeared before such a board and can confirm that the board did not examine witnesses and evidence against the detainee.  In 1987, appearances before the board lasted not more than a few minutes each. Furthermore, detainees were discouraged from appearing before the board by ISD officers. Many were advised that appearing before the board would jeopardise their chances of early release.


Singapore has many existing laws that will deal with acts of terrorism. We have the Penal Code, the Sedition Act, Corrosive and Explosive Substances and Offensive Weapons Act, Vandalism Act and after 9/11, the Terrorism (Suppression of Bombings) Act and the Terrorism (Suppression of Financing) Act. These laws provide severe punishments which include death,  life imprisonment and caning.

In 1991, then Deputy Prime Minister Lee Hsien Loong said, “Singapore will seriously consider abolishing the Internal Security Act if Malaysia were to do so”. He made this response to seven Malaysian journalists in his office when asked why the ISA was still needed in Singapore even though the Communist Party of Malaya no longer posed a threat. (ST 3.2.1991.) Now that Malaysia is repealing the ISA, we call upon PM Lee Hsien Loong to translate  his 1991 statement into reality and keep in step with the aspirations of our people for a mature and functioning democracy. Indefinite detention without trial is an affront to the human rights of citizens and an assault on our justice system.

我们欢迎马来西亚首相纳吉拉萨宣称其政府将撤销内部安全法令(简称ISA)和紧急法令。纳吉说这项变化旨在拥有一个现代的、成熟的民主运作,以便继续维护公共秩序、保证更大公民自由以及维持种族和谐。我们期待马来西亚首相纳吉实现他对人民的承诺。

新加坡是从马来(西)亚继承它的内部安全法令。这项法令已经存在了超过半个世纪,而对社会所造成的是残废和致命伤害的严重后果。这项法令源于二战之后1948年实施的紧急法令,英国人(殖民主义者)用它来镇压强大的反殖民主义运动。保存着紧急法令内容的公共安全法令,是在1955年通过的。在 1963年当新加坡加入马来西亚时,马来亚联合邦的1960年内部安全法令,就成为我们(新加坡)的法律的组成部分。


 新加坡内政部宣称:

    在新加坡,一个在内部安全法令下被逮捕的人士可被拘留最多30天,此后 必须发出拘留令或限制令,或其他如无条件释放。

   “在马来西亚,拘留期是高达60天。(见2011917日《海峡时报》)

这样的比较是不恰当的,因为在新加坡的政治扣留者被监禁的时期,远远长过在马来西亚的政治扣留者被监禁的时期。谢太宝博士被关了26年,林福寿医生被关了20年,李思东被关了18年,傅树楷医生与赛扎哈里先生被关了17年。

内政部进一步声称,咨询委员会(即所谓上诉委员会)是一项在内内安法令下防止滥用权力的保障。咨询委员会所给予被拘留者的保护是欺骗性的,只不过是一场 闹剧。我们之中的一些人,曾经向这个咨询委员会上诉过,但是,可以确认这个委员会并不会去盘问证人及审查指控的证据。在1987年,每个上诉过程费时不过 几分钟,而且内安局官员往往阻碍或打击被扣者进行上诉,许多被扣者都告知,若上诉必将危害他们早日获得释放的机会。

新加坡已有许多现行法律用以应对恐怖主义行为,诸如刑事法令,煽动法令,腐蚀性与爆炸性物质与攻击性武器法令,破坏行动法令,以及911后防止恐怖主义(制止爆炸事件)与(制止资助恐怖主义)法令。这些法令提供严厉的处罚包括死刑、终身监禁以及鞭笞。

1991年,时任副总理李显龙曾说,新加坡将认真考虑废除内部安全法令,如果马来西亚这样做。这是李显龙当时在其办公室,针对7名马来西亚新闻从业员提问马来亚共产党已经不再构成威胁,为何新加坡还需要内部安全法令?所作出的回应(见199123日《海峡时报》)。现在,马来西亚正在撤销内部安全法令,我们呼吁李显龙总理把他在1991年的声明,转化成为现实,配合人民的愿望,走向一个成熟的民主运作。未经审讯的无限期扣留是一项对公民人权的公然侵犯,同时也是一项对国家司法系统的破坏。

我国非政府组织-志在为人民服务

[编按: 本文是柯嘉逊博士在2011年9月11日于士姑来大学城美都迎宾楼举办的“非政府组织:与人民同在”论坛上发表的论文。]

1.我国非政府组织与人民的利益

非政府组织是为了捍卫和促进某个群体的利益而存在。1987年,执政党内部面临危机、进而援引《内安法令》展开大逮捕(茅草行动 . 就在这一年 , 大马人民之声逐渐成。 1989 , 扣者陆续被释放,茅草行动中的前扣者和扣者家属支援团成员正式成立了大马人民之声 .

大马人民之声 旨在推动废除《内安法令》运动 , 监督、记录我国的人权状况,为人权 奋斗。 此, 大马人民之声 成了展开反对无审讯扣留运动主要的非政府组织。
 
1989年起,大马人民之声一直都是反对《内安法令》、《紧急法令》、《危险毒品法令》及其他无审讯扣留法令运动的秘书处。我们的办公室成了 政府压迫的受害者家属的庇护所。每当发生无审讯扣留或其他 侵犯 人权的案件 ,我们便会向世界各地的联 络网 , 发出紧急 求援的讯号
 
其实 , 大马人民之声有一个更远大的目标,即 : “提高人民的醒觉,发展替代的进步民主力量 , 建立一个和平、自由、公正、 平等 和持 续性发展的社会”。
 
 大马人民之声在过去的22 , 都是由一小群积极的社运分子及志愿者经营的。我们所获得的资金 , 主要用來培训那些参与人权工作的年轻社运分子。我们聘用了几位职员, 他们都是投身人权工作的年轻人。
 
虽然我们的职员不多,但 ,1998年起 , 每年 我们 都不曾间断地出版我国独一无二的年度人权报告》. 这是一本具 公信力而又详细的 人权报告 。出版此报告是我们为马来西亚各族、各宗教信仰人民提供的一项宝贵的服务. 同时, 也借个机会向世界其他国家汇报我国的人权状况。
 
在过去的22年,大马人民之声的职员与秘书处一直 都在 参与人权和环 教育 工作,包括演讲、主办工作坊、提供培训等。 大马人民之声发起了反对巴贡与雪兰莪水坝运动及调查工作 , 以防止环境遭到破坏.  同时, 维护了原住民和我国纳税人的利益。我们也声援 那些 面对逼迁 , 或被当权者压迫的 , 被边缘化的群体(包括: 城市开拓者、园丘工人、难民等)。此外,我们也参与了恢复地方议会选举的运动。
 
 1999 2002, 我们分别在新山及槟城 两地 设立了支部,以便更好地为当地人民服务. 同时 , 也让我们更有效地监督与收录国内其他地方 违反 人权 的实 况。
 
2.我国非政府组织与人民运动
 
自成立以来,大马人民之声一直在推动国内的民主运动 , 使它 往健康的方向发展。可以 说,过去20多年, 在人民阵线 大马人民之声的 共同 努力下 , 促成了2008 年的 政治海啸 , 以及 今日的两线制。民联的一些领袖 , 曾经在不同时候 , 担任过大马人民之声的秘书处成员。

我们和一些非政府组织与社团建立起了合作关系,特别1994 , 我们 共同 草拟 《马来西亚人权宪章》、1998年出版人权报告》、1995年参与反对巴贡水坝联盟、1998参与人民民主联盟的行动。我们也是净选盟的成员之一。成立这些联盟的过程是非常难得与珍贵的,主要 因为 , 些合作和努力 推动了我国人权运动的发展。
 
 在国外,大马人民之声也是这区域的人权网络的一份子。我们相信,通过维护和促进本区域人权的发展,才能更有效地提升东盟和亚太地区人民对人权的认识。因此,我们在1998年亚太人民峰会、 1996年亚太东帝汶研讨会、支援缅甸及其他区域性课题上, 扮演了积极的角色。这与世界各国 (包括波斯尼亚、巴勒斯坦等国家) 提倡人权、反帝的普世价值观是一致的。我们也要把裁军运动、主张和平的文化, 推广到东盟国家。
 
3.我国非政府组织与我国政治

  非政府组织能够也必须发挥建设性作用, 确保马来西亚人民的利益在政治上受到保护。最近的 干净与公平选举联盟(简称 净选盟)可称得上是非政府组织中的佼佼者. 它提出了 ‘黄色’诉求, 以确保我国有自由公平的选举。反毒害的莱纳斯和武吉公满的环保运动, 则合法地提出了在工业计划项目中, 保护环境与人民健康的‘绿色’诉求。为了使诉求更臻完善, 就必须提出公民与政治权利的‘红色’诉求。这一切都是大马人民之声自1989年成立以來最关注的事项。
 
为了反对不合理的计划, 为了反抗政府采取殘酷暴虐的手段來完成这些计划, 必须喚醒社区民众进行斗争. 这对促进马来西亚的民主及永续性发展, 是至关重要的。木屋区人民坚決和发展商聘用的流氓、执法人员、和动用水炮的联邦后备队人员等进行抗争, 也是其中的一个例子。红泥山居民为了捍卫安全、免受辐射污染的居住环境,多年来不断反对在红泥山设立稀土提炼厂,直至提炼厂被关闭为止, 又是另一个很好的例子。今天,反对莱纳斯建造稀土厂、反对在武吉公满的山埃开采黃金的社区居民, 都站在以人民利益为主的斗争最前线。
 
马来西亚人民应该学习他们对斗争, 领导和社区紧密团结的精神。他们让我们了解到, 直接行动, 就是喚醒人民团结一致, 朝着共同目标, 通过自己的行动, 直接改变现狀。
 
我国目前的现实是: 我国存在着国家财富分配日益不均的危机. 这种分配不均的现象发生在: 东马与西马之间、乡村与城市之间、男人与女人之间; 被边缘化群体 (如原住民、城市开拓者、园丘工人等少数社群)被迫害;森林、能源和水源的枯竭等。当前的格局是, 那些有政治领袖撑腰的有钱有势者可以自行决定, 要生产什么、要开发什么资源、要赚取多少利润。那些获得丰厚利润的合同签署者, 往往都是与执政党有亲密关系的公司。
 
我国的经济计划, 需要由有高度组织的劳工运动, 以及公民社会的高度参与。所有权必须多元化,不应集中在不需问责的私人权力手上、应把计划经济与市场经济综合起來, 让有活力的合作社与社区群体参与。 在工作场合和更广阔的社会, 必须要有各种民主形式的参与。生产的最终目标是满足人类的需要,虽然受管制的市场,(:衣服、食品等) 也扮演着一定的角色。

我们绝对不需要生产武器, 也不成为全球军火商的境外组成部分. 同样地,我们也毋需生产武器以发展我国的军事工业。环保运动和人民要求和平、民主、人权的运动, 两者是分不开的。

人民的利益必须包含: 支持被帝国主义侵略的其他国家受苦受难的人民。这些年来, 大马人民之声一贯反对和谴责美国/西方帝国主义。我们是“反战联盟”的成员之一. 我们曾协调反美示威、抗议美国入侵伊拉克和阿富汗, 抗议以色列在加沙所犯下的暴行。
 
4.反新自由主义的第三势力
 
我国非政府组织必须继续为人民服务,建立第三势力, 为打倒新自由主义而努力, 并为马来西亚人民夺回被侵占的国家资源。第三势力的首要目标, 就是推翻国阵政权. 自独立以来, 国阵政权都在分化和压迫我国人民. 他们很乐让新自由主义资本家对人民进行剥削。就如2008年大选一样,我们必须和人民联盟结成战略联盟,推翻国阵,恢复我们的基本自由、自由民主和人权。
 
在结为战略联盟的过程中,我们希望民联在遴选候选人方面, 能从现实出发, 向第三势力做出一些让步。这是因为自2008 大选过后, 发生了不少从民联跳槽到国阵的事件

在人民阵线內部,非政府组织在选拔候选人方面, 可扮演至关重要的角色,以确保不再发生如308后屡屡看见的许多没有素质、沒有原则的候选人跳槽的事件 (这些变节者有如蟾蜍, 笨驴,或笨牛) 。为了避免频繁的肮脏政治交易, 以及给全国反对党带来恶劣的形象, 非政府组织可以成立一个独立的“人民候选人遴选委员会”,以便在來届全国大选审核适合候选人,并防止在一些选区出现三角战。非政府组织内德高望重的领导人,最适合成为委员会不循私的成员。每当全国大选来临前, 民联內部, 党与党之间常为分配议席进行谈判而出现争吵。上述遴选过程將有助于人民阵线大幅度减少这类的争吵. 如果民联各政党在上阵某些选区引起争论时,非政府组织所组成的遴选委员会, 也可以作出裁决。

在国阵垮台, 民联上台后,反对新自由主义资本主义的斗争必将继续下去,因为我们争取的是人民的权利和利益。民联至今还沒表态, 宣布放弃新自由主义政策. 在新自由主义政策下, 跨国公司和资本雄厚的大公司可以掠夺我国资源、以最低廉的价格收购我国已私有化的国家资源

我们反抗不受限制的新主自由主义的同时,也必须在发展民主参与式的社会主义过程中,给予被压迫人民以权力. 群众的民主参与不应仅限于经济领域,也应包括政治领域。国家干预是有必要的, 并且对基本的能源与服务 (: 石油、天然气、水电、医疗设施、教育、社会福利设施等) 应实施国有化政策。对投机倒把者和金融资本家不受限制的资本转移, 也应加以制止。
 
只有通过直接参与和群众运动, 才能实现真正的草根性民主。要掌握权力, 自行组织起來的工人与其他社群必须和资本进行斗争。工作场所和社区直选的议会, 必须有权處理他们自己的事务. 这点,和整个社会的决定息息相关。
 
仅仅想通过全国大选或单靠国会來取得真正的民主, 那是绝对不可能的。为了让民主能真正运作,我们必须加强在国会外提出的诉求。民主不仅仅是每五年投一次票. 俗话说:

如果只靠大选中投票, 就能带来改变的话,那么当权者早就把这种制度废除了!

1.      NGO dan Kepentingan Rakyat
Kewujudan dan pembentukan NGO adalah untuk mempertahankan, memajukan dan mengembangkan kepentingan masyarakat tertentu. SUARAM terbentuk dalam keadaan krisis dalaman parti pemerintah berlaku pada 1987 dan penahanan ISA secara besar-besaran dibawah operasi lalang. Selepas dibebaskan pada tahun 1989, bekas tahanan operasi lalang dan mereka yang terlibat dalam ‘kumpulan sokongan keluarga tahanan’ (families support group) telah mengasaskan SUARAM untuk berkempen bagi memansuhkan ISA dan untuk memantau, mendokumenkan dan untuk mempertahankan hak asasi manusia. Sejak itu, SUARAM menjadi NGO utama yang menentang penahanan tanpa bicara.

Sejak tahun 1989, SUARAM telah menjadi penyelaras utama gerakan anti ISA dan lain-lain akta tanpa bicara seperti Ordinan Darurat (EO) dan Akta Dadah Berbahaya (DDA). Pejabat kami berfungsi memberi perlindungan kepada mereka yang ahli-ahli keluarganya telah menjadi mangsa penindasan kerajaan. Kami menghantar rayuan segera di seluruh dunia setiap kali berlakunya penahanan (tanpa bicara)atau penindasan hak asasi manusia.
Namun begitu, misi SUARAM sebenarnya jauh lebih daripada itu: " berusaha ke arah masyarakat yang aman, bebas, sama rata, adil dan mampan(berkekalan) dengan memperkasakan rakyat untuk mewujudkan alternatif demokratik progresif baru."
Dalam 22 tahun yang lepas, SUARAM telah beroperasi dengan struktur yang terdiri daripada aktivis dan sukarelawan yang komited. Sokongan kewangan yang kami peroleh digunakan untuk memupuk aktivis muda dalam kerja-kerja hak asasi manusia. Kami mengambil sekumpulan kecil kakitangan muda yang berdedikasi yang telah memilih haluan ini untuk berkhidmat kepada kerja-kerja hak asasi manusia.
Walaupun dengan jumlah kakitangan yang sikit, SUARAM menerbitkan satu-satunya laporan Hak Asasi Manusia yang kredible dan terperinci setiap tahun tanpa gagal sejak tahun 1998. Laporan yang sedemikian adalah satu sumbangan yang tidak ternilai kepada semua rakyat Malaysia tanpa mengira kaum, agama atau kepercayaan dan juga mendedahkan (keadaan hak asasi di Malaysia) kepada warga seluruh dunia.
Sepanjang kewujudannya di dalam 22 tahun yang lalu, kakitangan dan ahli sekreteriat SUARAM telah terlibat dalam pendidikan hak asasi manusia dan alam sekitar, memberi ceramah, menganjurkan seminar dan menyediakan latihan. SUARAM telah memulakan misi pencarian maklumat (fact finding missions) dan kempen membantah empangan Bakun dan empangan Selangor untuk melindungi kepentingan orang-orang asli, alam sekitar dan kepentingan pembayar cukai di Malaysia. Kami juga memberi sokongan kepada masyarakat terpinggir seperti peneroka bandar, masyarakat ladang dan pelarian (refugees) apabila mereka menghadapi pengusiran paksa dan ditindas oleh kerajaan. Kami juga terlibat dalam kempen menuntut balik pilihanraya kerajaan tempatan.
Cawangan kami di JB (1999) dan Pulau Pinang (2002) telah ditubuhkan supaya kami boleh berkhidmat kepada rakyat di sana dengan lebih baik dan meningkatkan dokumentasi dan pemantauan pencabulan hak asasi manusia di kawasan-kawasan diluar KL.
2.      NGO dan Gerakan Rakyat Malaysia
Sejak penubuhannya, SUARAM giat bekerja ke arah gerakan demokrasi yang sihat di negara ini dan kita boleh mengatakan bahawa Gagasan Rakyat dan semua usaha-usaha oleh SUARAM dalam 20 tahun yang lalu telah menghasilkan sistem dua-barisan hari ini dan tsunami politik pada tahun 2008. Sebilangan kecil pemimpin dalam Pakatan Rakyat, pada waktu-waktu berlainan, pernah menjadi ahli Sekretariat SUARAM.
Kami telah berjaya dalam membina rangkaian badan-badan bukan kerajaan dan pertubuhan-pertubuhan masyarakat, terutamanya ke atas penggubalan Piagam Hak Asasi Manusia Malaysia pada tahun 1994, penerbitan Laporan Hak Asasi Manusia Malaysia pada tahun 1998, Gabungan membantah Empangan Bakun pada tahun 1995 dan Gagasan Demokrasi Rakyat pada tahun 1998. Sudah tentu kami adalah sebahagian daripada gabungan Bersih 2.0. Proses menjalin rangkaian-rangkaian ini adalah sama penting dengan pembentukan jaringan-jaringan ini sendiri dalam misi kami untuk membina sebuah gerakan hak asasi manusia di negara ini.
SUARAM juga telah menjadi sebahagian daripada rangkaian hak asasi manusia serantau kerana kita percaya bahawa cara yang lebih bermakna untuk memupuk persefahaman di kalangan rakyat ASEAN dan Asia-Pasifik adalah untuk menegakkan dan menggalakkan hak asasi manusia di rantau ini. Oleh itu, kami telah memainkan peranan aktif dalam Himpunan Rakyat Asia Pasifik pada tahun 1998, Persidangan Asia-Pasifik mengenai Timor Timur pada tahun 1996, ‘Myanmar Solidariti’ dan lain-lain isu serantau. Ini adalah selaras dengan semangat kesejagatan hak asasi manusia dan anti-imperialisme yang melintasi sempadan untuk setiap masyarakat di bumi kita, termasuk Bosnia, Palestin dan lain-lain. Kempen bagi melucutkan senjata dan membudayakan keamanan juga mesti meliputi seluruh komuniti ASEAN.
3.      NGO dan politik Malaysia
NGO boleh dan mesti memainkan peranan yang membina dalam memastikan kepentingan rakyat dilindungi dalam politik Malaysia. Gabungan Bersih 2.0 baru-baru ini mungkin satu contoh terbaik bagaimana NGO telah membangkitkan tuntutan "kuning" untuk memastikan pilihan raya yang bebas dan adil di Malaysia. Kempen alam sekitar Lynas dan Bukit KOMAN paling sesuai mengutarakan tuntutan "hijau" bagi perlindungan alam sekitar dan perlindungan kesihatan orang ramai dalam projek-projek perindustrian. Tuntutan-tuntutan ini tidak akan lengkap tanpa tuntutan "merah" hak-hak sivil dan politik. Inilah yang SUARAM prihatin sejak ia ditubuhkan pada tahun 1989.

Adalah penting bagi demokrasi dan pembangunan mampan Malaysia bahawa komuniti diperkasakan dalam perjuangan mereka menentang projek-projek silap rancang yang diiringi oleh kaedah menindas yang digunakan untuk menjayakannya. Kes kampung-kampung di mana masyarakat berdiri teguh menentang samseng pemaju, pegawai-pegawai penguatkuasa, FRU dan meriam air mereka. Begitu juga dengan kes di Bukit Merah di mana penglibatan dan sokongan masyarakat setempat kekal sepanjang kempen. Mereka berjuangan untuk persekitaran hidup yang selamat yang bebas dari pencemaran radioaktif. Hari ini, masyarakat yang membantah loji nadir bumi Lynas dan lombong emas Bukit Koman adalah barisan hadapan perjuangan ini untuk memastikan kepentingan rakyat didahulukan daripada keuntungan.

Komitmen mereka terhadap perjuangan, kepimpinan dan solidariti masyarakat patut dicontohi oleh segenap masyarakat Malaysia. Mereka telah menunjukkan kepada kita bahawa tindakan secara langsung mampu memperkasakan rakyat untuk bersatu  sebagai individu dengan tujuan yang sama, untuk mengubah keadaan secara langsung dengan tindakan kita sendiri.

Realiti di Malaysia adalah krisis ketidaksamarataan yang semakin ketara dalam pengagihan kekayaan di negara ini; antara Timur dan Barat Malaysia; antara kawasan luar bandar dan bandar; antara lelaki dan wanita; penindasan ke atas kumpulan yang terpinggir termasuk masyarakat Orang Asli, peneroka bandar, masyarakat ladang dan lain-lain minoriti; dan pengurangan kawasan hutan, tenaga dan sumber air. Sudah menjadi corak bahawa yang kaya dan berkuasa dengan sokongan daripada pemimpin-pemimpin politik yang akan membuat keputusan mengenai apa yang dihasilkan, sumber mana yang akan dieksploitasi dan berapa banyak keuntungan akan diragut. Dan kebiasaannya, syarikat yang berhubung rapat dengan kuasa politik tertentu yang akan diberi kontrak-kontrak lumayan ini.

Ekonomi kita perlu dirancang berpandu kepada gerakan buruh yang digemblengkan dan tahap penyertaan yang tinggi dari masyarakat madani. Corak hak milik mesti berbentuk majmuk tanpa penumpuan kuasa swasta yang tidak bertanggungjawab, campuran antara rancang dan pasaran serta sektor koperatif dan masyarakat yang bertenaga. Di tempat kerja dan masyarakat umum, penyertaan bercorak demokrasi mesti diwujudkan. Matlamat pengeluaran adalah untuk memenuhi keperluan manusia walaupun terdapat peranan untuk pasaran terkawal seperti barang-barang keperluan, contohnya. pakaian, bahan makanan.

Sudah tentu kita tidak memerlukan pengeluaran senjata sebagai sebahagian daripada proses luar pesisiran kepada pengeluar senjata global sebagaimana juga (kita tidak perlu) kompleks perindustrian ketenteraan domestik. Gerakan memelihara alam sekitar pula tidak dapat dipisahkan daripada gerakan rakyat untuk keamanan, demokrasi dan hak asasi manusia.

Kepentingan rakyat jelata mesti meliputi sokongan kepada rakyat negara-negara lain yang menjadi mangsa pencerobohan imperialis. Suaram juga telah konsisten dalam menentang dan mengutuk imperialisme Amerika / barat selama ini. Kami telah menyertai “Gabungan Hentikan Perang" dan menyelaraskan demonstrasi anti- Amerika dan protes terhadap pencerobohan Amerika di Iraq dan Afganistan serta kekejaman Israel di Gaza.

4.      Kuasa Ketiga Yang Menentang Neo-liberalisme
Oleh itu, badan-badan bukan kerajaan mesti terus berkhidmat kepada rakyat dengan membina kuasa ketiga yang berusaha ke arah mengalahkan neo-liberalisme dan menuntut kembali sumber-sumber Malaysia untuk  rakyat Malaysia. Matlamat pertama kuasa ketiga adalah menumbangkan rejim BN yang memecah-belahkan dan menindas rakyat Malaysia sejak kemerdekaan dan berkembang pesat melalui eksploitasi ala kapitalis neo-liberal. Sama seperti dalam pilihan raya umum 2008, kita perlu membentuk pakatan strategik dengan Pakatan Rakyat (PR) untuk menumbangkan kerajaan BN dan mengembalikan kebebasan asas, demokrasi liberal dan hak asasi manusia.
Dalam membina pakatan strategik ini dan mengetahui hakikat bahawa sejumlah wakil rakyat dari PR telah lompat ke BN selepas pilihan raya 2008, kita berharap bahawa PR akan berkompromi dengan sepatutnya dengan kuasa ketiga dalam pemilihan calon (untuk pilihanraya umum).
Diantara PR, NGO boleh memainkan peranan yang penting dalam menghakimi pemilihan calon-calon (pilihanraya) dan memastikan tidak wujud lagi kodok, keldai atau lembu tolol yang kita lihat selepas pilihan raya umum 2008. Untuk mengelakkan rundingan sukar yang biasa berlaku dan kesan buruknya kepada pembangkang persekutuan, NGO boleh membentuk satu 'Jawatankuasa Bebas Pemilihan Calon Rakyat' untuk menilai secara objektif kesesuaian calon-calon rakyat untuk pilihan raya umum ke-13 dan mengelakkan pertarungan tiga penjuru di mana-mana kawasan pilihan raya. Pemimpin NGO yang disegani adalah orang yang paling sesuai dijadikan ahli yang tidak berat sebelah dalam jawatankuasa ini. Proses ini juga akan membantu PR dengan mengurangkan pertelingkahan yang selalunya berlaku semasa rundingan antara parti (untuk kerusi) sebelum setiap pilihan raya umum. Jawatankuasa NGO ini juga harus mengadili tuntutan-tuntutan oleh parti-parti dalam PR terhadap kerusi-kerusi tertentu.
Selepas kejatuhan BN, perjuangan menentang kapitalisme neo-liberal, seiring dengan perjuangan untuk melindungi hak-hak dan kepentingan rakyat, pasti akan dituju kepada kerajaan PR. PR setakat ini tidak menolak dasar-dasar neo-liberal yang membolehkan syarikat-syarikat multi-nasional dan syarikat-syarikat besar untuk merompak sumber-sumber negara dengan membeli sumber-sumber yang diswastakan pada harga teramat rendah. Sumber dan pasaran kita dikawal mengikut kepentingan kapitalis yang berkuasa yang semakin pesat berkembang melalui buruh murah warga Malaysia mahupun buruh asing. Kos untuk ini akhirnya ditampung oleh pekerja-pekerja dan golongan miskin dimana taraf hidup mereka terus ditolak ke bawah.
Penentangan terhadap neo-liberalisme yang tidak terkawal adalah selari dengan usaha memperkasakan rakyat yang tertindas dalam proses membentuk sosialisme penyertaan demokratik (democratic participatory socialism). Penyertaan umum secara demokratik  bukan sahaja perlu dilaksanakan di institusi-institusi ekonomi tetapi juga dipolitik. Terdapat keperluan terhadap campur tangan kerajaan dan menghakmiliknegarakan sumber asas seperti petroleum dan gas, utiliti seperti air, tenaga, kesihatan, pendidikan dan perkhidmatan sosial. Pindahan modal yang tidak terbatas oleh spekulator dan kapitalis kewangan juga mesti diletakkan dibawah pemeriksaan.

Hanya melalui tindakan secara langsung dan gerakan massa, demokrasi akar umbi sebenar boleh wujud. Kuasa mestilah berasaskan organisasi kendiri pekerja dan lain-lain komuniti dalam perjuangan mereka menentang modal. Majlis-majlis di tempat kerja dan masyarakat setempat yang dihasilkan secara pilihan bertanggungjawab ke atas hal ehwal mereka sendiri dan dikaitkan dengan keputusan keseluruhan masyarakat secara umumnya.
Demokrasi sebenar tidak akan tercapai hanya melalui pilihan raya umum yang berkala dan tidak bergantung kepada parlimen semata-mata. Untuk memastikan kejayaan demokrasi, kita mesti mengemukakan tuntutan dari luar Parlimen. Demokrasi adalah lebih daripada sekadar mengundi lima tahun sekali seperti ada pandangan yang mengatakan bahawa: 
"Jika mengundi dalam pilihan raya umum pernah membawa sebarang perubahan, ia pasti sudah dimansuhkan sekarang!"

NGOS IN THE SERVICE OF THE MALAYSIAN PEOPLES

[Note: This article is prepared and presented by Dr. Kua Kia Soong in the "NGOs Are Always With The People" forum organized in commemoration of the 10th anniversary of Friends of SUARAM (FOS) Working Committee Johor on 11th September 2011.]

1. NGOs and the Peoples’ Interests

NGOs exist to defend, promote and develop the particular interest for which they were formed. It was during the crisis within the ruling party in 1987 and mass ISA arrests and detentions under Operation Lallang that SUARAM took shape. Upon their release in 1989, the Operation Lallang detainees and others in the Families Support Group founded SUARAM to campaign for the abolition of the ISA and to monitor, document and to defend human rights. SUARAM has since been the main NGO opposing detention without trial.

Since 1989, it has been the main coordinating secretariat for the Movement against the ISA and other detention without trial laws, the EO and the DDA. Our office serves as the refuge for those whose family members have been victims of state oppression. We send Urgent Appeals throughout the world whenever any detention or other violations of human rights happen.

But SUARAM’s mission is much more than that: “to work toward a society that is peaceful, free, equal, just and sustainable through empowering people to create new progressive democratic alternatives.”

In the last 22 years, SUARAM has operated with a skeletal staff of committed activists and volunteers. The funding we get goes into nurturing young activists in human rights work. We employ a handful of dedicated young staff who have chosen this path of service in human rights work.

Despite its small staff, SUARAM publishes the only credible and detailed Human Rights Report every year without fail and has been doing so since 1998. Such a report is an invaluable service to all the peoples of Malaysia irrespective of ethnicity, religion or creed and also to inform the rest of the world.

Throughout its existence in the last 22 years, SUARAM staff and secretariat have been involved in human rights and environmental education, giving talks, organising seminars and providing training. SUARAM has initiated fact finding missions and campaigns against the Bakun dam, the Selangor dam to protect the interests of indigenous peoples, the environment and the interests of Malaysian tax payers. We have also supported marginalised communities such as the urban settlers, estate communities and refugees when they have met eviction and state oppression. We are also in the campaign to bring back elected local government.

Our branches in JB (1999) and Penang (2002) were set up in order that we can serve the people there better and to improve our documentation and monitoring of human rights violations in the rest of the country.

2. NGOs and the Malaysian Peoples’ Movement

Since its founding, SUARAM has worked toward a healthy democratic movement in the country and we could well say that Gagasan Rakyat and all the efforts by SUARAM in the last 20 years have produced today’s two-front system and the political tsunami of 2008. Some leaders in Pakatan Rakyat have been members of the Secretariat of SUARAM at some time or other.

We have succeeded in building a network of NGOs and groups, notably on the drafting of the Malaysian Charter on Human Rights in 1994, the Malaysian Human Rights Report in 1998, the Coalition against the Bakun Dam in 1995 and Gagasan Democrasi Rakyat in 1998. We are of course part of the Bersih coalition. The process involved in forging those coalitions has been as valuable as the formation of the coalitions themselves in our mission to build a human rights movement in this country.

Reaching beyond Malaysia, SUARAM has also become part of the regional human rights network because we believe that a more meaningful way to promote understanding amongst the people of ASEAN and Asia-Pacific is to uphold and promote human rights in the region. Thus, we have played an active role in the Asia Pacific Peoples Assembly in 1998, Asia-Pacific Conference on East Timor in 1996, Burma Solidarity and other regional issues. This is consistent with the spirit of the universality of human rights and anti-imperialism which stretches beyond frontiers to every society on our planet, including Bosnia, Palestine and others. The campaign for disarmament and a culture of peace must also extend to the whole ASEAN community.

3. NGOs and Malaysian Politics

NGOs can and must play a constructive role in ensuring that the peoples’ interests are safeguarded in Malaysian politics. The recent Bersih coalition is perhaps the best example of how NGOs have raised the “yellow” demands relating to ensuring free and fair elections in Malaysia. The Lynas and Bukit Koman environmental campaigns are rightfully raising the “green” demands for environmental protection and peoples’ health protection in industrial projects. These demands will not be complete without the “red” demands of civil and political rights. These have been SUARAM’s concerns ever since it was founded in 1989.

It is vital for Malaysian democracy and sustainable development that communities are empowered in their struggle against the misconceived projects and the accompanying oppressive methods used to push them through. The cases of kampongs in which the communities stood firm against the developers’ gangsters, enforcement officers, the FRU and their water cannons. So is the case at Bukit Merah where the involvement and support of the local community was sustained throughout the campaign. They carried on the fight for a safe living environment free from radioactive contamination. Today, the communities fighting against the Lynas rare earth plant and the Bukit Koman gold mine are the front lines of this struggle for peoples’ interests before profits.

Their commitment to the struggle, leadership and community solidarity should be emulated by all Malaysian communities. They have shown us that direct action is about empowering people to unite as individuals with a common aim, to change things directly by our own actions.

The reality in Malaysia is a crisis of increasing disparities in the distribution of wealth in the country; between East and West Malaysia; between rural and urban areas; between men and women; the victimisation of marginalised groups including indigenous peoples, urban settlers, plantation communities and other minorities; and the depletion of forest, energy and water resources. The pattern has been that it is the rich and powerful backed by political leaders who decide what is to be produced, which resources to exploit and how much profits will be made. More often than not, it is the politically well-connected companies who get the plum contracts.

Our economy needs planning guided by a highly mobilised labour movement and high level of participation in civil society. There must be plural forms of ownership without unaccountable concentration of private power, a mixture of plan and market as well as a vibrant co-operative and communal sector. Within the workplace and in the wider society, there must be democratic forms of participation. The goal of production is to meet human needs although there is a role for regulated markets such as for intermediate need goods, eg. clothing, foodstuffs.

The peoples’ interests must extend to supporting peoples in other countries who are victims of imperialist aggression. Suaram has also been consistent in opposing and condemning US / western imperialism all these years. We are part of the “Stop the War Coalition” and have coordinated Anti-US demonstrations and protests against the US-led occupation of Iraq and Afghanistan and Israeli atrocities in Gaza.

4. A Third Force against Neo-liberalism

Thus NGOs must continue to serve the people by building the third force that works toward the defeat of neo-liberalism and reclaiming Malaysian resources for the Malaysian peoples. Its first objective is the overthrow of the BN regime that has divided and oppressed the Malaysian peoples since Independence and thrived on neo-liberal capitalist exploitation. As in the 2008 general elections, we must forge a strategic alliance with Pakatan Rakyat to overthrow the BN coalition and to reinstate our basic freedoms, liberal democracy and human rights.

In the course of this strategic alliance and knowing the sizeable number of defections from Pakatan Rakyat to BN after the 2008 elections, we hope that Pakatan Rakyat will compromise realistically with the Third Force when the time comes for candidates’ selection.

Within the Peoples’ Front, NGOs can play a crucial role in adjudicating the selection of candidates and ensuring we do not have any more toads, donkeys or moronic oxen that we saw after the 2008 general elections. To avoid the usual horse trading and bad form it gives the federal opposition, NGOs can form an ‘Independent Peoples’ Candidates’ Selection Committee’ to objectively vet the suitability of the peoples’ candidates for the 13th general elections and prevent three cornered fights in any constituency. Respected leaders among the NGOs will be the most suitable impartial members of this committee. In the process, this will also help the Peoples’ Front by minimizing the bickering that invariably happens during the inter-party negotiations before every general election. This NGO committee should also adjudicate the claims by the PR parties regarding their claims to particular constituencies.

After the downfall of BN, the struggle against neo-liberal capitalism will certainly go on under a PR government as we fight for the rights and interests of the people. Pakatan Rakyat has not renounced neo-liberal policies which have allowed multi-national corporations and the big companies to plunder the country’s resources, buying up privatized resources at rock bottom prices. Powerful capitalist interests control our resources and markets and thrive on the cheap labour of Maslaysian workers and migrant labour. The price has been paid by workers and the poor whose living standards continue to be pushed downwards.

This resistance to unrestrained neo-liberalism is simultaneously to empower oppressed people in the process of democratic participatory socialism. Popular democratic participation is not just in economic but also political institutions. There is a need for state intervention and nationalization of basic resources such as oil and gas; utilities such as water, energy; health, education and social services. Unfettered capital transfers by speculators and finance capitalists must also be checked.

Only through direct action and mass movement will there to be true grassroots democracy. Power should be based on the self-organisation of workers and other communities in their struggle against capital. Directly elected workplace and community councils take responsibility for their own affairs and this is linked to decisions for society at large.

Real democracy will never be attained merely through periodic general elections and relying on parliament alone. To make democracy work, we must step up the demands we make from outside Parliament. Democracy is more than simply voting once in five years for as the saying goes,

“If voting in the general elections ever changed anything, they would have abolished it by now!”

鉴于徐袖珉长期以来顽固推行她的“颜色革命”理念和“舔美仇华”思想,蓄意扰乱人民之友一贯以来的“反对霸权主义,反对种族主义”政治立场,阴谋分化甚至瓦解人民之友推动真正民主改革的思想阵地,人民之友工委会经过长时间的考察和验证,在2020年9月27日会议议决;为了明确人民之友创立以来的政治立场以及贯彻人民之友现阶段以及今后的政治主张,必须将徐袖珉从工委会名单上除名,并在人民之友部落格发出通告,以绝后患。

年轻一辈人民之友有感而作


注:这“漫画新解”是反映一名自诩“智慧高人一等”而且“精于民主理论”的老姐又再突发奇想地运用她所学会的一丁点“颜色革命”理论和伎俩来征服人民之友队伍里的学弟学妹们的心理状态——她在10多年前曾在队伍里因时时表现自己是超群精英,事事都要别人服从她的意愿而人人“惊而远之”,她因此而被挤出队伍近10年之久。

她在三年前被一名年长工委推介,重新加入人民之友队伍。可是,就在今年年初她又再故态复萌,尤其是在3月以来,不断利用部落格的贴文,任意扭曲而胡说八道。起初,还以“不同意见者”的姿态出现,以博取一些不明就里的队友对她的同情和支持,后来,她发现了她的欺骗伎俩无法得逞之后,索性撤下了假面具,对人民之友一贯的“反对霸权主义、反对种族主义”的政治立场,发出歇斯底里的叫嚣,而暴露她设想人民之友“改旗易帜”的真面目!

尤其是在新冠病毒疫情(COVID-19)课题上,她公然猖狂跟人民之友的政治立场对着干,指责人民之友服务于中国文宣或大中华,是 “中国海外统治部”、“中华小红卫兵”等等等等。她甚至通过强硬粗暴手段擅自把我们的WhatsApp群组名称“Sahabat Rakyat Malaysia”改为“吐槽美国样衰俱乐部”这样的无耻行动也做得出来。她的这种种露骨的表现足以说明了她是一名赤裸裸的“反中仇华”份子。

其实,在我们年轻队友看来,这名嘲讽我们“浪费了20年青春”[人民之友成立至今近20年(2001-9-9迄今)]并想要“拯救我们年轻工委”的这位“徐大姐”,她的思想依然停留在20年前的上个世纪。她初始或许是不自觉接受了“西方民主”和“颜色革命”思想的培养,而如今却是自觉地为维护美国的全球霸权统治而与反对美国霸权支配全球的中国人民和全世界各国(包括马来西亚)人民为敌。她是那么狂妄自大,却是多么幼稚可笑啊!

她所说的“你们浪费了20年青春”正好送回给她和她的跟班,让他们把她的这句话吞到自己的肚子里去!
